Judge Judy Episode 9868 Best Amazing Cases Season 2024
of money garnished by the IRS and for his share of their son's medical bills
order all rise yeah it's case number 515 onc in
the matter Vann versus acrian thank you you're welcome judge P have been sworn in you may be seated folks have a seat
miss vanan when were you and Mr Raman married 1994 to uh 2007 and you have one
child yes ma'am how long did you and Mr rakan live together we lived together probably from 19
92 to 2006 so far is that correct sir yes ma'am your one child is 15 and I
believe for my reading of the paper that Mr Raman has custody of that child is that correct correct is that correct yes
ma'am and you are under a child support order for that child yes ma'am I am is it correct that you are currently in AAR
on your child support and your driver's license was suspended because of that yes maam you are $115,000 in AAR that is
not accurate how much in re are you closer to 16 your honor I didn't
actually come to court to prepare to prove uh what I've paid on top support that's not my
question on file it says $115,000 but I can prove that I don't owe that much there was a period of just a second and
your license was suspended in January of this year 2011 for non mistake at my job
for nonpayment of Child Support is that correct no ma'am was your driver's license suspended in January yes ma'am
what was it suspended for for non-payment of child support
that's what I said there was a clerical error that my payroll department made maybe yes maybe no this is what your
lawsuit is about first you claim that your wages might be garnished and you
have to pay an IRS debt that was ACW during the time that you and Mr rakaman
lived together so you want him to be responsible for half of that IRS debt
yes ma'am okay when were you notified of that IRS debt I had made attempts in
2008 to make this right with the IRS I didn't get far enough in the process
before they levied my account in 2009 Miss ban when did this IRS debt acrew
from what year to what year I'm sorry uh the years of 2000 through 2006 that's
not correct you're honor what years 2003 to 2006 and you were still married then
is that right Mr Raman yes ma'am and you were divorced in 2007 correct when if ever were you
notified of this deficiency after her license was suspended she filed the lawsuit a week later for the back taxes
that's first I found out about it Miss van Beren when for the first time did you have communication either by email
or letter with Mr aaman that you had received the notice of deficiency from
the IRS we both knew in that matter don't tell me what we knew I notified
him of the levy of my account either the day of the day after the day of or the day after what when they levied my
account show me your initial notice from the Internal Revenue Service what I have is a bank statement that's no good I
want to see the statement from the IRS indicating I have documentation with me from the IRS you're H I'd like to take a
look at it do you have any documentation with you from the IRS I have tax returns that's not what I
want may I request some assistance from my witness please who is your witness Jason schwier who is it my boyfriend
no 2004 you were still living together 2005 you were still living together 2009
you were divorced right correct 2003 I'm not interested in well this is to you Miss Sacrament
indicating that you worked out of tax repayment plan with the IRS there's a
letter here December 31st 2009 indicating that there was an overpayment
on his tax return of $34 but that's after the divorce right that was supposed to be a refund and they added
it to the back taxes what do you mean they added it you mean they paid down the back taxes correct correct and how
many times did they do that I think that was the only time okay and how much have
you paid them back I paid them with my refunds that I have filed in 20078 and N
all that was taken from me not seven how much was taken in 2008 and how much was taken in 2009 all of them and I don't
have the amounts with me well then I can't help you how am I supposed to help you he had his refund taken and appli to
back taxes as well how do you expect me to make it as equal as I can if you
don't know how much they took of your refund do you understand what I'm saying yeah
okay judge Judy continues in a moment what are you doing here what do you want
here why did you file this claim speak no and later today there has to be some
basis for a lawsuit otherwise what you do is you clog up the courts I agree with with
[Music] [Applause] nonsense real cases real people Judge
Judy Michelle vanan says ex-husband Chris Akerman owes for money garnished
from her account by the I RS and for half of their son's unreimbursed medical
bills miss vanan you want to tell me what you believe that Mr aan owes you
with regard to unpaid medical expenses for your child February 7th of 2010 our
son was involved in a serious accident he was taken to emergency room and then
transported by ambulance uh to another hospital to receive emergency surgery okay I've gotten all the bills paid
except for just under 5,000 of that have my divorce decree stating that he was responsible for half does your divorce
decree say who's supposed to have insurance for him she supposed to have insurance yes ma'am you're shouting out
and I am and I've always insured my child but your insurance lapsed yes it did I have always had my son covered the
insurance company that I have through my job has a verifications benefits company I have a document stating that they had
him covered in 2010 they had dropped the wrong dependent it was a big mess I said look you need to switch this you need to
take my ex-husband off that had been my ex-husband for 3 years I said you need to take him off and there put my child back on when I went to reenroll him for
coverage they should have never denied him to begin with they said that I failed to provide proper documents for
the insurability of him in other words I needed to prove insurability after three trips to the courthouse birth
certificate social security card they were not happy with the two pages that I provided of my divorce decree Mr uran
your judgment of divorce provides that you are to maintain insurance for the child
the insurance lapsed through no fault of his whether it was your fault or a
combination your fault and the insurance company's fault what you're asking me to do is to say because you were under
Court audit to provide insurance which I did provide insurance man no if you did then we wouldn't be here
exactly I had him covered then you would have had no medical bills well I can't get all the medical bills or some of the
medical bills are not going to pay Miss vanen he did not have any insurance I mean you can't have it both ways at the
time of his accident was he insured or not insured he was not insured but I got the bills paid I got him covered and
then after that I got him continuous coverage to the the state of Georgia Miss vanen you're not following my
question two answers either he was covered when he was in his accident or
he was not covered was he covered or not covered yes yes what yes he was covered
if he was covered then why did did you have thousands of dollars in medical
bills show me where they applied your insurance to his bills and if your
divorce decree provides that his father should pay for one half of the unreimbursed medical bills I'll be more
than happy to award you half of that but I want to see where you had bills that
were covered by insurance and there was a deductible or something else do you have any of those no I only have the of
course no only had the bills but they didn't pay no because he was not insured
at the time of his accident correct is that correct I had him
covered for the month for the month of the accident he wasn't insured at the
time of the accident I not under the insurance company that provided by my employer no well just a second the bills
that were occurred by this accident was probably a quar of a million dollars he went under two major surgeries okay and
after I thank God that he was alive my sole purpose was to get this child covered because as far as I was
concerned it's not my fault that they dropped my child I have always had my child insured Mr vanur it may not be
your fault but it's not his exactly I don't know whether it's your fault or not but I know it's not his fault
because your divorce decree I mean I've read your papers very carefully provided that you were to make child support
payments and you were to keep them covered by your insurance and your former husband was to pay for one half
of the unreimbursed medical bills that's standard language is that what it says in your divorce degree yes ma'am okay so
all you have to do is show me the bills that were paid by Insurance what your deductible or unreimbursed medical bills
were and I will entertain them and if you don't have those I can't help you I don't have those documents well then I
can't help you Mr Ur and I don't know where you thought you were coming today you know you came here for two different reasons and you don't have paperwork
with her right the you were misinformed by some a that I owe I was not prepared to come here and prove that I have been
providing for my child so I think right from the get-go you don't likee me cuz I haven't been paying my child support
which is not the truth miss van I have been providing for my child you can get exercised but what I'm telling you is
based upon your papers that I read you were aware of this tax debt for a long
time you told me that you were aware of this tax debt for the last three years
so was he he was aware of it listen tow Hey listen to me carefully you can get
as exercised as you like you didn't sue him until after your driver's license
was suspended last month that's when you got angry and don't get angry with him
get my license I'm not on trial here for child support I didn't say you were madam what I'm saying to you what I'm
saying to you madam is you had two issues you brought proof of neither I
only want it fair we were married for 12 years for six years we did not file taxes and he knew that we why should I
be responsible to pay all of this and it's paid in full and that's what I'm happy about miss vuren all I asked you
was to show me what your tax refund but you know what it's paid and
really that's what I so then what are you doing here what do you want here if it's paid and then you're happy with
that then what are you doing here why did you file this claim and if you file the claim it's your responsibility to
bring the paperwork you no because if you knew anything you would have to have
the paperwork here we have paperwork well she doesn't have it here she has bank statement showing pment to the IRS
no is not bank statements IRS statements that show we have taken the following
$34 on your past your IRS debt that's what the letter shows from the IRS
that's what she will have some place not a bank statement that's all thank you that's all your honor listen to me
say goodbye goodbye excuse going step out he knows he owes me half this tax D I had no clue
she lied then and now she's lying about the the insurance on the child I hope that you know we can communicate but I I
don't think it's going to get any better from here I would like to be able to communicate with her but she's very unreasonable and I don't see that happen
and now the next case all parties in the matter of wisman versus kmen step forward Diane wisman is suing former
business associate Molly Carman for expenses she incurred while studying to
become a private detective Miss wisman let me see if I can put in a very
Readers Digest way what this case is about so perhaps I can simplify it for
both myself and for the two of you you wanted to go into the private
investigation business could you st M Carman papers down sor it's not so I'm
sorry not so difficult Miss wisman if you want to go into the private investigation business according to your
complaint you contacted the defendant who had been a private investigator for
quite some time yes ma'am you made some sort of an arrangement with her where she would come and instruct you so that
you could get your license in what jurisdiction Washington State Miss Carman traveled to Washington state from
boyo at her own expense to come and work with you in setting up your business and
doing some training yes ma'am you had no written agreement with her whatsoever and no oral agreement with regard to a
partnership an arrangement to sharing of income I don't know why she did it I don't care but there was no contract
between the two of you so far correct correct correct Miss Carmen according to
your complaint did not follow through with what she had to do to take a test
in Washington state in order to train you and therefore you had to hire
someone else and do some other paperwork in order to get your license yes ma'am and you want her to pay for that yes
ma'am Miss Carmen wants to be compensated for her travel to the state
of Washington even though there was no agreement to compensate her for travel
so far correct correct so what you need Miss wisman is a cause of action and you
don't have a cause of action you don't have a cause of action for breach of contract contract requires an offer an
acceptance and consideration those are the basic parts of any contract whether it be written contract or an oral
contract what was Miss Carman supposed to get out of this arrangement she was
supposed to get part of the ability to be able to work with us I don't know what that means she was going to work
with us and if she came to Washington State she came to Washington State because her son and grandbabies live there I assume that she didn't come just
for you right I assumed that you were an afterthought in her visiting somebody else there I assume she didn't come for
you in any event you don't have a contract that's a nebulous sort of thing she was supposed to get something to
work maybe with us and maybe that's not a contract bird has
this I need this he knows how much I need this this is a calculator so I say
bird would you sell this to me and he says I'll sell it to you for $5 I give him $5 offer acceptance the $5 is
consideration now I have this whether it's oral or in writing that's a contract but you have no contract you
asked her for help she came it didn't work out so you had to do what you had to do in order to get licensed she's not
responsible for that you understand I thought I might tell you that now under what theory do you think you're entitled
to be compensated for your travel to the state of Washington well your honor she
was in a hurry I wouldn't have traveled on those dates but she was on medical
leave from her job care about that that she tell you she would reimburse you for your travel no she did not but I was
doing it out of the kindness of my heart good then what are you bothering the court for no good deed goes unpunished I
mean but I don't understand why you bothering the courts with your lawsuits I don't think I'm bothering you hopefully I actually actually it is
there has to be some basis for a lawsuit otherwise what you do is you clog up the
courts I agree with nonsense and put your hand down there has to be some basis for a
lawsuit either in negligence right contract breach of warranty I do believe
there was negligence ma'am there wasn't negligence Madam she has to owe you a duty she doesn't owe you a duty to take
a test so that she could train you but she agreed to you honor Mary say she aged Wiman you didn't put your ears on
there has to be offer acceptance and consideration you do not have a contract with her put your hand down I'm sorry
bird wants his room cleaned he's very messy I say I have
nothing to do on Saturday I'll come over and clean your room on Saturday I said
what am I crazy I'm not going to go over and clean Bird's room or I go over there on Saturday I look at it and I say you
know this is a real pigpen I'm not cleaning this room and bird said you said you would come over and clean my
room and now I'm going to go and hire somebody and pay him $200 to clean my room room and charge you for it exactly
well that's exactly what you're doing now is that clear to you now I'm clear
good Chase is dismissed thank you very much thank you Donna are suing Kiana's ant Ronda battle for the return of
property Left Behind after Kiana was kicked out of her home all
R that's case number 543 on the calendar in the matter of Brown versus battle thank you you're welcome judge P have
been sworn in you may be seated folks have a seat please Miss Brown this is your daughter yes ma'am this is your
sister yes and this is your Aunt yes ma'am according to what I gather from your complaint there came a time when
you moved and your daughter who was a senior in high school would have had to traveled 2 hours each way to school yes
your sister who had just purchased a home close by to the school volunteered to take your daughter in and have her
live with her so that her commute would be an easy one to school you accepted
and your daughter went to live in her house and she lived there for several months is that what I gather a few
months yes then something happened involving a bank account money that was being withdrawn from your account by
some sort of link that had been set up erroneously when she was drawing money
out it wasn't supposed to come out of your account but it did and there was some problem with the bank in any event
you left and it is your claim that your sister refuse to give your daughter back
her property that's what you're suing her for yes ma'am your sister says that in her counter claim you owe her for
some collect calls that were received by your daughter from her boyfriend who was in jail and lost wages nonsense I don't
know what that's about that forget that anyway that's your counter coin what property do you say your sister still
has at her house everything Kiana just a sec I asked you specifically what you
think she has there bad just a minute bed do you have the bed yes ma'am that
goes back what else TV DVD player when did she purchase it about 5 years ago
okay do you have that no ma'am where is it she took it I don't know where it is well let's go through this very carefully what property do you have in
your house and let's be very careful about it what property do you have in your house that belongs to your niece
Okay the reason why a bed was still remaining in my home is because Kiana still freaking my house but according to
living things she was no longer living there so I do no longer living there when mid November where did she go in
mid November she went home with her mom why I didn't go home with my mom I was still living with her um our Christmas
break I went home with my mom for 2 weeks Christmas break started when it started um December 21st when did you
start living with your aunt I started living with my aunt in the summer of August so you were there August
September October November and according to December yes ma'am how much money did you give your sister towards your daughter support nothing she said she
didn't need anything but I did just a second so for the 5 months that your daughter lived there according to you
you gave her no support for your child do you work yes I work you have other children yes I do how many other
children I have two other children how old are they 14 and 16 and who else lives in your home my boyfriend and he
works he's unemployed at the moment do your daughter's father provide her with child support he's deceased so she gets
Social Security disability up until last month month she got while she was living
with your sister Social Security Disability yes in what amount $93 how often every month okay so the
$93 a month that your daughter receives from Social Security you did not turn over to your sister no any reason for
that well I purchased deodorant uh bus pass any Necessities that she needed I
provided for her as well as groceries I did uh take her to the grocery store let
her get groceries when ever she needed I'm just finding out what's going on here because I have to make a determination who's lying and who's
telling the truth your honor I have proof as well miss battle is lying Kiana
never moved out of her residence Kiana was thrown out on January the 18th of
2008 after the incident at the bank I went to Rhonda she called me first of
all I rate I was at work I told her I will call you when I calm down because she upset me I got off work early I went
home called Miss battle asked her what was going on she informed me that her
checking account card and ke's savings account card were linked together so I
told her I needed to meet her at the bank so I can find out for myself from the bank got to the bank spoke to a
tailor he told me three times in front of Miss battle and Kiana that the two cars were not linked together so at that
point I told Rhonda I'm not writing a check because they said they weren't linked together we proceeded to leave
driving down the street same street that Rhonda lives on I see her throwing my daughter's things in the street I pull
over ask her what is she doing she tells me your daughter stole my money I stated
to her what did the bank tell you at that point she lunged at me and attacked me in my face and as she attacked me I
grabbed her hand as it was raking down my face my mouth was open her fingers were stuck in my mouth I grabbed her
hand she pulled my hair so I pulled her hair oh that all very Unbecoming behavor
ultimately turned out Miss Brown that the bank had made a mistake and that the cards were linked just a minute
ultimately the bank called you and said oops sorry we made a mistake were in fact linked the money that your daughter
was taking out she was taking out of your sister's bank account yes so that she was right so that the bad behavior
that erupted after you went to the bank and they gave you erroneous information but that is incorrect I have the bank
statement with the date and the time that we both went to the bank showing that the accounts that the monies was
taken out the account I have that statement I understand that but she says that when you went to the bank and the two of you spoke to a teller yes the
idiot teller said to you no that's not true they're not linked no your honor that is not true what if the the teller
did not have a chance to explain any of that to us what were you told when you left the bank initially when we left the
bank the teller was was undetermined we didn't get any answers she walked out just a second she says the tella said no
they weren't turned out that they called her two weeks later I asked them to call
her because she was calling the bank the bank manager called me personally and said that Miss Brown was pretending to
be me that was someone's pretending to be me she want whatever you listen I don't have to go there it's not necessary we're just saying it turns out
that you were right yes ma'am and she was wrong but you were both wrong for having escalated this thing into
something that was pretty ugly yes ma' now when she was throwing your daughter's things out on the lawn in
front of her house what was she throwing out her bras her underwear she had her a
whole stack of her jeans that she grabbed from the what did you do with them I didn't pick the stuff up I was
asking Rhonda as I was talking to Rhonda she was picking it up throwing it in her trunk and she closed her trunk down who
did miss battle why would she throw it out and then put it in in her CU she didn't want us to get it nah come on
Judge Judy continues in a moment I have problem believing both of you I really do I think that the two of you
are so invested in being bitter with each other that you just are prepared to say anything that's necessary both of
[Music] you real cases real people Judge Judy
Kiana Brown says her aunt Ronda battle won't return her belongings Rhonda is
accusing Kiana of stealing money from her bank account and is counters suing for lost wages and a phone bill listen
to me Miss Brown let me tell you what's distressing to me what's distressing to me is that according to your daughter
for the 5 months that she lived with your sister and your sister took care of her provided a roof over her head
provided her food and snacks and milk and Juice whatever light air everything else put your hand down put your hand
down you were receiving money from the government that should have gone to your sister I'm telling you it should have
gone to your sister because you were not providing a home for your daughter who was being cared for by another person
that person should have had the support that the government was providing that alone according to your daughter is $500
now I have to make a judgment as to who's telling me the truth your sister Who provided a home free of charge for
her niece in order to make her niece's life more comfortable or you who got money from the government did not send
it where it should have gone you say there's $55,000 worth of property that your daughter had at your sister's house
and I have a witness to that my other sister who really doesn't want to be here to testify but she is willing to
tell the truth because my daughter never moved from Rhonda's house whether she moved or not I don't believe that you
had $5,000 worth of property at your sister's house what what I had DVD
players worth $200 iPods that I bought over a period of time I love Jordans and
Nikes three $400 worth of shoes you had a DVD player yes ma'am I had and you had
an iPod I had DVD players iPod just a had a DVD player yes ma'am Port not
players you had a DVD player yes ma'am when did you purchase it I actually got it for Christmas in two this Christmas
from my mother's boyfriend how much do those things cost I have no idea they cost about 200 and you had an ip7 250
you had an iPod I had an iPod and it cost 170 okay we have a digital shff and
my digital camera and I had Jordans I had Jordan one Retro Ones Jordan Retro
fours Jordan Retro 133 I don't know what you're talking about a pair of sneakers their shoes
tennis shoet cost right these kids been your honor Miss Brown is elaborating on
items that she does not have or did not have in my home your honor my daughter
father is deceased she had member Bila pictures wedding tapes she had jewelry
she didn't receive anything but what she had on her back you do you have any of this memorabilia of hers no ma'am I do
not did you have in your house at one point I did and what happened to it when Kiana moved out in November because of
the phone bills which is my counter claim if I may go ahead while Kiana was living in my home she was accepting
collect calls bounced to me from her boyfriend in juvenile hall she ran up my a boyfriend his name is gante and why
were you accepting these collect calls from him I actually paid that off with the money I earned from work I paid
everything off she never had permiss calls who did you pay I paid miss battle the same day that we went to to the bank
and opened the account well wa just a second when did you pay her give me the date give me the month it was when I
first got my job it was my first check that I earned I'm not sure when give me the month I started working in October
so you got your first check and you paid her for these collect calls so that would have been in October yes ma'am she
say she gave you a check to cover some of those calls some or all of those calls sometime in October is that
correct no ma'am she did not um in fact they eventually cut off phone and it went to collections which is very upset
can I see them please yes ma'am she admits to having a relationship with the with the boy in jail your honor mhm um
when Rhonda called me and told me Kiana was accepting collect calls from her boyfriend from juvenile hall I told
Ronda that Kiana needs to be responsible her first check Rhonda took her to open
up a savings account you weren't there don't tell me I talked to her you weren't there don't tell me well she
told me that she paid her the money cuz I asked her you know something I have problem believing both of you I really
do I think that the two of you are so invested in being bitter with each other that you just are prepared to say anything that's necessary both of you I
do believe that your sister took some stuff cuz she was Furious that she says that you were assaultive to her she said
that you scratched her face that she couldn't go to work she was I'm just a minute I'm telling you what she says and
because she says that whe true or it's not true she I assume she believes that that's what happened and you said she
pulled my hair I did what I had to do to defend myself probably shouldn't have stopped the car at that point you
probably should have just gone to the police and said her stuff is outside and I don't want to get involved with it because my sister's too angry but there
was a time when your sister was very loving and very supportive of both you and your daughter and me her just a
second did you ever take care of her children in your house yes I've taken her son when he was 2 weeks old she was
tired needed some help how long did he stay with you um every other weekend
sometimes oh listen we're not talking about the same thing we're talking about having a teenage child living with her a
child who has limited judgment if she's got a boyfriend in falsom juvenile DET well that's where the collect calls come
from fome California okay right so a teenager with limited judgment living in
her house because it's more convenient for her to get to school that is not something that somebody does who's a bad
person so clearly something happened between the two of you with got in between the two of you was a teenager
that's what got in between the two of you and teenager who inadvertently got some funds taken out of an account that
shouldn't have been you did not support your sister when she said it happened I mean I got what don't show me
receipts you didn't say to your sister look I don't know what happened whatever
happened I'll take care of it if that's what happened you said prove it to me meet me at the bank you got to the bank
and the bank didn't right away say listen we made a mistake so you said you see my daughter was right you were wrong
you accused her of taking money out of your account and that was wrong and your left turned out she was right but what
got in between you two formerly loving sisters because you used to take care of her baby she took care of your bigger
baby turned into an ugly vicious situation ugly and vicious because she
tried to do something that was good and positive for your daughter and because of circumstances over which neither one
of you had control but over which both of you acted badly your honor once I found out I went immediately and I paid
that bill I got you the damage was already done the fight had already taken place yes ma'am the scratching had
already taken place the hair pulling had already taken place she had already tossed out your daughter's stuff cuz she
was angry tossed it out sold it whatever and she probably if it took two weeks for the bank to come up with the
ultimate solution which was they were wrong it was probably if she did sell
some property that belonged to your daughter probably within that 2E period that she did it until the bank notified
her that you would come in and made restitution on that account I have I also what your honor I also have um
documentation from Kiana school where this incident has really brought
emotional distress from her teacher I'm listen I'm sure about that I've also had receipts where I had to replace
eyeglasses it's enough okay it's enough you got to let it rest
but I don't I don't have nothing she has all my stuff I don't
think she has your stuff anymore I had DVD players that I bought that my mom
helped me buy everything that I ever owned everything from my mom's house why
do you think she would do that because she thought I stole her money which I didn't and we have receipts saying we
paid her back I have receipts I had to go buy all new stuff just a second you
paid her back for what for the money that they said that um was taken off of
my card just a minute you were using a credit card no it's a a bank deit deit
card a savings account card and you had money in your savings account yes ma'am
so instead of taking the money out of your savings account they were taking it out of her checking account yes ma'am over what period of time they said it
was for like I just barely got the card I was supposed to have first card come but I guess she said she had it in her
safe so she ordered another card and so she when she finally gave it to me it was open and everything so I was like
okay you know I finally got my card you know I was still putting money it's my senior year you know it's my year to be
18 and I can't do nothing because I have to buy all new stuff I can't really
concentrate on school because well start concentrating on school this is just stuff they're just things but these are
things very unfortunate my dad pictures my dad is dead well that when if you if
you had those things and if you no longer have them miss battle because you got angry with your sister and you got angry with your niece and in a fit of
anger you threw them out if you threw those things out that was absolutely a terrible thing to do you understand that
if I done that that would have been a terrible thing to do your honor but those things were not in my home the things that are packable should be put
in a box and shipped to them the bed if you want it you'll have to arrange for a marshall to be there to escort you in to
pick it up so those things are going to be returned to you I'm awarding you $1,500 for clothes and the replacement
value for an iPod DVD player some sneakers Etc $500 for punitive damage is
because I do believe that you threw away the pictures and her memorabilia which are irreplaceable because you were in a
bad mood that's $2,000 now I was going to deduct the $500 that I think that you
should have paid to your sister for the support of your daughter for the five months that you alleged she was there
instead I think that you should take $500 out of your pocket and add that to your daughter's losses which would make
$2500 that she has to spend to replace her stuff do you understand yes ma'am okay and on your count to claim this
battle I don't think that you had any losses whatsoever and I do believe that this young lady paid you for the phone bill so your counter claims dismissed
that's all parties are excuse you may step Assan says Mari is
exaggerating order all
rise yeah this is case number 467 on the account in the matter of Bailey versus Smith parties have been sworn in judge
you may be seated ma'am have a seat please Miss Bailey the defendant was a former friend boyfriend of yours you
claim a series of loans to him he says whatever money that you gave him were gifts correct yes who is this my
girlfriend why is she here because uh she spoke to more after the incident happened and she explained to her what
happened I don't know what incident you're talking about you'll tell me I'm sure miss Bailey did you date him for a
period of time yes I dated him for a period of about eight months during my senior year of high school and how long
ago was that that was in everything ended around August of 2000 and how old
were you at the time we broke up I was 18 where'd you get this money from I had
an inheritance from an aunt she had died when I was 13 and she had left me this money so I could go to college and I
decided to go to a hunter college so I had a little left over and you were able to take the money out yourself yes it
was left to me and when I turned 18 it was turned over to me okay the first Lo was in August yes for what um it was
$2,000 because he said he wanted a new car um his car had been crashed quite a
few times and they couldn't fix it or it was too much money to fix it whatever he wanted a new car and so I lent it to him
and I explicitly said it's a loan and I will need this money back did he say when he would pay you back he never
really said anything he'll just said you get it by next year when I could get money back whatever you'll get it byy
next year whatever is not a contract did she give you $2,000 no no no show me proof that you gave him
$2,000 I have um Bank receipts from that month there was actually a lot of transactions where he would do is he
would call me and he would wake me up in the morning and take me to the ATM before the banks could open so I would
have to go to the ATM because the ATM could only take out $800 at a time I would have to go to three different ATMs
on a day and because there was only a certain amount of money that I could take out at on a certain day I had to go
to two days so my bank receipts reflect that does that sound more familiar Mr
Smith no it doesn't doesn't so you never got this money I got a portion of the money which much $700 my car cost my car
actually cost $750 which I did receive from Mari and which I told her I was a pay her back which I did not pay her
back at the time why but uh I don't we we broke up before she got it and uh I
wasn't you know able to get in contact with off things I work I'm uh engineering training so I cannot have
waking up in the morning and gone to see her because I be work at 7:00 in the morning I get out of work at 3:30 and
she was okay I don't care about your work you borrowed this money from her uh not 2,000 though no $750 okay $750 I do
I do say I do owe that I do do owe that money but excuse me there was also um
about $1,400 he couldn't afford her insurance so I paid two mon Insurance let's let me
take care of this okay okay but in your answer sir you don't say that you owe her the money and
your answer you say I needed a car and she offered to help me buy a car yes she offered to give me the money she offered
but I owe that money cuz she gave me that money gave you didn't say that here you didn't agree that you ow her that
money all right 750 what else there was also he his insurance was about $711 a month on two
months one was September of 200000 the other one was October of 2000 he could not afford to pay his insurance so I
paid two months of insurance and the total came out to about 1,400 each check was
$71.7 and I have the checks here which were not cash cuz I did not have any checks to cash I didn't have a b count the cash you cannot cash a personal
check at a check cashing you must cash it was written out to the place so but I
did not the check what happened is they did an electronic check or something I handed him the original check that I
wrote out and that's the check that was sent to my bank so the check was cashed and he got it my insurance was canceled
October of 2000 so I'm not understanding how she says that I I have uh paid money
for my insurance be uh R out and paid for by my by the insurance company did you ever have a conversation with her
about your car insurance of course you did because if you say your car insurance was cancelled then you must have had a discussion with her she was
your girlfriend about I don't have money for car insurance I have two checks made payable for
$71.7 they're bank checks yes what was that for sir that wasn't to me at the time when she wrote out just a second
that went to you yes but I did not cash it when she wrote after me she was still there I told her I couldn't cash a check
I didn't want it I didn't want the check she took it back to I couldn't so I gave it back to her and then it was open I
couldn't cash a check cuz I didn't have a bank at the time I could not have no way I cash a check any was my insurance company they would but they even no they
would have mail me a copy of the check all it was paid both of these checks I paid my my insurance company was
canceled and I had I had another insurance company with my mother's these were paid sir Capital payment plan okay
yes what else um I have a tape here he knew it was Al loan he always knew it
was Al loone every time when I gave him those checks I said when am I getting back my money every time we had a
conversation it would be about when I am I getting back my money and what I want to know is what the girlfriend is doing
here the girlfriend what happened is he found out I was suing him he calls me I
told him I'm I will see you in court I will not talk about this over the phone and his girlfriend calls me and that's
what happened stand up here what did you call her for I called her to speak to her about um what I just wanted to know
why she was suing him exactly no I I wanted to know the reason why like how how it went about
like the situation bus because he's my boyfriend that's the reason why I wanted to know why I just wanted to know why he
told me he didn't owe her any money that's why didn't owe her any money to start with exactly and that's why I called her to find out she told me that
um she paid for his car she told me the same exact thing and she actually told me that after she broke up with him that
that's when she had gave him $700 for his to pay for his car and she told me that she spent a lot of money on him she
bought him a lot of gifts and all this gifts is not what we're talking about well that's she said she spent a lot of money on him sure she did she
18-year-old got a hands on some money and then and that's the problem but this money was for his car and his car
insurance but $3,000 it doesn't add up at all no 2150 is what it adds up to well actually there's a lot more money
he's I get I did give loan him the $2,000 he's saying it's 700 right now if you next time you loan somebody money
Miss barley and if you think there's going to be a disput us to the amount get a note what else um there's a taper
he he was fully aware there was a loan he called my machine let me see real cases real people Judge Judy Marie
Bailey says ex-boyfriend Hassan Smith owes for several unpaid loans and she
has an audio tape to prove it go ahead
5116 p.m January 23rd crazy I don't know what you're doing but for come back this
long for 3 years later and sue me for $3,000 I don't know what the hell is s me for sue you as you put me through I
spend your mother's house and me helping you you live over me so therefore I should kind of Sue you but we'll see about this in becausein
way me wish I understood a word you was
saying I was saying that she was Su me $50,000 3 years later which was way too
weird because when she did call me and want the money I told her I will give her the money no problem but the her it
came so sudden for her to come to court and say I owe $3,000 it hit me was such shocked that saying $3,000 that I it was
shocked that $3,000 out of $700 from $3,000 it was pretty weird Insurance you forgot about the insurance Mr Smith you
forgot about the insurance you mean you were shocked that 3 years later she came to you and said I want my money yes but
she could have made me sign a contract and I would GL I sign a contract for the money I owe her but she didn't yeah J
please go ahead I'm listening to you okay oh and bank statement saying that
she wrote checked out to me if it wasn't my insurance company I I would like to have a receipt from my sh saying it was paid in full know all
they mail they always how is she going to get that because the check is Ru out from her her address so they mail a copy
of what is paid a receipt and the and the mail with that always I have a check account too they always do that they mail it to the person who wrote the
check rather than to the insured that says your insurance is now paid we want to let you know that the check wasn't
out to me why would they mail back to me uh because maybe she didn't trust you and you told me you didn't have a checking account at the time so well I
don't care what you have now now is not important Mr Smith do you think you're smarter than I am no I'm not turn right
judgment for the plaintiff in the amount of $2,150 goodbye parties are excused you may step out we had a a baby together
which died and uh I broke up with her so suddenly and she hated me for that I don't know why he's bringing up the past
history it was not brought up in the case I don't know why he's trying to bring it up trying to make me look bad or whatever but it has nothing to do
with it I don't hate for I don't want to have any contact with the defendant or anything and I'm just so happy to have him out my life for good things like
this happen all the time with people who are mad because they got left by somebody who doesn't want them anymore I
don't want him I am happily engaged I have a new life I guess money makes the world go around that's one thing that
can make you happy if you can't have that person that you want I don't even think about him except the money that he owed me don't get relationship when
involv money if he wants to think that I still want him let him if that makes him sleep better at night whatever and now
the next case all parties in the matter of luga versus Kavanaugh step forward please 21-year-old store manager IET
luga is suing her ex-boyfriend 22-year-old construction worker James Kavanaugh for the unpaid balance on a
car he total miss luga the defendant was a former boyfriend of yours in addition
to just being a boyfriend you had a car that was titled in both of your names he paid for the insurance on the car but it
was your car there was a car loan on the car is that right right he got into an accident and total the car so far is
that right yes the insurance company total the car and gave you a check but the je did not cover the car loan and
there is still about $1,800 left that you owe the loan company on the car is that what the case is about yes Mr
Kavanaugh when were you in this accident sir uh it was uh May 28th 2001 tell me
about the accident well we were coming back from the airport and stop playing with papers look at me okay we were
coming back from the airport from St Louis who's we the two of you the two of us yes she was in the passenger seat we were going through an intersection and
the light was green she swore the light was Green at one time went through the intersection another car we collided no
Witnesses stopped on our behalf uh the other car had a witness stopped said they had a green light so I was at fault
for the accident cuz I had no Witnesses uh she was in maybe you were just at fault in the accident because you were at fault uh no the light was green I'm
sorry if the light was green I'm going did you hit them or did they hit you we hit each other how was that because the
two corners hit together I mean I didn't see them they just ran they went right through the light and we CL I never saw
the car coming through the intersection cuz I was halfway through the intersection before you know we even hit so the insurance company found that you
were at fault is that right yeah I guess I mean the the high the highway patrol
put me at fault now I guess the insurance goes by that or if they go by their own I don't know whatever those
people who were responsible for finding who's at fault found you at fault yes okay and when had you purchased this car
we had purchased it in last September when you say we purchased it you purchased it together yeah was the
primary person on the car and I was the co-signer but it was supposed to be the other way around and they messed it up I
don't care what they what is it now who owes the $1,800 right now I'm the primary person
why is that because we switched the names back when back in June after the
accident yes why because I was the one making the payments on it and I wanted to have credit for
it at the time that this accident occurred that he caused he he was the
primary on the car right and on the loan is that right cor right who was making payments prior to May 28th I was why
were you making the payments because it was my car well then why was he ever the primary cuz alone people were stupid
mess it up they put my name wrong they put it the paperwork wrong when I signed the papers I asked them this puts me as
co-signer because I've never signed for a car before co-signer nothing so I believed the uh people we bought the car
from and said so I'm on as cosigner they said yes so we signed the papers come to find out later on they put me as primary
and her's co-signer so when we found that out since she was making the payments it was her car we switched the
names you mean the payments for a car that no longer existed what's that in June after the accident the car no
longer existed yeah is that right that's right how much did they give you for this car about 7,000 $
7,311 and how much was owing on the car that much I don't have the exact amount on that cuz how come you have a lot of
paperwork I have all the paperwork I need for my case I mean I I don't have the exact amount left on the car they
wouldn't give let me see the information that you have Madam I want to see the loan that was taken out how much the
payout was all that good stuff I have a copy of the title right
here it has a price on it I do have that how many cars did you have when you were living together I had mine and had
hers what when did the two of you part ways in July why he broke up with me cuz
he was some seeing somebody else I see the last payment that you made to Ford Credit was $100 185 is that right right
your honor uh what month was that because I've had to cover one month of that cuz she quit paying on it and didn't tell me so they called me two
days and before they were going to send it to collection agency and informed me that she was three months behind I did
tell you so you made the payment yes I had to make the payment good was your accident now she is right there in the
passenger side your honor she could have very well been driving she gave me permission to drive the car so you know
my insurance paid out all that on it I mean if I was is this your defense now if I was to let her go drive my truck
and she was to wreck it it' be my responsibility to pay for it not hers I mean isn't that right because it is my
my truck and my insurance I mean unless I'm wrong I don't know so that's your defense my defense is I've paid out more
on this car than I think I should have anyway I mean yeah my insurance covered my wreck my part of the wreck but I cover I paid for her insurance the whole
time she had that car so where were you coming or going from that you were coming from the airport we were coming
from St Louis because she had gone to Texas yes vacation see her mom okay so you when you went to pick her up the airport you took her car yes how come
you didn't take your truck cuz her car had more room and we could put her stuff in the trunk had permission to take her
car no I didn't ask for permission I just said how come you didn't take your truck cuz her car has more room I have
an S more room than a truck I have an S10 the cab is a lot smaller than the front seats of a car it's just more
comfortable in a car okay cuz it's you went out for dinner which car did you take what's that what word didn't you
understand sir when the two of you were together I'm speaking intered me when you went out for dinner when you were
living together whose car did you take uh either or most of the time which car did you take there wasn't a most of the
time I mean I guess most the time we took my truck you did I guess yes I doubt it I doubt it you want to know why
women don't ride in the truck if they have car by choice they have no choice they'll ride in a truck but if they have
a choice they'll ride in a sedan that's common sense isn't it bird I'm not a
woman but yeah but you know women my wife prefers
a car right now what kind of work do you do I work construction so you use your
truck for your business but going out on a Saturday night you take the car not
true not true okay of course it's true
sir bottom line is Mr Kavanaugh you not only were driving this car with or
without her permission of course it was with her permission that you were driving the car but you were also
primarily responsible on the loan at the time of the accident I don't care who messed up you bought this car in
September of 2000 if you're old enough to have a car and a Truck and a job then you're old enough to look at paperwork
and see whether it's wrong and you don't switch it after the accident so at the time of the accident you were a at fault
B primary on the loan as cosigner should have been no okay both of our names are right here on this title both of our
names are under owner right it doesn't say who's cosigner who's not when I asked I saw that and when I asked them
who is the co-signer they said me now but it turns out it that doesn't seem to be very clear to me it turns out I I'm
not here to go over their contract as it turns out you were primary right and
knowingly yes not my fault you certainly knowingly one thing you knowingly were involved in an accident which the police
attributed to you as the one at fault so you owe the remainder on this bill why
should she be saddled with it judgment for the plaintiff and the amount of are suing 49-year-old school teacher Linda Y
for the return of their Chihuahua [Music] precious order all rise
[Music] yeah this is case number 119 on the calendar in the matter of Willams versus
Stowers y probably have been sworn in judge you may be seated folks have seats
bird would you uh take the puppy on a leash and hold it over there with you please friendly puppy oh very friendly
great better be better be huh you know I don't like dogs judge right cuz they
said that my son would hold him oh sweet yes he does he really does he really
likes STS you can put them down you put them
down great okay now I don't think this's
a very difficult case the jingles could come off
maybe if you take those off she won't have a collar on well she's not going any place in court all right Mr Mrs
oams according to you you had a dog m a Chihuahua and how long did you have this
dog we had had her for about 4 months and somehow the dog got lost around Christmas time right uh tell me how the
dog got lost well um I guess she had went out in the backyard and then she came up missing and what we had figured
we had people we were putting a pool in our backyard at the time so there were a lot of different contractors coming and going and Miss y you found a dog yes I
was with my son Darren we were up hiking in Cucamonga Canyon which is 2 and a half miles away from where the onions
live and we found her at the end of a dirt road at the trail head to the trail
that goes up into Cucamonga Canyon when did you find her on December 28th and
might I say that when the ons talked to me and when the police were at my house uh the next morning they came back and
said they found their Petco receipt and they had lost their dog on the day of this Petco receipt and it was November
12th is is that what you said I told her that I had lost the dog after I had
taken her to get her um to get her groom by the um Petco who are these two people
the this is my daughter TAA and this is her her schoolmate Karina okay would you step up with your
mom now tell me your name again TAA TAA is this your dog yes how far do you live
from each other or how far do they live from where you found the dog probably about seven long blocks or
so so not far no so when they came to your house I assumed somebody saw the
dog with them how did that happen I was can I talk I was walking my son to the
school bus stop and Karina saw me with chalupa don't tell me what anybody saw
okay I saw Karina with you may have seen her yes I saw her and we spoke she said oh where did you get the cute dog and I
said we found her we're looking for her owner and so that was like a week after we had found her so I was walking Darren
to the bus stop again and by then we had had her for almost three months and I Corina came out of her house and
she said oh cute dog where did you get it and I said we found her hoping that she would remember that that's what I had said before in January well that
afternoon was when the onions called my son and he showed him our dog okay but
it's their dog I don't think so sure it is look a Chihuahua is not one of those
real common breeds of dogs seven blocks away from where you found your dog they
lost their dog dog no we did not Lo find her there we found her 2 and 1/2 miles away when we were hiking oh okay she was
and2 Miles Away 2 and 1/2 miles away at the end of the dirt road so what
do you see any reason whatsoever that these people would come look at this dog
and if it wasn't their dog say to you that's our dog I mean I
have a dog I can tell my dog
excuse me can I say something is this the dog yeah hi precious your dog hi
precious precious okay excuse me but there are lots of Chihuahua I've taken
her to the vet they said their dog had a broken tooth no I have from my vet a report he said this dog has no broken
tooth Miss y by the time they lost their puppy when their puppy was four months old dogs lose their teeth when they're
about five six months old and then they get new teeth I mean I don't understand you you found the dog not far from if
it's 2 miles it's 2 miles if it's seven blocks it's seven blocks in the Foothills where there are bobcats
coyotes Hawks owls that eat dogs there are more than one female Chihuahua in
have you found anyone else in your area who had lost a female Chihuahua my vet says no don't tell me what your vet says
Miss y did you find anyone else who claimed to have lost a female chihuaha
in your general fac for 3 months I was driving around the answer is no before I
decided to have the dog's fade when I went to have her license they said I pay
attention you just keep talking well this is my dog I've had it's not your dog no it's not your dog you found the
dog that was lost by someone you didn't buy the dog I assume you notified the
police at the time you found the dog no I did not why don't you let your daughter take the
dog outside so she's not growling the thing is they have not
shown me any just I'm asking you a question take the first thing that I might do if I found a pedigree animal
was to notify my local police department I wouldn't just drive around the neighborhood and look for signs why
would they say when they first called and left a message on my answering machine they said that this was a male
they lost their male chihuahua that's what I'd like to know too they said they lost a male chihuahua who called her
you're an idea yes I have a tape of it oh let me see let me hear the
tape do I play it right here or right in the microphone we were informed that you
have a dog a chahua dog M uh that is our
dog can you give us a call so that we can come down and pick uh this go is dog
phone number3 did you say on to her that your dog was a male dog I mean I clearly
heard you say male dog yes yeah it was a slip of tongue okay yes did you ever take your dog to have your dog groomed
yes I took get a Petco do they keep a a record of the dogs can I see I would
like to see whether they listed the dog as a male or a female plus I also have um that one I take her to get her shot
I'd like to see that please Judge Judy continues in a moment
somewhere this dog gained 2 months he doesn't know the difference between male and female I'm supposed to worry about 2
months and later today the argument was over marijuana I grabbed her by the head and pushed her out of my room and I fell
um on the hardwood floor down on my wrist real cases real people Judge Judy
chisa oams and his wife aimi say Linda yacht won't return their pet Chihuahua
this y have you seen this yes I have it right here okay and this said that they
still had not had a rabies inoculation on the dog stop telling me about rabies I'm talking about identification and
this says that the dog was 8 months old so somewhere this dog gained two months I mean listen to me he doesn't know the
difference between male and female I'm supposed to worry about two months clearly the dog that they took to the
Animal Hospital the dog they took to be groomed was a female Chihuahua not male
the dog is to be returned to the plaintiffs that's it so thank if I excuse you may step
out I think that's that wasn't their dog cuz away we found her like we found her
in a canyon there's wolves coyotes they're right down the street he can always come by and see the
dog and now the next case all parties on Jones versus Shivers step forward please
31-year-old hairdresser Chad Jones is suing former roommate 30-year-old sales rep Laura Shivers for assaulting him and
breaking their lease Laura is counters suing for attorney fees according to what I've read here you claim that the
defendant moved out after an argument and you are suing her for a month and a
half worth of rent yes ma'am Miss Shivers you on the other hand claim that you moved out because he became violent
yes sure and you had no choice but to leave in addition you are counter claiming for a variety of things some
Bill that you say you had some other expenses and that he filed for an order
of protection against you yes your honor you were forced to hire an attorney and that case was subsequently dismissed
when was the last month that you paid rent um I paid month for the I paid rent for the month of March and I believe the
altercation took place around the 9th or 10th so I paid for a full month and then left on March 8th your honor 8 okay you
had fully paid March's rent yes ma'am all right now let's hear about this argument okay the argument was over
marijuana your honor okay she had come in and she asked me if I wanted any more marijuana and I said sure but I don't
want what I had the last time which was you know if you're not don't know anything about marijuana it was sticks
and seeds and shake and I told her that I didn't want any I didn't want sticks
and seeds and shake the next time around well she went into her bedroom and thought about it for a minute I guess
and came back into my room and said you know that really upset me what you said and I said upset you I was according to
you she felt as if you had dissed her because there was other stuff in the marijuana yes ma'am okay so anyways um I
was sitting on the end of my bed smoking a cigarette and she started flailing her arms a regular cigarette yes a regular
cigarette yes but she had started flailing her arms around at the end of my bed like a baboon and so I had got on
the end of my bed and started flailing my arms around like a baboon and at that point it became physical where Miss Shivers actually pushed me back on the
bed and through the cordless phone at me and so I grabbed her by the head and said get out of my room and pushed her
out of my room into the living room where she hit a rug and did a parette and landed on the floor she comes back
in and she starts pounding on my chest and arms comes back in where into my bedroom so you went back into your
bedroom yes I I never actually had left my bedroom I pushed her just far enough to get her out of my bedroom and after
that she starts screaming I'm moving out and um call the cops and I tell I told her if the cops are coming you make sure
to tell tell them who started the argument and she called the 911 back and told them not to come okay and she moved
out the next day um actually yes she did okay all right Miss Shivers let's see
your version okay um I returned home from work I actually worked late on that evening I got off at 8 um we proceeded
to get into a fight about he said I was a 500 lb sloppy whale and then I did not
that's a lie your honor you see how quiet she was I'm sorry okay where did this discussion take place he was in his
bedroom smoking we started arguing where were you I was the bedroom door that he has actually is flesh with the living
room we were standing right in their living room bedroom area and it escalated of course he called part of my
anatomy stunk and he don't know how he could ever live with someone as big and fat and horrible as I am and I had the
cordless phone in my hand and I pointed it at his face he then stood up on his bed towering as he is over me on his bed
he jumped off his bed and with both of his PS M Square on my right and left shoulder pushed me which I have pictures
of the injuries as well if you need those and I fell um on the hardwood floor on my elbow and then down on my
wrist okay your honor sh just a minute um then after after the altercation when
I got home from work I packed an overnight bag enough close to get me through the rest of the work week at my
job and um went to my grandparents okay now you stayed in the apartment yourself
the month of March March had been all paid for yes what did you do in April I stayed there and I also tried to find a
roommate yes were you successful no I was not okay when did you finally vacate
the apartment after the first week in May I stayed one week in May all right but you had 7 weeks to find a new
apartment after she moved out through April yes ma'am but I was worried about breaking my lease well you did break the
lease anyway yes okay and the landlord permitted you to break the lease yes well that's great I actually T to him
that that morning the next morning I called our landlord from what I gather and I'm not making any excuses for
either one of you you it seems to me like you both behaved badly that day Judge Judy continues in a moment
there's been some abuse in his past and I just didn't feel safe there miss shers has also attacked me before
[Music] too real cases real people Judge Judy
Chad Jones says former roommate Laura Shivers assaulted him and broke their lease Laura claims Chad was the one who
was violent I don't find that Mr Jones was the aggressor Miss Shivers because you
were in his room and if you were in fear of him as you say towering over you all you had to do was walk into the living
room right even if I don't believe him that you threw the phone at him and that you pushed him down on the bed you had
no business being in his room so I find that you really didn't have cause to
excuse you for at least part of the rent I think that it was probably a very wise decision for you to leave or for you to
have left you chose to leave but there has to be some responsibility with regard to the rent now you both paid the
month of March so we're really only talking here Mr Jones about the month of April yes we issue May no may you should
have been out already okay so that's on your side let's get to her side the primary thrust of your counter claim is
attorney's fees is that right yes ma'am it is cuz that's the only thing that you really talk about in particularly is
talk about some other bills but it's all very NE everything was in my name so and I paid all the bills he never gave me any money for no ma'am I have a I have
my check that went through her bank account that was used for rent for may or March and there is $90 left on my
check that was supposed to be paid for bills um actually our cable bill is $21 yeah um that and everything did you
pay that um it actually I've paid off the energy bill which was in my name which was
1258 the Comcast bill with the cable company I've actually taught to them they're waiting for the court case to be
decided and then of course I'll pay it with okay do you doubt that she paid off those two bills primarily the 125 and
the 2011 for cable um no ma'am I don't you didn't pay them um well I had $90
for my check that was supposed to pay some Bill fine so you'd have an additional $90 to defay the cost of some
of those bills let's get to the counter claim according to what I've read Miss Shivers you originally tried to get an
order of protection against him yes your honor I went down the next morning to the um prosecuting attorney's office
when I stop playing with paper um um I went down the next morning to file an
order of protection on Mr Jones why um there's been some abuse in in his past and I just didn't feel safe there has
also attacked me before too just a second you had not had any trouble with him before no he moved in with me CU he hit a stepfather and moved in with me
but you had never had any trouble with him before yes we had we had had a problem I went to with his family to Florida and there was raised voices and
pushing at that point so but after that you moved in with him very stupid yes I did well look Miss Shivers you moved
into a house with him and from the time you moved into the house until this incident there was never a problem and
clearly you were not intimidated by him because you were in his space in a sort
of threatening manner so I don't quite frankly see the need for an order of protection if you were out of the house at that point that's what they told me
the officer that's what they told right they said I agree with you and they then you know sent a letter to him they sent
a letter to him let me see the copy of the sh just a second um they also told me I everything was in my my name the
electric and the phone and they told me not don't tell me what else they told you
okay okay now so Mr Jones you get this letter so you went and filed for an
order of protection against her no ma'am i' had already done that I did that on the 13th of March because she kept
calling to my job and harassing me and kept coming over to the house with police officers asking when my schedule
was she needed to know it so she could da da d da and do all whatever so that you went down and filed for an order of protection against her yes and what
happened with your case um I went down there to see how I could have it dismissed because I'd obviously gotten
accomplished what I wanted accomplished she stopped calling me at work she stopped harassing me and um they said
you can either come down and ask for the case to be dismissed or not show one or the other so you chose not to show up
yes ma'am okay and you hired an attorney for $350 yes ma'am and I have that here
if you need I believe you okay but miss Shivers you don't have a counter claim against him clearly you went first to
file for an order of protection he's got this letter and which is now on file
which is like a little not a major sword but sort of a little toothpick hanging over his head that if he does anything
else that you complain about he could be arrested so he went and filed one
against you Judge Judy continues in a moment all right according to my very
intricate calculations Miss Shivers you owe him $242 for your portion of one month's
rent and the bills that the remaining bills having been deducted from that is
$242 so I am entering a judgment for the plaintiff and I believe that he was perfectly within his rights to file for
an order of protection against you since you did first have a good day thank thank you excuse you may step out order
all rise yeah this is case number 282 on the
calendar in the matter of Gatewood versus Bouton parties have been sworn in judge you may be seated genten right
let's see if I can unravel this rather complicated complaint Mr Gatewood you and Miss
Bouton were friends in 1995 yes and in that year you sold her a used car yes
how much did you sell her the car for a sum of $2,000 and she was supposed to pay you
at the rate of $250 a month is that right yes yes and you say in your answer
that he was pretty reasonable about late payments and that sort of thing right but you were paying off this car what
kind of car was it a VW Bug they cute yeah right so it came a Time sometime couple
of years later when she hadn't been making her payments and you were worried about the insurance on the car you
decided to repossess the car yes So In the Still of the
Night without telling her right oh no no there was a did you tell her you were going to repossess the car there was a
letter sent to her yes that said what if you don't I will what if you don't pay I
will repossess the car right right but then you didn't tell her when you were going to repossess the
car day and date it gave her till the end of the month which was Mr Gatewood
do you understand what I'm saying to you you didn't tell her when you were going to repossess the day and time no no so
without telling her when you were going to repossess the car this former friend of yours you went to where the car was
parked yes and took it yes and the registration was still in your name yes
because that was your Arrangement yes she did what any normal person would do getting up in the morning you looked
outside and you saw no car so you called
the cops you got
arrested pulled over for stealing your own
car yes right mm what people do to each other and to themselves this is really
so fascinating I was fascinated when I read this complaint
now ultimately it was okay because you spoke to the police and were able to
convince them that it was your car yes how long were you in custody about an hour and a half was it
scary yeah to say the least you ever been arrested before never I've never
even dawnn bracelets what did they actually put you in handcuffs yeah I was on my knees and they put me in cuffs
tell me about that I'm really curious to know um I was driving home and uh I
notic notic the cop following me and I eventually made it home and I pulled into my parking lot or my carport and uh
I got the lights and I'm thinking okay what's this all about I get out of the car and I get this Spotlight in my eyes
and he says throw the keys to the ground I'm like okay he's like turn around put
your hands on your head I'm like okay and I says walk backwards towards my voice and I did he says stop and I feel
something on my back and he says put get on your knees I'm like execution time and they cuff me and I'm
like am I under arrest and he says no you're in custody I said can you please explain
the difference to me did you say that to him yes did he have a sense of humor uh not at this
time and um so he says uh can you explain to me instead why you're driving
a stolen vehicle I said this isn't a stolen vehicle this is my vehicle and he says what's your name and
I said got Gatewood he says well you got that part right then you know explain
this to me had you known at that time that she had called the police no no
this is just like completely so what you were suing her
for is for having called the police and having had you arrested falsely
mhm so you want some damages for that and then you want some money for the car
there's still a balance do you want it okay well first let's take care of the car business and then we'll get into
this arrest business because I have to figure out exactly how much if anything you're wrote on the car because she says
that she paid money towards the car and she is countersuing you for the car and
then you're countersuing him Miss Barton for some nonsense which I categorize as nonsense which is the emotional distress
of not having your car something like that which I'm not even going to think about because that's a lot of baloney
now how much did you pay for this VW Bug sir how much did I pay for it that was
my question I'm sure you have an answer I initially when I got the car I paid
$500 I then fixed the car up put a brand new motor in it fixed the body um did
the interior as well it came to about 23 $2,400 let us assume for the moment you
paid $2,300 for the car okay all right
how many payments did you make on this car I had about two more payments left I
owed him about $600 more on the car how many payments did she make on the car
she made four payments on the car um she only owed she only owed $425 on a car um
so she paid you in total how much
$1,575 okay and how much money did you sell the car for sir because your
complaint says that you sell sold the car after you repossessed it I've resold the Volkswagen for
$200 why uh for the condition that it was in when I got it back it wasn't
worth much more than that Judge Judy will continue in a moment the idea that
he came at night and took it was a total passive aggressive miserable move that is typical of guy
Gatewood real cases real people Judge Judy
guy Gatewood says he was embarrassed when he was handcuffed and led away after he repossessed Nicole bouton's car
now he wants payment for the car and the emotional distress who did you sell it to a neighbor
downstairs for his wife so she can go back and forth to work let me see the bill of
[Applause] sale what year Volkswagen was this it's a 71 Super Beetle
Mr Gatewood yes you were driving this car when the
police pulled you over yes I was where you were you driving it from sir I was
driving it from Shooters bar in Huntington Beach what is the distance between This Barn in your home 2
miles and how long had you been driving the car from the time you repossessed it
until the time they repossessed you it was stored most of the time maybe two or three times I took it out to keep it
running um I also have another Blazer and a motorcycle that use now Mr
Gatewood just because you do a bill of sale for $200 sir doesn't mean that I
believe that you sold this car for $200 because the car was clearly a drivable vehicle
drivable vehicle cute little car almost vintage you know 71 VW Bug is a
convertible or not no it's not convertible so just because you wrote $200 here doesn't necessarily mean I
believe that you paid were paid $200 for it in total I'm not the only signature
on that uh statement you talking about the buyer the buyer also oh well it
would certainly serve the buyer would certainly say that you he only paid $200 for the car cuz that means his tax when
he has to register the car is a lot less people do that all the time it's wrong and it's illegal but people do it all
the time when they sell cars that are used cars they say listen put down 200 bucks I'll give you $800 for the car and
then I only have to pay tax on $200 you understand that Mr G understand your point of view
now what did you after you found out that uh the car wasn't there you called
the police when did you realize that he had taken the car
about 3 days after I made the report um I didn't hear from him I called him as soon as I called the police I was like
your car has been stolen I know I still owe you money on it I'll pay you the money I owed on it but just to let you know it's been stolen so if you get any
calls about it being found then call me back I didn't hear from him and he didn't tell you that he had taken the pH
no right right right that I was told by I was told by
legal advice not to not to speak with her just a second she told you that she
had reported the car stolen no she didn't tell me that she what did she say she left on the answer machine she goes
I don't know if you have the car or not but um it's not up here give me a call
that was it and did you call her no well didn't you think that she might call the
police and report the car stolen yes but I didn't think they'd take a stolen police report without proof of ownership
well then that's your problem Mr Gatewood so I'm dismissing that part of your complaint for having you arrested
because it seems to me she did the right thing by calling you immediately and if you wanted to be smart you could have
had a friend or someone else call her and say he doesn't want to speak to you personally he has the car when did you
find out that he had possession of the car like I said it was about 3 days after when he didn't call and tell me
make any comment about it being stolen is when I knew that he must have taken it I
mean because that's a part of his character that I wouldn't doubt so a
friend of mine was like do you think he took it and I'm like you know he's just miserable of enough person to have done
that but I'm not going to call him until I chill out cuz I was pissed I had no notification listen to me you're in
court try angry angry I was angry I was out of control
no I wasn't out of control I was just angry I was amazed that he could have done anything so low without any
notification um but like I said it's part of the um
nature that I knew of him so what did you do did you call the police I called
the police and I said I made a report a couple days ago this is the number scratch that report he goes well was the
car stolen or wasn't it stolen I said well it was taken without notification by its registered owner so I don't know
if you'd call that stolen but it's not stolen it's in the owner's hands when I got a call from the
Huntington Police Department a couple months later saying we recovered your car I like knew something definitely
went wrong with the reports I called him immediately I'm like guy I need to talk to you about your car there's some
problems if you need my help with anything call me and I will totally help you straighten it out I never heard from him he should have told you he should
have notified you immediately that he had repossessed the car that's what you do when you repossess the car you tack a notice on the door this property has
been repossessed I sent her a registered letter did she pick it up she she
refused it can I see it it was well that's all right she refused so she there was no
notice if she if you had a receipt that she had received it that's one thing why
didn't you just leave a message on her machine that you had the car sir because I couldn't prove that she would uh
acknowledge the fact that she received any information from you could have done
both right you could have done both you know Judge Judy will continue in a
moment you bu a used car that's 25 years old listen anything that reaches 25 years old starts to go downhill believe
me I know you know every year it gets a little bit worse real cases real people Judge
Judy guy Gatewood says Nicole boutton owes him for a car and a false arrest
Nicole says guy owes her for payments and repairs she made on the car in any
event Mr Gatewood I'm really sort of surprised that you repossessed the car anyway since she owed you just a couple
hundred was on the car I waited 9 months three of which she lived with me to receive any form of further payment
towards it and there was nothing coming in I sent her letter saying you know what do you mean she lived with you she
lived with you as boyfriend and girlfriend or she lived with you as a tenant she ran she was a tenant with in one of my I had a spare bedroom she
rented it up and while she was living with you she was driving this car and she had and she did not make any
payments but then she moved out but she paid you almost everything that was owed on the car 75% of the thing
is how long did you have the car about a year and a half year two years almost yeah and we can talk about
the repairs of this perfect car that I paid twice of what it was worth when I
first bought it and I had to immediately put in at least $1,000 on this perfect car that the money went to his buddies
at his garage who charged me so much for like just a second nobody forced you to
go to his garage right well I thought SP nobody forced you to go to his garage
you're right and when you buy a used car that's 25 years old but when it's supposedly in good
condition every say great condition everybody says it it's a cream puff is
that the right word it's a perfect car anyway that's he
knew of his repairs and that's why he wasn't getting some of the car payments on time was because I was putting so
much money into fixing this cream top he's not your partner in this tragedy what's that he's not your partner in this car tragedy you buy a used car
that's 25 years old listen anything that reaches 25 years old starts to go downhill believe me I know you know
every year it gets a little bit worse right cars are no different from people so you buy a 25y old car you be prepared
even if the owner of the car says it's in great shape to pay whatever it is if you get disgusted paying for the repairs
then you sell it but you don't charge it off cuz a bank wouldn't understand if you went to a bank and you say well I
had to pay repair for the car and I had to pay my phone bill and I had to pay this and I had to pay that so I can't pay you this
month they wouldn't have tolerated it but I have a problem because you two clearly knew each other you were friends
you knew each other for a long time she lived in your house and Mr Gatewood I don't understand why you treated this in
a in nothing more than what apparently is uh an arms length transaction by
going and repossessing the car not notifying her immediately not notifying her
immediately even if you send her a registered letter that takes a couple of days to get there any normal person coming out of their house not seeing
their car would call the police then you are at risk sir so you caused that
problem Yourself by repossessing the car without advising her that you were going to do it or at least repossessing the
car at midnight tacking a notice on our door I have in fact repossessed the car
uh if you have any problem with that I'll see you in court whatever it is but you didn't do that so if you got
arrested that's your problem so that part of your lawsuit is dismissed the only thing that I have to try to figure
out is who owes who money for this car Judge Judy is ready to
[Music] Rule now you have any proof that you
paid $2,300 for this car that was all in Parts receipts stuff like that I well
let me see I did bring anything like that with me because I didn't feel it would be necessary for today and you say
you bought it for $500 yes so let's see how much you made so
you don't have any proof of how much you put in to have it fixed for me so let me let's say you put in nothing so you
bought it for 500 you got1 1575 from her and you got another according to you
$200 from your neighbor 5 7 12 so far you
got no $775 for a car that you paid $500
for that's pretty good that's pretty good now on the other
hand Miss Barton you had the use of a car for almost two years right at about
750 bucks a year right plus all the repairs that's what happens when you
have a car you do repairs on a car when you have when you have a car so for 750
bucks a year you had basic Transportation basic very basic did you have another car or this this car it was
great was great so that seems to me as if that nice 12
months comes out to what less than 50 bucks or 50 60 bucks a month to own a
car that's not bad you have insurance for this car not anymore did you have did I have
paid up Insurance all the time all the time no not all the time well that was one of the reasons you repossessed the
car right I don't know we had more excuses for taking the car let me ask a question no he's very clear in his he's
very clear clear at his complaint he says he was concerned cuz the car is in his name and you told him you didn't have money for to keep up the insurance
so he was afraid if he got into an accident in this car they were going to come and take away his other car and everything else that he owns right so
you didn't have insurance on the car okay right
mhm sounds to me as if you made out okay Mr Gatewood in the sale of the car
sounds to me Miss Borton that you put brought on some of this on your own mhm
had no insurance on a car you certainly weren't going to get stuck if the car was in an accident or if you hurt somebody he was going to get stuck he's
the registered owner and you have nothing CU you couldn't even make the car pavement so they couldn't go after you so it sounds to me as if you two
folks absolutely deserve each other your complaint is dismissed your counters suit is dismissed goodbye par I excuse
you may step out Judge Judy will continue in a moment versus Ventura step forward please
20-year-old student Timothy brazes says Jimmy Ventura seriously injured him when
he hit him with a skateboard during an all out fight at a party order all
rise quiet in the courtroom please all rise Yiannis is case number 238 on the
calendar in the matter of brazes versus Ventura parties have been sworn in judge you may be
seated Mr brazus according to these papers you claim that the defendant assaulted you You by hitting you with a
skateboard you were severely injured MH you want him to pay for your medical and dental bills as well as pain and
suffering yes right right tell me when this happened Friday the 13th
1996 okay tell me what happened okay um first we were having a party at my house
and uh he was there who he Jimmy's brother I believe that's his brother this young man here yes okay he was
there and he came and peed on our lawn some the party goers at the party didn't like it so um they uh confronted him and
said why' you do that and I guess there some push came to shove and they started fighting and they chased him off the
lawn and the brother yeah and then um he came back shortly later about 10 minutes
later with Jimmy and about 20 people and they're all wearing um white tank tops
and had tattoos and shaved heads hold someone were holding pipes and bats and
um there was about 10 people left at the house having the party with me and then all of a sudden him and his brother
rushed the house um Jimmy was one of them Jimmy grabbed a skateboard hit me in the head and I fell to the ground and
uh he walked away and I walked to the next house and went and got treatment from my mouth was he arrested no he
wasn't well he was at one point arrested because there's a criminal trial going on is that right later on I think about
four or 5 days later he was arrested how was did he come to be arrested did you identify him yes yes I went down to the
um police station and picked this picture out and the list of people
okay yes sir okay one night on Friday the 13th okay um him he had a party he
had two Kegs and four bands my brother was he was supposed to go out to the
party cuz he was invited by my uncle and they jumped my brother a bunch
of people jumped him I wasn't there step up here you're a gunner yes did you use his lawn
as a bathroom come on let's go all right well I was invited to his birthday party
by my uncle I went out there my friend was Tak took a pee on his lawn and then
they got around them huddled around them I went over there to try to settle it a guy got in my face and I was in about
this close to my face I pushed him and then I struck with a bat in the head and the side and then I was basically gang
rushed down the street and uh that's where I went and caught my breath you caught your breath and when did you call
your brother I never I didn't call him I never seen him at all that night he left
supposedly he got jumped I was walking through the apartments and this is how I found about it my uncle told me that
that Gunner might have gotten jumped so I saw Tim I guess whatever his name is
um with a group of people like about 40 guys sitting in front of his house laughing on how they beat some guy up I
took off I was with two girls that I was with all night and I went to their house and I sat there and I saw my mom Elaine
she drove by down she was going down the street and I saw I'm like what is she doing out here you know 3:00 in the morning but anyways I came up to the
scene and I saw my mom trying to break up a fight and some guy cold clocked my mom like leveled her out she got a
broken nose she got you know fat lip and I ran in there and I and I socked the
guy that hit my mom wasn't this young man no it wasn't even him yeah but this that was the only thing that I came into
this fight I hit the guy that hit my mom I'm looking at this you say in your answer sir that there was another fight
4 days later there when he got beat up and he wants me to pay because the
apartments belong to my grandmother and Tim smell's money so according to you the injuries that he sustained happened
4 days later is that right yeah that's right can I see your medical reports please sure
the statement that you make here is that he got beat up four days later yeah he got beat up 4 days
later he got beat up 4 days later and he wants you to pay for it is not true because the first medical report of
injury was the morning of this incident this in inent happened late at night on
the 13th yes and his first report of injuries was on the 14th which means
that this stuff that you suggest about his being beaten up 4 days later and he just wants you to pay for it because he
he feels as if your family has money I want you to put that out of your mind his injuries were sustained on the 13th
now you are Mrs Schwarz yes step up
please you're their mother yes I am what do you know about this evening this boy has falsely identified
because this boy wasn't there but 5 minutes I don't doubt that Tim didn't
get hit by somebody but it wasn't by this young man right here you don't know that I was there the whole time you're honor no you weren't yes I was your I
was there you weren't there the whole time yes I was there the entire time Tim said he got all the way until when the
officers told us to go home I thought you got hit I did get hit when you when
you got hit where were you I was right in front of their apartment right where he says he claims he got hit were you on the ground pardon were you on the ground
pardon yeah not the entire night I the entire night I said down were you knocked down KN yes I was so when you
were knocked down you were on the ground you didn't see what was going on all around you no but I wasn't down for that long Mr
Schwarz Judge Judy continues in a moment for one I didn't hit him but anyways if
you if you think about it can you run 20 ft with a a skateboard and have a skateboard truck and only chip one to
you can you do that it's it's quietly impossible would you believe this you
missed the point sir real cases real people Judge
Judy Timothy brazes claims Jimmy Ventura injured him when a party erupted into a
neighborhood brawl Mr Schwarz what I'm telling you is
you did not see what was going on around you all the time that doesn't mean that I am yet
convinced that this was the person who hit you sir and I don't doubt the fact that you got hit mhm because in
your complaint mhm you say cuz I read it very carefully my back
was turned to him when I got hit well I meant my side you know I was
like what you meant sir in your sworn complaint and what you wrote mhm then or
different things because you swore to this you want to see it no I I know what I I know what I wrote you
said the reason I should win is I did not H at all him hit him at all my back
was turned to him when I got hit well yeah I mean my side was turned
room more like my back as I got hit I could see who hit me you mean sir listen to me and I'm and
I'm not saying that it definitely was not this young man mhm you have just told me that you never
saw him before mhm that that night was the first night you saw him mhm that
there was a lot of confusion going on because there are lots of people out there 40 people from your side from the
other group sides so there are a lot of people a lot of commotion according to your own statement you had a couple of beers that night you didn't want to get
blot drunk but you had a couple of beers that night so You' had something to drink it was late at night cuz the party
was in the process of War winding down and your back was turned towards
the person who hit you so what you're telling me is in it's the split second that you turned around you saw this
young man and you are able to 100% say to me
today you are absolutely positive that this was the person who assaulted you with the skateboard yes because after he
hit me I saw who it was he walked away and I saw him he walked away you fell to the
ground when a hit I fell to my knee and my arm you fell to the knees and your arm and the person who hit you he was
standing right there waiting for me to get up I didn't get up for about 3 or 4 seconds oh you didn't tell me that before you said they were walking away
why would they be standing right over you to see if I'd get up and probably attack him back but he'd probably want to be ready if I would do something like
that but that's not what happened he was right there after he hit me he hit me I
got up as I was getting up I I'm looking at him the whole time he's standing there you know kind of backing away and
and then he he just goes off in his way and I run upstairs in the house my brother saw that happen did you have
skateboards in your house yeah they were on the lawn it' be very easy for him to grab one and hit me I know for a fact it
was him I'm not sure I'm positive I'm 100% positive okay he says that I hit
him and I took off well if he would have known and he knew what I was wearing which he doesn't cuz he said I was
wearing a white striped shirt I was sitting in front of those stairs for 4 hours talking to Cops
and that's not what he was wearing he's what I was wearing when he said to court in court he's all I saw him he's wearing
a white shirt I was not wearing a white shirt white shirt I thought he was wearing a stripe shirt said it's in your testimony in the criminal a strip shirt
listen to me says a white shirt WR after this happened we've got the trans after
this whole altercation were you sitting you say you were sitting and talking to the police mhm yeah I said hey Mr Schwarz stop it
I'm talking to him you say you were sitting and talking to the police where right on the stairs we
sat down right when my mom got hit I showed up right when she got hit I wasn't even there before when the fight
started I came up when the fight was already going on I came up and I saw my mom get hit and I hit the guy that hit
her I got maed we both sat down on the stairs supposedly where he says he ran up the stairs whatever I sat there we
were sitting there and the fight was still increasing I was still sitting there the cops come up my mom had a she
she had like blood coming from her nose and her her she had a fat lip and so we were sitting there and she was getting
taken care of that the ambulance came up and we were talking to him and we sat there for 4
hours Judge Judy continues in a moment it doesn't make sense to me that our own
son struck her sir Common Sense would dictate to me that that did not happen
in the case involving Mrs Schwarz and her sons there was no common sense involved
real cases real people Judge Judy Timothy brazes is suing Jimmy
Ventura for injury suffered during a neighborhood brawl Jimmy is countering for pain and suffering loss of education
and financial hardship did they ever apprehend the person who hit you no they didn't we
tried to tell we tried to tell them who hit me and they would not listen they all that sounds very peculiar to me this
whole thing is peculiar no just a second that sounds very peculiar to me I mean here you have a woman who's in
charge of a building complex who apparently is injured when the police
arrive and the police will not take your complaint about the person who hit you
no all they kept saying is their side Tim and his roommates kept saying that Jimmy was the one that hit me and I was
trying to convince Jimmy was the one that hit you yes you mean your son was the one who hit you that's what they were that's what they were saying say
they try to say that's what they were saying the whole night that Jimmy's the one who hit me not Tim he hit me and the
fellow that hit me if he's so sure it was Jimmy who I'm sure anybody suggest to the police because the boy that hit
me was that boy's size right there no Mrs Schwarz this boy didn't he didn't hit you come on get together boy hit me
was as tall as him but I won't 100% dfy him because I didn't see him it happened
too quick but it was he was a tall big boy okay did anybody suggest that this
woman was assaulted by her own son no huh no it's in the police report let me see the police report I didn't bring
it sure well because you're the father Yes you know anything about this
yes I'm going to hear you uh I just recently retired from the Los Angeles
Police Department and I had contact that night with my son and then I contacted Lewis Martin who's the detective
handling the case in Santa Barbara County Sheriff's Office uh and as she stated there were independent wits from
the commotion that was going on outside that did in fact you know is in the police report that she was struck by her
own son during the melee oh just a second just to let you know that part no
you can't let me know that I don't know that I don't know unless I hear a witness who saw it okay do you
understand yes because you understand that yes and it doesn't make sense to me
that our own son struck her sir Common Sense would dictate to me that that did
not happen in the case involving Mrs Schwarz and her Sons there was no common sense
involved oh I believe that there's common sense and logic involved in this whole thing I believe that there was a
party yes I believe that this young man came Uninvited I believe that he brought somebody else with him that was also
Uninvited to the party I believe that the other person he invited to the party went outside either with him or without
his assistance and urinated on the lawn right in front of the house I believe that there was some
altercation yes because there was some guests at the party that were IR rate at what they saw because here were
uninvited guests using the front lawn of your home as a toilet clearly in
appropriate yes I even believe he probably got roughed up a little bit and
went home and got a whole group of people probably included in that group
was his brother who came back to the house looking for nothing but trouble so
far it's as clear as a bell to me the only thing that's not 100 % clear to me
sir is whether your son could make an appropriate identification I can clear that up H I can clear that up go ahead
okay before this night I've never seen him before I would have no reason to pick his face out of a Sixers lineup um
i' never seen him before that night um how would I go into the uh sheriff station and pick his face out of a
lineup even if I've never seen him before and um if he's not the one you know if he's the one who hit me i' I'd
pick him out for sure you know well how long have you been living in that complex uh at the time about a
month he never came by before ever had you seen him before never that's on the other brother he saw both of my sons
when he was at my house signing contracts do maintenance or I saw him one day when we came there with one of
our roommates parents I saw a gunner walk through walk to his room that's the only person I ever saw didn't see the
other brother never you have photograph of the lineup
no but the the I mean the police made me pick it and they brought it to a civil uh criminal trial pick it m explain to
me sir exactly what was shown to you when you came into the police station I went to the police station 4 days later
you went into the police station mhm and U he showed me up who's he the
police officer Martin yes detective Martin showed me a list there's six
people on this paper on this this photo thing and he was one of them and I
picked out the guy that I saw hit me just like that I don't know who the other five people and you had never seen
him before never for one I didn't hit him but anyways if you if you think about it can you run 20 ft with a
skateboard and have a skateboard truck and only chip one tooth can you do that it's it's quietly
impossible would you believe this Judge Judy continues in a
moment you missed a point sir either they have convinced me by a
prance of the evidence that you were the one who hit him or they haven't and
whether his head got cracked open or whether he chipped one tooth or whether he doesn't have one of his own teeth in
his mouth as a result of that is really not the issue the issue is did you hit him no and quite frankly he has
convinced me that you did
all right what were your unreimbursed medical expenses sir okay and that's where my dad was here um he knows
exactly how that went out of pocket I lost about $1,600 approximately and we
have an $800 uh root canal do on the same tooth because it died well the only
question is what are the damages for pain and suffering because you you're unreimbursed bills you certainly are
entitled to because I find that there is icient evidence by a preponderance of the evidence so that I am satisfied that
based on the fact that you picked him out of a lineup and the lineup was a Sixers photographic lineup and I am
satisfied that you had not seen him before I believe you that you had not seen him before so there would been no reason for you to pick out this person
who just happens to be the brother of the person who had an argument with your party goers a few hours before there
would have been no reason for you to pick him out that coupled with the fact that usually when someone is injured they
want the right person arrested they want the person who caused them pain to suffer right right so you
would not like to identify the wrong person it would have been just as easy for you to identify this person mhm kind
because he had been there did not you identified somebody who you had never seen before him so I'm satisfied that by
a preponderance of the evidence you have established that he caused you injury
and I'm giving you what you're suing for which is $5,000 that's all I excuse you may step
out how the back door to your right excuse me step out Jud Judy continues in a
moment and on the next Judge Judy 39-year-old attorney Marilyn Thomasson
says 29-year-old Bruno Herzog owes her for rent in utilities from when they lived together Herzog says Marilyn is
harassing him because she wants him as her boyfriend order all rise
all this is case number 369 on the calendar in matter of Thomasson versus Herzog P have been sworn in judge you
may be seated have seats Miss Thomasson this defendant according to
you lived in your home and when he left he owed you money for rent utilities Etc
that's correct was he live do you have a two family home or was he living in your
apartment I have I rent a large home and uh he was the first roommate that uh I advertised
for after my long-term roommate died of cancer a year ago so he lived in a home
that you rented correct so he had his own room yes own bath yes and kitchen
privileges is that right that's correct your H okay so tell me about the rental agreement uh he answered the ad the
recycler and we uh agreed on 600 a month plus one quarter of the utilities is
that correct sir uh no it isn't your honor well let's start did you answer an
ad yes I did and you went to her home that's correct and what agreement did you come
to um basically as far as the rental agreement concerned um the rent was going to be $450 per month and I also
gave a $250 deposit at that time what about the utilities sir um the utilities
were going to be fairly what about the utilities sir um the utilities were
going to be fairly uh split fairly split is not an arrangement sir fairly split
sounds ridiculous when you're talking between two strangers we supposed to pay half the utilities a quarter of the utilities what were you supposed to pay
um basically there was no uh straight agreement or Arrangement on that it was going to be split between there was um
Marilyn and her two sons plus her boyfriend also living there at the time what month did you move in I moved
in in the 1 of March of this year that's correct and how many months did you live
there I lived there for 6 months your honor and how many months rent did you
pay um I paid two months rent and at that time I had given notice of uh to
vacate um the day the day following so you paid for two months and the utilities correct and you lived there
for six months that's correct and you lived there March and April then you said you were leaving that's correct
your honor but you didn't leave but I did not leave and you stayed on for an additional four months and paid nothing
why not um at the time of of notice of vacation uh to vacate the premises um
she had given me which I have documented uh written notices and a note from her
stating that um it would be okay for me to stay there as long as I want for free under no obligation to pay for rent or
utilities let me see the basically what I have and like to present to you me basically just show me
the note um if I can present this to you just the note show it to her bird would you
please that's one of several notes I had a little trouble communicating with so I wrote notes I just want to see what it
says
here why did you give her notice that you were leaving sir um it was a very uncomfortable situation for me from the
very beginning um I just felt it was appropriate for me to leave I just uh it was it was just unbearable situation in
the house okay tell me why was an unbearable situation um basically the
first and foremost reason was uh the harassment that I've been receiving from her um to somehow uh come into a
physical relationship with her you mean it from the time you moved in that's correct March and April that's correct
and it was unbearable it was it was it was it was something uncomfortable and
unbearable yes H so you stayed on you moved in in March you stayed in April and after this unbearable situation you
stayed May June July and August for another four months that's correct your
honor why um basically she had uh you know we had spoken and she had agreed
that she was going to try to uh basically stop some of the impropriate comments that she had made um I also
have a note stating uh to my mother that she had made a sexual um Indiscreet comments and Haring
comments um she would say you know she she' uh she'd note to to her friends
this is my little house boy Liz her isn't he cute she would tell her friends to come over when I was around um you
know she she'd say things like you know it'd be great if if if you know you wouldn't wear a shirt around the house you have such a great body just a lot of
small remarks like that I mean there's some phot SL slowly
she turned there's some photos here that I have mrog yes
if a big guy like you doesn't like the heat then he get out of the kitchen sounds to that's what it mean
unbearable so you leave leave if a situation is
unbearable that's what it mean unbearable so you
leave you didn't leave you sponged Judge Judy will continue in a
moment your beauty is going to go one day so I know you must think you're a very handsome man and you can get away with
murder but anybody who can twist the truth like you can is not good-looking
in my eyes and later today I'm not a criminal this was this is the first thing I've ever been in trouble for in
my life this has taken up way too much of my time already real cases real people Judge
Judy attorney Marilyn Thomasson is suing Bruno Herzog for un paid rent and utilities Bruno is counter suing
Maryland for sexual harassment show me the rent receipts for May June July and August show me
your cancel checks to her in the amount of let's say your amount $450 a month
okay excuse me R basically the two things that I have here is um I have in lawsuit it States from from the
plaintiff that um she states that there is a a written agreement um in fact she refused to ever provide me Ral agreement
Mr herzo what word that I just said didn't you
understand show me the rent receipts
from May June July and August that's also part of uh the situation that I
have here is that in the beginning um there was cash paid to her I had asked for receipts on that on several
occasions that was refused to me um I felt that she she said to me this was
for so is what you're telling me Mr Herzog that you paid her in cash and you didn't get a receipt that's correct your
honor and I had asked for that you are one lying sucker you just told me no more than 5 minutes ago that you didn't
pay her anything for those four months and now you say you paid her but you paid her in cash yes your honor and I also have a statement from her in a
respon you just told me you didn't pay her for 4 months and you told me the reason you didn't pay her for 4 months
is because she volunteered for you to stay there for free that was what is it did you pay her or did you not your
honor I paid her for the month March and April rent that's not what I asked you sir I said show me the receipts
for May June July and August I have no receipts for those your honor because
you didn't pay her for those months that's correct right so you owe up for those months cuz if something is so
unbearable that you can't live there because you don't like the fact that she is making these suggestive statements to
to you you're a big boy whose feet aren't planted in cement you pick yourself up and you leave well you're
honor through conversation with her I felt that this uh problem would be resolved she is an attorney and I felt
that she would understand as far as a relationship goes as a roommate and there was going to be no no physical or
relationship it stop the harassment uh stop it did stop for for some time your
honor for how much time sir um it it would be hard to say I mean there was comments made left and right but maybe
for the first month after that it seemed to be uh she seemed to work on it Mr Herzog what do you do for a living sir
um I am self-employed I own a business what kind of business do you own sir it's a manufacturing business what kind of manufacturing uh we manufacture
snowboards snowboards Mr Herzog did you ever hear
the expression Beauty Fades dumb as forever yes I have your beauty is going to go one day sir I know you must think
you're a very handsome man and you can get away with murder but I'm telling you I do not find you particularly
attractive maybe it's because I'm too old I don't think so but anybody who can twist the truth like you can is not
good-looking in my eyes now if this lady had a think for you I don't know maybe
she's desperate who knows in any event in any event you can't stand there as a man and tell me that you were so
offended by the way your landlord was treating you you stayed on for four months but
didn't pay pay her any rent you want to say something if I may about
what about the sexual harassments that that who are you I am Heidi Brittain how
do you know him uh he is my brother where do you live I live in Laguna Beach why didn't he live with you because I'm
an opera singer and I travel around the world wonderful so you must have an apartment that's free a lot no that's
vacant a lot no I have a husband well if the situation with your brother Madam was so unbearable in his residence and
you as his sister who clearly cares about him did not say why it's so unbearable there living with this lady
and her two children come and live with me you're not much of a sister now you
tell me whatever you want to tell me first day I met Marilyn she had made
comments about what a good-look body what you know does he have a girlfriend is there anything that you can do to
help me you know I'm interested in basically and I'd like to have a relationship with him so I told him know
that he had been seeing someone and that that was inappropriate I thought you know he's my brother I don't know you
I'm not going to divulge information or share information which if he wanted you
to know something he would tell you something so so what on other occasions she had said to
me I'm I really want Bruna to stay stay here I'd like to be involved with him uh
I was out in the yard with his cats with Bruno she said I'll pay him to stay here
I really like Bruno i' like he' he'd be a so did you think that that was all very sick I thought that was very very
sick and in fact I had assisted and started looking for uh other locations
for my brother if you thought it was all very sick MH why would you allow your brother to stay in a sick situation well
is no he's not is your brother no he's not is he dimwitted no he's not he owes a money that's what he
does Judge Judy is ready to rule and later today you would know the truth Mr Neville if came up and bit you in the
behind real cases real people Judge Judy Marilyn Thomasson wants money owed
for rent and utilities from her former roommate Bruno Herzog Mr Herzog says Miss Thomasson harassed and assaulted
him I'm taking his amount Madam of $450 right that's
$1800 and I'm not even tacking on much for utilities another 50 bucks for the four months bringing your grand total to
$2,000 listen to me I really have no idea whether she said what you attribute to
her nothing sounds so lud and lascivious to me this is not sexual harassment in the workplace you didn't work there she
wasn't trying to create a situation to make things un bearable for you so that
you couldn't earn a living you are clearly at least according to your sister of sound
mind and you had the ability and the capability to pick yourself up and move
if you didn't like what was going on you don't live there and sponge off somebody now you've got a counters suit for sexual harassment I assume that you've
told me the best statements that you can think of that she said to you during the
course of your tency that would at least touch my conscience and say that's terrible right and I don't find she
sexually harassed you at all sir if she liked you and you didn't like her the chivalrous thing to do would have been
to have move moved out as quickly as possible your counter claim for sexual
harassment is dismissed and I am awarding the plain of $2,000 for your back rent and utilities that's all exuse
you may step out uh she just uh shot some photos of
me without making when I was in the backyard kind of half naked I guess you'd say with no shirt on for her own I
guess private use Pleasures disgusting disgruntled woman who has two children
by two different fathers get over he's not going to be a father to your children I have many friends and I'm dating somebody batteries no I we got a
long F he had a great sense of humor and now the next case part's on Haney versus
Neville nean step forward please 37-year-old florist Sue Haney says her
neighbors Jeff Newman and Craig Neville stole her bicycle and destroyed it
bicycle that you owned correct they were arrested correct bicycle that you owned
correct they were arrested correct yes yes found guilty no not if that we were
arrested and convicted of receiving of stolen property inv but the stolen property was her bicycle yes
mhm and when your bicycle was returned to you it was returned in what condition
pieces so you're suing both of these young men for cost of your bike which is
$22.6 right you want to tell me why you don't think that you are responsible to
pay her let's start with you Mr num first of all I paid a $200 restitution
fine I spent 2 days in jail I almost lost my job over over this and I'm not a
criminal this was the this is the first thing I've ever been in trouble for in my life so that's the reason why you don't
think that you're responsible to pay her uh at least part of the money this is
taken up way too much of my time already now should please please didn't
take it please and you are Mr Neville
yes Mr Neville would you tell me why you don't thinks that you are responsible to
pay her at least part of the money for her bicycle well first of all I didn't
steal their bike neither did Jeff I bought the thing from somebody off the street
baloney so let's start with the First with that that that's baloney no it's not yeah sure it is sure it is it's
baloney you just so happen to have bought a bike that was stolen from
somebody off the street and you knew one of her children or something according to the complaint was that right I've
known all of her children for years you knew all of her children so it was just a coincidence that you were had the bicycle and it was taken apart and
dismantled so that some of you had the wheels some of you had the main frame of the bike that was all just a coincidence
am I correct sir just a coincidence yes I want you to get him a copy of my
book I think we would have been smart enough if we stolen This Woman's bike to have gotten rid of the parts after we'd
stol on them Mr Neville thieves are always
stupid you didn't buy this bike from some unknown person sir and if you did I
am certain that you would have told the police the name of the person that you bought the bike from did you mhm did you
yes I did you told them the name of the person and did they contact that person
I don't know did you tell them where he they could find that person I didn't know where the person lived well why
don't you tell me how it came about that you bought this bicycle from let us call
him JN Jones why don't you look at me sir and tell me how it came about that you
bought this bicycle I was hanging out with a guy at a party he told me had a bicycle you you were hanging out with a guy at a party
mhm which guy his name was uh Steve and
so Steve told you he had a bike mhm is that
right yes told you he had a bike mhm is that right
yes stupid trying to tell me that story Judge Judy is ready to
rule don't you feel stupid trying to tell me that story don't you feel
stupid I don't feel stupid telling the truth you don't know what the truth is you
wouldn't know the truth Mr Neville if it came up and bit you in the behind each of you owes this lady
$11 and 32 you sir your excuse for not paying
her is this matter has taken up all too much of your time not an excuse and your
sir excuse that you bought this bicycle from and I
quote Steve doesn't work wash with me you're entitled to your money Madam you have a
judgment for that am you very much I excuse you may step
out back go to your right Judge Judy will continue in a moment and on the
next 39-year-old store owner Chuck Edwards and his ex-wife Tracy are caught
in an all to Common war and at the center is their 8-year-old daughter Elizabeth he's suing Tracy for the money
he spent on a vacation she cancelled order all
rise judges number 12 on the calendar in the matter of Edwards versus Edwards thank you fir that been sworn and judge
you may be seated I must tell you that when I read these papers over your papers over last
night I was struck by the fact that I had seen these same problems with different
names on them for 20 years sad situation you two folks have been
married for how long 18 years and have how many kids three how long ago were
you divorced um year and a half ago according to your papers Mr Edwards uh
your youngest child's name is Elizabeth how old is she uh she's eight and you enjoy regular visitation with her she
lives with her mother very liberal visitation now what kind of visitation do you enjoy with her um I have every
other weekend like the standard rule I also on Mondays I have her overnight until Tuesday when school starts um I
have her two hours after school on Tuesdays Thursdays and Fridays and on Wednesday I have her until 9:00 how old
are your other two children um I have one that's 19 and one that's 17 the
19-year-old's boy or a girl uh girl no one gets to seear much and the other
child's boy yes and who does he live with no one gets to seear much and the other child's boy yes and who does he
live it was my ex-wife's um year to have my daughter for spring break okay um
this past Spring Break um it was at the beginning of April it was my ex-wife's
um year to have my daughter for spring break and because of our agreement on
visitation if she has to work and Elizabeth doesn't have school she's to bring her to me at 7:00 in the morning
well because of this I talked to my ex-wife about it and I said well since she you're going to be bringing over here every day anyway why don't you um
just let her go with me and my son my fiance on vacation with us and she said yeah that'd be fine and it was your
regular period to have her during that spring break yes it was but you were going to be working correct okay so that
sounds like a nice thing for Elizabeth right go ahead well um I had scheduled
we were going to go to Cancun um Elizabeth's been there before and really wanted to go I didn't have the money I
was waiting on my tax return to come in so we changed that to when my tax return came in that we were going to go down to
uh Daniel Boone National Forest and ride our dirt bikes uh my girlfriend and myself and my son we all ride uh
four-wheel dirt bikes um so when the tax return came in I went and bought Elizabeth her own and where we were
teaching her to ride it when a week before we were scheduled to leave I get a letter from my ex-wife saying she was
mad which this is what she usually does when she's upset is cancel any special visitation I have so I got a letter a
week before we were supposed to leave sorry you can't take her with you now at this time I'd already put deposits down
on a cabin bought the dirt bike bought her equipment so she wouldn't get hurt which at her insistence made sure I had
every piece there was um and it I was just out a lot of money for setting up
this vacation that how much money were you out uh
$1,474 Elizabeth still has the dirt bike yes well yes and that will has to ride
the dirt bite well I had to buy the equipment I know but she still has it and she still uses it when she still has to ride the dirt bitee well I had to buy
the equipment I know but she still has it and she still uses it when she rides the dirt bike did you lose your deposit on the cabin Mr Edwards and how much was
that $175 why don't you tell me why you think your wife changed the your former wife
changed her mind about you taking Elizabeth on vacation uh she has these Tendencies to go off well you must have
had an argument obviously obvious so take much well what was the argument
about I have no clue at right at this point well Miss Edwards why don't you tell me um he told me about a week and a
half before that he was planning on filing for full custody and the idea that I gave her up for spring break
which was supposed to be mine was going to be used against me we having an argument at the time yes well why don't
you tell me what the argument was about because Mr Edwards doesn't appear to be a stupid man and it would be stupid to
tip your hand about a plan for a lawsuit
well he does that to me a lot because he knows it upsets me and usually it doesn't turn out to be true but he came
out to the car and we were talking about actually we were talking about something totally different we were talking about a boat tell me about it um we had two
boats when we got divorced and he got the sailboat and he gave me the speedboat and I was planning on selling
it and I had asked him if I could have the keys to it because he had told me he had the keys and he said I don't know
what you're talking about and at that point I got mad and I said spring break oops I don't know what
you're talking about and he got very mad and he dented my car pounded his fist into it okay so let me go through this
now you got into an argument about property correct you wanted to sell the
speedboat you said to him where are the keys he said I don't know what you're talking about does that sound familiar
sir uh about the keys to the boat yeah that sounds very familiar and so you retaliated by saying spring break whoops
I don't know what you're talking about and then he retaliated and said it's too
late you already agreed to Spring Break and didn't you know he said I I was going to use this against you anyways
because I'm falling for full custody so I sent him a letter saying that I had reconsidered spring break and
that she was going to stay with me don't you both feel
foolish h a little bit because ultimately the one
who was disappointed because you two people spoke in anger and in haste both
of you you two Miss Edwards that wasn't a nice thing to say whoops spring break I don't know what you're talking
about Judge Judy continues in a moment Miss Edwards I I don't know what
you know about my judicial reputation sometimes I'm a screamer and later today I think he just buys a lot
of extra stuff he doesn't need men like toys yes they do cars special
real cases real people Judge Judy Chuck Edwards is suing his ex-wife
Tracy over money spent on a vacation that included their 8-year-old daughter
according to your papers Miss Edwards you went and spoke to your lawyer yes I did and your lawyer is the one who said
to you you don't have to give him spring break he said I was under no obligation to give him spring break I'm going to ask you this question
you really don't have to answer did your lawyer lawyer say to you but it's the right thing to do to give him spring break no he
didn't he had me discuss it with my daughter and see how she felt about it and she didn't care either
way yeah we have we shouldn't put kids in the middle about that either kids don't have an opportunity of picking
their parents very few parents are perfect if you're fortunate enough to have two
reasonable parents in a divorce situation you're very fortunate Miss Edwards I think what Mr Edwards retorted
to you was wrong when he said I'm going to use the fact that you let her go on spring break
with me when I petition the court for full custody you don't intend to do that do
you Mr Edwards no not at this time well does Elizabeth seem happy with
her mom she seems for what she's gone through um she seems very well adjusted
it's amazing well then that's a credit to both of you sounds to me as if you're two very nice people who got into a very
stupid Tiff Miss Edwards I I don't know what you know about my judicial
reputation sometimes I'm a screamer I find it difficult to scream at you I think that you're a nice lady
thank you and I don't think that the cancelling of this trip is hopefully indicative of the way you do
business I also Mr redwoods don't think that your response to your wife when she said the wrong thing to you which was
whoop spring break what spring break and your retort to her I'm going to seek full custody because you were angry was
appropriate so I think that you were both wrong your out of pocket expenses were
$175 you're going to split them sounds fair is that fair yes Mr Mrs
Edwards uh I wish you good fortune uh you owe him
8750 okay thank you thank you I excuse you step
out and now the next case part's on ronning versus alexandrias step forward
San Diego college student Susan ronning says she loaned her boyfriend Jason Alexandria's $1,500 toward a car now
that they've split he won't pay her back you know when a loan becomes a
gift when the relationship is over did you ever hear that I've never heard
that one nor have I good cuz I just made it up should put it on coffee
mugs um miss roning ronning ronning you and the defendant had a boyfriend
girlfriend relationship when you were both in the Navy according to your papers okay that right and that
relationship is a little under two years just yes during that time you say he wanted
to buy a car and you lent him how much money
$1,500 put that on your bank card on my credit card yes how much after that did
you break up um probably about four months no money none tell me what your
Arrangement was about paying back the money the loan happened in October and I
gave him until April to be able to pay me back and he hadn't paid me um anything since then or ever since did
you talk to him about it yes I did you even when we were breaking up I asked him about it he said don't worry about
it I'll pay you I'm good good on the money I trusted him I believed him because he's paid me before I have loaned a money before and he has paid me
back and so I had no problem with it why was he always in need of money I I don't
know did he ever lend you money no he's never lent me money um I've always been
more financially stable than he has for some reason I think he just buys a lot of extra stuff he doesn't need just guys you know men like toys
yes they do cars especially mhm Judge Judy continues in a moment
she's like well you know don't worry about it it's close to Christmas meaning that it was going to be like a gift that I I told her I said I was not going to
be able to pay her back she said you told her that yes ma'am Susan ronning is suing her former
boyfriend Jason alexandrias for money she Susan ronning is suing her former boyfriend Jason Alexandri Rus for money
she says she loaned him for a car what kind of car was this uh 1993
Ford Explorer why didn't you pay her back the money to back up a little bit um she needed a car so I had a 1989
Nissan 240SX that I sold to her um she only had $5,000 so I'm still paying on
that loan today and I have the loan paperwork with me um I just basically so I'm still paying on that loan today and
I have the loan paperwork with me um I just basically the bank released the title to her in her name and uh kept the
2500 on the loan to my signature that I'm still paying on so she gave you the $5,000 she gave me $5,000 you were
living together at the time correct okay you didn't make a gift of the car to her
no and you were living together correct
so go on with the story I was I was getting to the the point um anyway uh so
the the leftover that I was still paying on was just kind of you know that was the limit of her money so I just told
her I would just that was it pay on the rest cuz I owed $256 extra okay so later down the line
when I need you had another car right I needed to buy another car months later no but you had another car when you sold her this car no so you were both using
this car when you were living together yeah for a few months period so for the few months you sold her your car she
paid you for it and the two of you together only had one car right but she
just a second you have to think about where he's going and think about whether he's hurting you or Not by this story okay I yeah um then you needed a car I
needed a car so we went looking for cars together she went with me and we went to the Ford dealership and we found the
Explorer that I wanted now I only had $1,500 down payment of my own money and we needed 3,000 okay and uh I financed
the Explorer through my own lender Private Bank Susan gave me500 from her
well tell me how that came about Sir you went looking for the explore you went into the store he had a Salesman he came over he showed you this car let me hear
what how it happened well we just took it for a test drive yes um we liked it
and Susan and I had the conversation there at the dealership when they were gathering paperwork I said well I don't have you know they were trying to make
the deal and uh she wanted to tell me about the conversation now we're getting
to it okay the conversation was needed it she would give it to me500 and I said I you said are you sure
cuz I'm still paying on needed it she would give it to me500 and I said I you know said are you sure cuz I'm still paying on the extra
from the 240 you know I'm still paying that 64 93 a month for that and uh I'm
not you know I just don't have the 1500 she's like well you know don't worry about it it's close to Christmas you know we'll uh we'll get through it and
that was that was Christmas will get through what well meaning that it was going to be like a gift that I I told
her I said I was not going to to be able to pay her back you know and she said you told her that sitting there sitting
there sitting right there you told her that yes ma'am is that true that's absolutely not true well tell me your
recollection of what happened okay when we're sitting at the dealership um he needed the $1,500 he only had
$1,500 he asked that I I loan him the $1,500 what did he
say he said remember the last times that you've loan me money I've paid you back
I've been good about paying you back back I said yeah this is a lot of money though and he says well I've been good
about the money I promise to pay you back I will pay you back and I said well if you want this car and you and you
want to you want to make this transaction I don't mind doing it as long as you pay me back and he agreed to
that he said fine I'll pay you back I think probably somewhere in the middle of both of these stories lies the
truth because quite frankly it just doesn't sit well with me for two people who are living together
and I assume planning a future together if you're living together uh to have that kind of indepth discussion for
instance you were so good about it in the past you paid me money I've lent you money then you paid me back and I'm so
I'm going to do this again somehow that doesn't sit right with me nor does it sit right with me sir it's coming up
towards Christmas and consider it a Christmas gift you understand so somewhere right in the middle of this is
the accurate rendition now when for the first time did you ask him back for the money
I asked him in April I talked to him before when we broke up because we broke up before April if if um he would pay me
back he said when did you break up we broke him in January had you both decided that it
wasn't a good relationship um there's been other he's kind of abusive and a
little he's yes and you were paying your bank card all this time yes I'm paying
my bank card I I had money on it already and so I had interest accumulating and so I I still haven't been able to pay
everything off because I'm still going to school I'm a student at San Diego State and I'm taking loans out I take
financial aid there's no way I can give anybody money what do you do for a living sir I was in the Navy four years
what are you doing now I'm still in the Navy now it's my last I called the bank and I asked him it's uh $325 accumulated
with no payments so it's a little less than what you're suing for you were suing for 2,000 so yes just to make sure it would
cover that's my advisor said to do that
so sir yes ma'am deal the money I don't believe
so but uh I'm not sitting up there so here I
am Judge Judy is ready to
rule listen she purchased a car from you even when you were
together he had payments on that car through love and affection you could have said to her listen don't pay me any
money for the car I want you to have it because I want you to have a safe car to drive you didn't do that I couldn't
afford to do that well she says she she goes to school she can't afford to make
you a gift of $1,500 you knew she was going to school right yes ma'am so you
couldn't afford to do it and she can't afford to do it so she purchased a car from you she
had money saved up I assume I mean who knows whether you could have gone out and sold that car for anymore if you sold it privately
it's very possible that you couldn't have that that was really a fair market price for the car at the time you sold
it to her in any event she paid you you didn't pay her that doesn't sound fair to
me so the Judgment in this case is for the plaintiff in the amount of
$1,825 thank you b i excuse you may step [Music] out Judge Judy continues in a moment and
on the next Judge Judy when spent you know a couple years together it was just time to we we were
just not ready for that intense of a commitment I don't think at our age he's very um angry person he's been an angry
person as he was a child and he always brought that up you know I lost so I can
just take it and uh you know and live and learn and move
[Music]
on in this case is for the plaintiff in the amount of 1,000 825 thank you I excuse you may step
out Judge Judy continues in a moment and on the next judge step down please
31-year-old exotic dancer Ladonna Sanchez is suing her former friend and roommate 26-year-old Shawn Henry for
unpaid loans rent and a stolen VCR order all rise
judge is case number 347 on the count in the matter of Sanchez versus Henry priz have been sworn in judge you may be
seated well each of you claimed that the other owes you money just about the same amount of money
$2600 change Miss Sanchez you claimed that this gentleman was living with you he
left owing you money for a variety of things which you'll tell me about you say you made a loan to her for
lawyer $1,500 for something you'll tell me about that so I why to just start from the beginning how come the two of
you were living together Sean said he had no place to go and when we first
moved together he was getting kicked out of his apartment I was leaving my apartment had you been friends yeah we
had been friends he we had met at work and at the time we were staying in a hotel and it was like you pay every week
then we found an apartment through one of his friends at work he got the apartment in his name okay and then
later I had got it put in my name I have a a rental agreement and I was giving Shawn the money because he knew the
landlord I had no idea and I work at night and so I would give Shawn money every week to pay rent Shawn didn't pay
rent I have agreement that we both signed saying that we're both four months in the hole in rent and I'm like
you know how in the world can this be I give you money every week you know what you're telling me is you gave him your
share of the rent how much was the rent 250 250 a month each yes each it's $500
a month okay so you gave him the your 250 yes and he never paid the rent no I
have a piece of paper saying right here that we're both and he signed it we both signed it saying that we're four months
in the rent four months behind in the rent to this day didn't I pay her 7 I don't know do you have a receipt sh
don't talk to each other don't talk to each other
okay you both signed that you're both responsible for half the rent did you pay the rent sir uh when I moved out I
paid $750 I'm talking about while you were living there with her we live together for a whole year and a half how long
were you living in the apartment together about a year and a half two years and did you pay the rent yes all
that time yes no he didn't he's lying Miss Sanchez yes
ma'am you have rent receipts she had them all did you ultimately pay all the
rent not yet I am still in the hole because of Sean how did that come about
that you're in the hole okay Sean was unemployed First Sea moved out okay cuz me and sea and my boyfriend were living
together right and everything was fine but we still owed her $2,000 three the three of you were living in the
apartment yes and the rent was 500
yes my my boyfriend didn't really live there he wasn't responsible for any of the rent was my responsibility he didn't
hardly have any clothes there okay he was just there just told three of you in a two-bedroom apartment in a two-bedroom
apartment yeah he had his own room I had my own room he had his company I had my
company so my boyfriend didn't really live there he had all his clothes some place else my boyfriend did Sean was
fired from his job came crying to me that he didn't have any place to go okay
no place to go he couldn't go live with his brother they were having problems he go live with his father they're having
problems so what you're saying to me Madam so I let him move back in I let him move back in on the agreement that
he help me with households in May of 1997 sir you signed an agreement that
you owed her a total of well this would be $1,000 right
because it says that total owing was $2,000 and Henry and Sanchez are
responsible for 50% of the total and you signed this correct correct so you acknowledged in May that you owed her
$1,000 yeah right did you pay her I paid the landlord $750 no no I'm not saying what you paid
the landlord I'm saying what you paid her why would I owe her because I gave you the money every day to pay the rent
and you didn't stupid you want it you want me to
dismiss your lawsuit no this is $2,000 each of you owe half of that so that's
$1,000 did you pay it or did you not pay it I PID 750 I guess I still owe the
landlord 250 when did you pay the landlord 750
July when did you move out July no sh sh Show me the receipt I
don't have that that makes this easy so that's $11,000 what else does he owe you
for he bought through through his work I got a VCR cuz he could get it cheaper
from Dow stereo how much did you pay for for it $160 okay that's all the money that I
gave him for the VCR how much did you pay for the VCR got a receipt right here okay
213 213 and you gave him 160 where's the receipt I don't I didn't give I didn't
ask Sean for receipts okay did she give you $160 for the VCR every day
I you wanted a video camera listen to me but you did
you each want money from each other it would be very foolish so you say you bought it for
$160 and you're going to show me a receipt for $213 and you claimed that when he moved
out why did he move out cuz he wouldn't do his charge nor did he pay rent the first month that he moved back in after
he was unemployed he went to Las Vegas okay that was on Memorial Day didn't
tell me anything and then he comes home oh I'm broke I went to Las Vegas like what the hell you go to Las Vegas for oh
so I can see if I can win some more money I'm like you've got to be stupid and every day that month that he was
there and he was unemployed I gave him money cuz every day I had had to go to work are you finished yes what's the
address of this apartment where you live together 802 Apartment
A he didn't help me with the chores he didn't help me take care of the I don't
care I'm not your therapist Madam this is a Court Judge Judy will continue in a
moment are you telling me that this attorney under the penalties of perjury in state of California is is lying yes
ma'am we really maybe I'll call them and later today she was in high demand cuz she was a natural blonde and had natural
big breasts I'm sure if I chose to pursue that career instead of a research scientist I would be in high demand
yes real cases real people Judge Judy dancer Ladonna Sanchez wants her
former close friend Shan Henry to pay her for back rent Shawn says she kicked
him out so what happened with the VCR that you said was yours he took it from me I would went to sleep he went in my
room and took it out of my room Okay now what's your story I let her use it and never says
she can have it I bought it crap sh
sh I said you could use it now you also say that you made some loans to him you want to tell me about that the month
that he moved in since he was unemployed he would ask me for money every day every day I'm not talk M listen to me
I'm not talking about the $5 and the $10 that you say you gave him because he was unemployed did you lend him any large
sums of money for which he promised to make payment not all at one time every day
can I borrow some money can I borrow some money did you have did you keep a record of that he was my best friend did you keep a record the answer is no so
you're just guessing about how much money you no I'm not I knew how much money I had saved in my drawer before he
had moved in so how much money did you give him $350 I don't believe that you can I did every day I gave him 20 or $30
every day cuz he needed it he needed it gas he was supposed to go look for a job I bought him
news you're not listening to me Miss Sanchez I said did you write down these
numbers I think I had to well then that's a problem he's supposed to be my best friend he was supposed to be my little now you're now your C to suing up
for a lot of money too let me hear it well one time not well look at me she
uh got arrested coming back across the border and um she needed a lawyer so she called me
crying I need a lawyer so I paid 1,500 for a retainer to try and help her
out when was this June 26th 96 does that sound familiar to you
no you just took out a piece of paper what is that this is the piece of paper that was the only thing that I was
supposed that I gotten from that lawyer I saw that lawyer once I knew it wouldn't do me any good I cussed sea out
in on the phone about what do I need a lawyer for lawyer wasn't going to do me any good just a second you went to see a
lawyer no I didn't lawyer came to jail and I'm like lawyer came to
jail lawyer doesn't come lawyers don't do anything for free I didn't ask him for the lawyer I never asked him for the
lawyer and if I did ask for him a lawyer it wouldn't be from him it would have been from ru my boyfriend listen to me
where were you when you paid this lawyer were you in I was California yeah does
he have a
SE I have a feeling you two people deserve each other cuz you are Miss
Sanchez irritating me and I'm just about ready to show you the door do you understand
yes with nothing not your $1,100 nothing if you
do it again you got it I want you to show me any
documentation sir that you have with regard to this lawyer right here can I see it please
well this clearly is a letter from an attorney indicating that he received he accepted a non-refundable retainer in
the amount of $1,500 from the defendant on your behalf on the 26th of June
1996 that's his ex-girlfriend's boyfriend's father why wouldn't he write
him that piece of paper are you telling me that this attorney under the penalties of perjury in the state of
California is is lying are you yes ma'am yeah really maybe I'll call
him no all I maybe I'll call him you want me to call him can you look at this
for me a minute I asked you question do you think I have to call him no right but he was never my attorney I
did not ask Sean to get me a lawyer how did you find out she had been arrested
she called me from jail I believe that Miss Sanchez I did not ask him how how
would he know that you're in jail unless you call him I did call him from jail what did you call him for to say how are you no we live together this happened a
long time ago correct did you ever a sewer for this money no
why so I cared about her good excuse me you on me I say something
sure when the lawyer thing each came you're lying Miss Sanchez don't lie to
me I don't like when you lie to me I did not I'm not sure you are now was there any ever an agreement that you had with
her that she would repay this lawyer's fee to you well we had an
agreement Mr Henry you don't want to go down that road sir I guess you do you want to tell me
about this agreement tell me what words we used Mr she said get me out of
here whatever it cost and you said I'll try the best I can I borrowed the money
from my brother no no don't tell me how you borrowed the money she said get me out of here right yes and you did mhm well I
tried okay no an agreement to pay it back means get me out of here whatever
it costs and I will pay you back that's a contract that's an oral contract but you didn't have that with
her no okay that's what I thought so that's honest judge Duty will continue
in a moment you never paid you didn't clean up the house you didn't clean up your your stuff I had just sit up there
and pick up after you bought food and everything and later today she begged me
for sex your honor literally Mr Swan you're not that attractive sir thank
you real cases real people Judge Judy exotic dancer Ladonna Sanchez wants
her former close friend sha Henry to pay for back rent loans and a stolen
VCR hey I can't figure out who owns the VCR I have a bill here for
$213 so she's also caused damage to my truck sh so I can't make a determination
with regard to the VCR I can only make a determination with regard to the contract that you both entered into indicating that you are indebted to her
for the amount of $1,000 now you want to tell me about this truck yeah she's uh damaged it well
tell me about that well one time at work she said she locked the keys in so she had to break the back window and I had
to pay for that I paid him back and we were in a fight I wouldn't
let her drive it she doesn't have a license or insurance on it so what did she do to the truck she kicked it put a
nice dent on the driver's side door let me see I got estimates of the damage reses
right here looks like there's lots of damage
on this truck lots of scratches on this truck from his DUI okay how about your boyfriend
kicking it wonderful you ready dismissed dismissed
goodbye excuse step out I don't understand why it was dismissed because
I talked he was supposed to be my best friend okay he doged me just cuz I won't be his stupid girlfriend sorry now it's
dismissed cuz you're stupid never see mying money again make
me sick and now the next case parties on Maris versus Swan step forward
32-year-old research scientist Anne Maris is suing her former friend physical education instructor William
Swan for unpaid credit card bills why do women give men credit
cards I think it has something to do with the word convinced Mr Swan looked me straight in
the eye and told me he loved me wanted to marry me that I thought he had morals
Mr Swan go ahead I thought he had morals and how did you meet him I met him in
the produce section of a Asian store Asian market and how long did you know him before you put his name on your
credit card five months and had you dated during that five months beginning about two or three
months prior to that we started seeing each other on a more regular basis and talking pretty pretty much every day on
the phone at least once so he needed some credit and you said you'd give him
credit on your card he said one morning I talked to him from work and he said he
desperately needed a refrigerator that he was getting skinny and that his brother wouldn't loan him the
money and that it would be about $500 and I told him I didn't have the
money and I thought we could find one a lot cheaper than that as I had paid a 100 for mine and that I would be willing
to let him put it on a credit card that had no other money on it so we could be clear and he he had told me he was going
to pay it out of his tax return and he didn't know why his brother wouldn't loan him the money to make a long story short because
Mr Swan is going to tell me what his defense is he ran up bills on the credit
card totaling $1,500 yes is that correct yes and he
does not dispute that that he is that right sir that's correct but this is your defense that you had an
agreement with her and your agreement was that as long as you maintained the
payments on the credit card that she would keep it open absolutely but that they came a point
when you took out a significant amount of money how much $1,100 yeah and that
after you took out the that amount of money she closed the credit card down yes so your defense says that she
breached the agreement yes by canceling the credit card and therefore you do not
owe her this money that's what your defense is something to that effect Judge Judy
is ready to rule well why don't you tell me what I
got wrong well you not that I don't necessarily owe but the fact that she breached our contract uh with reference
to me keeping the the pain pay paid that I shouldn't have to pay because she cut
it off basically out of spite because I wouldn't have sex with her mhm that's not true of course she begged
me for sex your honor what is that Mr Mr Swan Mr Swan you're not that attractive
sir thank you what does this have to do about owing she thought order well
sometimes love is blind Mr Swan you're not serious with me are you you're not
trying to tell this to me with a straight face that you don't owe the money that you took out on her credit
card because she breached the agreement when she cut off your credit I never said I didn't know it you sure you said
as far as I'm concerned she broke the agreement and I have no intention of giving her a dime that's what I said but that's what you said right here in your
answer yeah but I didn't know you $1,500 judgment for the plank that's why I excuse you may step out Judge Judy will
continue in a moment the ex-wife who was the defendant in this case destroyed or threw away some
Irreplaceable memorabilia of yours after you were out of the house you place a
dollar value on that memorabilia at $5,000 she says that you are an abusive
drunk who hit her left the house disappeared for months she had no idea
where you were and ultimately got fed up with storing the stuff and just got rid of it correct that is correct so how
long were you married to each other actually living together on and off for close to 3 years give or take we were
only married uh right at four months so when I left and I gather you were living
with the defendant's father that is correct all right so tell me about your
departure from the house the evening that I left um I was quite intoxicated
uh if you'll bear with me um this is the first time I've seen Michelle since the
evening that I've left and I still haven't uh really gotten over
but the night that I left I did become intoxicated I went back to her father's mobile home whereas we had another
argument and I was intoxicated enough that I don't recall whether or not she hit me and knocked me down or she shoved
me and knocked me down at that time I got up I slapped her and I left and I
never went back that was my understanding with her I had
told her if I ever raised my hand to her that I would leave and that was the only
time your honor that I had ever raised my hand to her so you left yes ma'am and how long
were you gone before you made a request for this property that you say you left behind it was about um two
months and how did you make that request for the property by telephone originally
talking directly to her yes ma'am now what property did you leave
behind sir uh I left my clothing camping equipment fishing equipment um some
tools an awful lot of books memorabilia uh my son's photographs from
when he was a child and I requested if I paid UPS
prepaid would she box these items up and send them to me and uh at that time I
never really got a response from her well did she tell you that she had already disposed of all the stuff not at that particular time
no where were you for those two months sir I was working living in U a little
town called Antioch I was living with my sister and I was working pumping gas why didn't you call the very next week and
make arrangements to pick up your stuff um the emotional situation was is that I
had been fairly mentally abused by her on a number of occasions as a matter of
fact there were times that I spent as many days in my van living there this is
my secure area after an argument
um you have to excuse me um do you have a drinking problem Mr Burch yes ma'am I
do okay has it been a long-standing problem with alcohol yes ma'am although
um this was one of the reasons I believe that Michelle had asked me to move in with her father he also has a drinking
problem and he needed a drinking buddy were you drinking all during the three-year relationship with Michelle
yes ma'am all right Michelle yes why don't you first tell me your version of
what happened on the night that your husband left he um was supposed to meet
me that evening and we were going my son and him and I were going to go to a MGM
Adventure Park he never came home he never showed or called and so when I returned from the
park because I went ahead and went I found him at a casino in town saw his van
parked in the garage and I went in and we looked for him my son and I both he wasn't
there so we went on home and there he sat on the ground very intoxicated
and uh laughing and I said thanks a lot for showing up for us
and uh I did push him on the shoulder and he fell back but I proceeded to walk
down the hall and out and he came after me and um he hit me with a fist close
fist like a man would hit a man and it spun my head around and I couldn't close my jaw for
seven days thereafter at that point we called the police I was yelling dad he's hitting me help me he
came out of the bedroom and uh the police were called at this point Glenn
tried to take my car and leave because his van was obviously still parked at the
casino and um I pulled him out of the car and I uh recovered my car at that
point he walked down the street got a neighbor Tak him back to his van at the casino
and I never saw him again or heard from him Judge Judy continues in a moment I
even went into rehab for 3 days but didn't work well after being out of
rehab for 3 or 4 days Michelle would make me a cocktail and later today I
wouldn't have been there if it wasn't for you Susie and every time I do something for you this is the way I get
it real cases real people Judge Judy 52-year-old engineer Glenn Burj is
suing as soon to be ex-wife Michelle claiming she threw away precious photos and memorabilia of his son what had you
done with all of his belongings put him in a unlocked shed outside of our mobile
home which meant he had access at any time day ultimately what did you do with
them we left him there for which I have receipts from the Salvation Army until
March 6 of 97 and then they came and took all the stuff yes what about his pictures and
that sort of stuff they took it all it was thrown in um garbage bags and boxes
and kind of and it had been 3 months that you hadn't heard from him according
to you not at all I contacted his aunts and uncles which I had his address book
so I went through it and found some took a chance that he might be and he was he
had been there and so they kind of directed me to an address and a phone number so who called him did you call
him yes and what did you say when you called him I didn't reach him I reached
the relatives yes Glenn was here he stayed a few days and left so you never really reached him no but he got the
message so he called back and when he called you you still had the property
yes we did so what was the conversation it was Hi how are you doing I can't live in Las Vegas anymore
anymore it's the drinking's too available and I
would like you to come live here with me and
um I don't really remember if the property really was mentioned at that time but then there came a time when you
did call Salvation Army yes now how much time passed between this first
conversation that you had with him and the time that you actually disposed of the property approximately 1 month later
and why did you dispose of it at that time because I received a letter from Glenn saying that he would be there on a
Saturday and pick up his things and I agreed fine we'll meet you here Saturday
and he never shows do you have that letter no that was a um no I don't do
you remember writing a letter to her no ma'am there was never a letter written my father remembers this your
honor I believe you okay I believe that maybe
you don't remember sir uh Mrs Burge I gather from your
husband that you knew that he had a drinking problem at the time that you married him because you've been together for three years before you married him
yes I did why would you I didn't know it was to that extent at that point um but
you knew he had a drinking problem yes and I he had said he was going to work on
work on that and I had hoped you would you know I get the sense from looking at
both of you and from listening to you sir that you still have some very strong
feelings for her yes I do I did since the first day that I ever met the lady
and I also have a sense that but for his drinking problem you feel strongly about
him we did we had a very very uh very close relationship and it
was good when H it was good when it was it was good when it was good
good Mr bur what have you done if anything to deal with this problem that
you I haven't had a drink your honor in uh almost 3 months during the course if I may add
during the course of our relationship towards the ending of it I even went into rehab for 3 days but didn't work
well after being out of rehab for 3 or 4 days Michelle would make me a
cocktail you have to understand Miss Burch the the nature of the illness you
know you can't treat it as if it's a if it's thing that you can turn on and turn off sometimes you don't understand that
you believe that he hasn't had a drink looks pretty straight to
me it's possible if he did enter period
of a BRI in his life would you be interested in trying to save your marriage I'm not
certain because uh he he did hit me and it wasn't the first time he had tried to
hit me before but he that was only when he was drunk yes well that's what I'm
saying to you I mean nobody should live in an abusive kind of relationship yeah but he did leave yes he did yeah because
I think he felt terrible that he did that and the police were on the way he probably was too drunk to even
understand that thanks so Mr Burge your lawsuit is a relatively
simple one sir she doesn't have to store your property she hadn't heard from you for many
months I do believe that you did make arrangements to go and pick up the property and that she didn't show up and
she got fed up and ultimately said just get the stuff in any recollection of this man out of my life because I don't
want to deal with him anymore if I me I also have phone records stating or
actually physically showing that I have been in contact with her since December
January February and she says that she says that you had them and in February I
also um sent her a dozen long stem roses to her job I was trying to keep this
relationship going as long as I could possibly because of the
feelings um then you wouldn't want to be punitive Mr B surge right and you did in
fact hit her and I believe that you hit her whether you realized at the time or
not was more than a slap so you're going to have to live with the fact that because you have a drinking problem you
did certain things that were really the antithesis of good behavior for any human being to
another Judge Judy continues in a moment certainly get the sense from the
two of you that neither one of you is prepared to totally throw in the towel maybe you can ditch dad's for an hour
and go out and have a cup of coffee and later today you using me is over with it's over with okay no problem that's it
Susie That's it real cases real people Judge
Judy Glenn Burge wants his estranged wife Michelle to pay for the loss of photos and memorabilia of his son
Michelle says she held on to his belongings for 6 months I don't think she's a bad person
sir she's not okay so we really shouldn't be here today other than perhaps for you to see her cuz you said
it's the first time that you've seen her since you left yes ma'am you certainly get the sense from the two of you that
neither one of you is prepared to totally throw in the towel you know what I mean
yes pardon me sir maybe you can ditch dad for an hour and go out and have a
cup of coffee or breakfast and just talk uh is that a possibility
if she's willing you willing I don't know you're well you see about it Miss
Burch uh if your husband who I clearly believe you have some feelings for
still no or yes no I would say no really okay
yes just too much has happened I I can understand that
can understand that Mr bur you may have to try a little harder sir she's vacillating a little bit so
you may have to try maybe 3 months isn't enough in any event uh I'm not entertaining a claim $5,000 sir I am
dismissing your lawsuit that's all excuse you may step [Music]
out and now the next case part's on Bishop versus bomb step forward please
35-year-old Lori Bishop is suing her former girlfriend ingaborg Bound for the cost of a parking ticket ingaborg says
it's not her fault she got the ticket and refuses to pay for it this was your friend mhm she asked you to do her a
favor and drive her downtown MH because your daughter was in jail yes and you
didn't have a car no so you did her a favor drove it downtown yep parked your
car where you shouldn't have well not really where I shouldn't have we parked
the car we stayed there we tried to find out where rat was going to be and is your daughter yes find out how long it
was going to be before she got released well we've been there probably about 3 hours and um we got back to the car and
Susie says what is that on your windshield and I says it can't be a ticket because I can park here I parked here before I know we can park here so
we went and got something to eat we came back and we parked across um where this in this little um complex and I it said
no parking towway zone I'm like I don't feel good about this so all we had when I went to the when we started our trip
out um I got her I told her that I'd pay for the gas I mean she has to pay for
the gas but I'd give her the ride so we got to the gas station and um we um her
ATM card wouldn't work so I put $20 in my car and then I got $20 for us to eat because we weren't sure how long it was
going to be for us you know before we got back you parked your car where you shouldn't have parked your car Miss Bishop right well I did well it was it
was the M said parking this way no parking this way right there what what is that just a second what does that have to do with her well I wouldn't I
wouldn't have been there if it wouldn't have been for her that's what she keep seeing and I told her I wouldn't have been there I mean I did her a favor I've
done a lot for this lady you know listen to me your argument is that but for the
fact that you were doing her a favor you wouldn't have had your car down in that location and you wouldn't have gotten a ticket and therefore she is responsible
for the ticket right let's say you were driving with her to pick up her daughter
mhm and you were speeding right and you got a speed just a second and you got a speeding ticket
mhm who would be responsible for who would be responsible I would be because
you did the wrong thing right Judge Judy continues in a
moment now you try to explain to me how it's different parking where you weren't
supposed to be parking mhm and speeding well because she didn't have the money to pay where we could where we could
park where it wasn't going to cause us any money I mean where it wasn't going to you know cause me any harm she didn't have the money she didn't have any money
when we went but then when you parked there under the tunnel I asked you can you park right and I could cuz I did
before so I asked so just a just a second so you said you've parked there before and you didn't get a ticket right
this time you did right pay it okay well what about the what about the money that I mean I I took $40 to eat on for the
for the parking you know to finally pay the $5 for the parking and stuff what about that just a second when I call
Bishop I think she's responsible for those out of pocket expenses the gas
right yeah you paid $5 to park the car after you moved the car when you got a ticket
were you were with her when she moved the car yes and she paid $5 for that yes you think you're responsible for that
yeah absolutely I agree with you that's $25 mhm and if you think that you were
wrongfully given a ticket right then you have to go argue that the parking
Violations Bureau you go before a hearing examiner and tell them your story MH but you parked your car in the
wrong place mhm you got a ticket right you have to pay for it well okay
okay good judgment for the plain and the amount $25 that's than part I excuse you may step
out Judge Judy continues in a moment Garrett is suing her granddaughter Misty
Omen and Misty's boyfriend Tom Bradford claiming they used her destroyed her property and stole precious
momentos order all rise quiet in the courtroom please all
rise ma'am judge number 230 on the calendar
in the matter of Garrett versus Bradford Omen P up and sworn and judge you may be
seated Miss Garrett this is your granddaughter that's correct your name is Bradford yes ma'am
and you're her boyfriend yes yes you live together yes and you have two children three three children but
they're not your children no ma'am okay Miss Garrett you're suing your
granddaughter and her boyfriend yes your honor because you rented them a house mhm yes I did and you say that a they
did not pay rent that's correct B they vandalized your
house yes and they took property that was yours from the house
absolutely when did you and why did you rent this house to them well Misty lived
there prior uh to for a year approximately prior to a year of her mom
moving out so originally her mother lived there and she lived with her mother and her three children exactly
and then she uh the mother moved out and Mist that's your daughter my daughter
Misty didn't have any place to go nor the money to go any place else so I told
her I would rent her my house and I did what was the monthly rental
$466 that covers my mortgage payment now you admit Miss Omen that you
did not make one rental payment yes and that's after you say you was served with
an eviction notice from your grandmother yes so you admit that you owe her that money yes I do there came a time when
you decided to evict her yes can you tell me why uh well for one thing they were not
paying the rent which I needed I'm I'm on a fixed income I needed the rent
money to cover my own expenses I have enough to take care of my own personal needs but not that of Misty her
boyfriends or her children so I needed the money for that and the eviction started over the the payment there was
also other problems involved during the V the uh V like what uh over the
children what um I Heard veral abuse from uh uh
Mr Bradford with the three children I was very much concerned about that they were going to ship the young boy off to
Alaska to a father that he did not that he hardly knew to people that did not know him and I was her oldest child they
were going to send to the father's house in Alaska because he was causing problems he does have a behavioral
problem but to me you don't have throw away children how close do you live to them I
lived about 60 ft in a studio apartment that's on the same property as my big house before you served them with an
eviction notice did you tell them that you wanted them to move out uh uh yes I
did are you sure uh I sent them a letter uh uh telling asking them to come to me
to work out a payment plan for the rents owed how many months rents did they owe
you by the time they left uh she stayed there they stayed there may I have a drink of water please they stayed there
for um 3 months they paid me a total of
50080 do you have proof of payment of more than $580 no I do not I um used money orders
and I gave the money orders to my grandma and then she went to the bank and made the
payment she says that you gave her a total of $580 um during the three months that you
were living there um we were there for three months and um I did pay the first
two months the third month I did not pay she says that one of the reasons she started eviction proceedings is because
you weren't paying her no that is not true um and she well you have the receipts to show me two payments of $466
each no your honor I do not I know you saying that the total they paid you was $58 that's
correct and she's also claiming that we owe um or that the rent was
$466 which um the mortgage payment and the insurance together is but um I was
only responsible for 290 of it why um I didn't pay the insurance she that was
not our agreement just a second maybe when your mother was living
there it was split differently but what was your mortgage payment $466 and2 in fact you have proof of that
yes I do can I see it please your honor uh actually the
payments were 290 as they were when the mother lived there
no no who said so that's exactly how much they were she
says that you had an understanding that you were going to pay whatever amount it was to cover her
mortgage payment she's claiming 466 I believe but that that's not true you're hon well I want to see whether it's 466
she's going to show me the mortgage may with the insurance May indeed be that but that doesn't mean that was the agreement to pay
that well why should just why should she subsidize you where can you find a house for $466 well I don't think that's the issue
with no no just a second where can you find the house for $466 you can find them in Fresno they're
they're available the people can scoff if they want that you're in you're in Los Angeles and for asno it's not
uncommon to find a house for 450 it may not be palacial but it'll be something that you can live in and was this a nice
house uh yeah it is it is a nice house it's an older house 70 or 80 years old and it's very large um well $466 doesn't
seem to me outrageous so do you work ma'am do you work do I work yeah yes I do what kind of work do you do
uh well I just uh got a job as a production supervisor with a poultry company what were you doing during the
time that you were living with Miss Omen in her grandmother's house well
uh you mean was I seeking employment or was I work were you working no at that time I wasn't working I was seeking
employment well who was supporting you uh I received unemployment how much $400
a month and were you working no why
not well um I have a few things that I've been I'm a recovering addict
alcoholic and during that time I've been seeking therapy and help for myself and
for my kids and that Well you certainly weren't living on $400 a month that he was getting from unemployment insurance
so you must have been subsidized by the state in some way is that right yes so you were receiving welfare yes how much
a total of 620 a month so you receiving 620 and he was getting 400 That's a
th000 Some OD dollars a month more than enough to pay Grandma's mortgage Judge
Judy will continue in a moment while she was involved with drugs involved with alcohol she had two more illegitimate
children with two other men now Mr Bradford you can understand why her grandmother was slightly
frustrated real cases real people Judge Judy lvll Garrett claims her granddaughter
Misty Omen and Misty's boyfriend Tom Bradford did not pay rent stole and
damaged her property Misty says her grandmother is trying to control her now
let's get beyond the mortgage let's get to this vandalism you have photographs of the house yes uh I do it's under
the uh the green tag there that you have I also have the color ones for you if
you would like those are copies I'd like to see The Originals
please one of the things Miss Garrett that I'm sort of surprised at well I'm
not faulting you because you know you came prepared for this lawsuit but that you took such care to prepare this
lawsuit when your granddaughter was involved so I my sense is that there's something more to this than just this
property damage did you have a fight with her about sending this young boy to Alaska yes I did when did you have that
fight with her uh it was uh after the
eviction no your honor that's not true it was prior to the eviction okay I couldn't be mistaken about that your
honor I'm not sure I mean there's been an ongoing argument about this child for a long time because of my concern for
his welfare did you ever ask your uh granddaughter if your grandson could
come and live with you he did live with me for one year he was in my custody for one year at this time as we speak he is
living with my daughter with his maternal grandmother right is that through the state no by agreement by
agreement between Mr Bradford and Miss Omen well what does he have to do with it you tell
me nothing is the answer I'd like you to look at some of
these photographs and tell me whether any of this looks familiar to
you I'd also like to add your honor this is a very sad day for me to have my granddaughter in court I have loved this
young lady for 24 years and this is very very sad for me to have her in court but
I've I've had it I I'm up to here with her the men she's been dragging in and
out of her children's life your honor uh I'm trying to be polite and be reserved
and be respectful of the court and you know I'm just going to take a chance here and speak out you know I'm a good
human being I'm not going to be ashamed of the fact that I'm in between jobs many people in America are in between jobs right now and that it's nothing to
laugh at or to be ashamed of and uh I met Misty uh some months ago in March in
fact and uh we developed a relationship and we we had a good relationship in in
fact her Suitor Bob mcgr hired me to do a number of uh odd jobs for him while I
was in between jobs and uh and in fact after the eviction offered me uh offered
me work and offered us a place to stay in one of his apartments that he rents and we have a letter here stating that
saying you can come and live in one of my apartments and you can continue to have your job we're not bad people and I love her children and I love her and
we're planning to have a future together Mr Bradford let me stop you sir I don't
doubt certain of the things that you said to me you don't fall in love with children after 6 months as I didn't say
in love just a second you love the children you say you love her and you love her children you don't love her children you don't love her children you
may tolerate two of them certainly you didn't love the third one the third one was being sent
away thousands of miles away from his siblings because clearly he was not
thriving in your home and he was probably in all probability you don't send the child away unless they are
particularly Troublesome he was going for a 4-we vacation your honor to see the father who she summons down to help
with the child within the last few years if you ask her she'll tell you just a second that's not what it says in the
answer when the uh the uh psychiatric uh when the doctors at the psychiatric facility recommended that we allow him
to to try to work out some of the unresolved issues by visiting with the St what do you Mr Bradford what do you
think the unresolved issues are sir well I'm not a a professional in psychiatric field but I so you're not a professional
and you've been in this family for 6 months you've been involved with these three children for 6 months you have
three children were you married once or more than once once once and the father is the the person who lives in Alaska is
the father of all three of your children no your honor okay how many children is he the father of one one and the other
two children do they have the same father no your honor so I want you to listen to me very carefully Mr Bradford
what she said is she's had it up to here with the men that her granddaughter has
brought into the lives of her grandchildren and right now very simple
I mean just on its face Misty acknowledges she had a substance abuse
problem hopefully she's in recovery but the bottom line is she has three children by three different men only one
of whom she was married to she has a little boy who was clearly suffering as a result of a his mother's addiction she
was in all probability neglectful of the children while she was involved with drugs that's clear you don't have to be
a genius to figure that out while she was involved with drugs involved with alcohol she had two more illegitimate
children with two other men now Mr Bradford you can understand why her grandmother who was probably been around
for all of these tragedies that have gone on for her grandchildren is slightly frustrated so don't tell me sir
that we're good people and I love and I love all these three children because
this lady has heard that before well you have to understand the frustration Judge
Judy will continue in a moment am I guessing at the fact that each of her three children has have three different
fathers not guessing at that and I'm not guessing at the fact so that you don't know one thing that went on in this
family from your own personal knowledge for the last 10
years real cases real people Judge Judy Airline technician lvll Garrett
says her granddaughter Misty Omen and her boyfriend Tom Bradford owe her for back rent and damaged property Misty
says it all started when she set her son away now all I want you to do is look at
those photographs and you tell me whether any of that damage to her property looks familiar just look at it
there are some things that I am responsible for but some of this for example the broken portable closet no
the screen what are you responsible for the screen right here the cat potty
the what the feces the cat feces that they left in my bathroom floor plus cat
litter in my kitchen with cigarette butts and cat pieces in it the pictures are all here you're not suing for that
much money right now you're almost to the amount of money from back rent this coffee cup right here that's broken on
the porch somebody threw that at the window and I asked keep going your honor
what the doorbell was removed because he took it down it didn't work he took it down he was going to repair it grandma
said that she didn't have the money to repair it so we just left it on top of the refrigerator this stuff is all just
a mess from moving just a minute what do you mean it's a mess for moving why did you leave a mess when you moved who suppos moving we had who was supposed to
clean it up just Missy who was supposed to clean it up did you come back and clean up your mess after you moved yes
this stuff we took with us I'm talking about the mess after you left cat litter cigarette butts in the cat litter dirt
all over the place did you come back and clean that up no my grandmother did not want me me to come back to clean it up
did you you mean you called your grandmother and said I left the house a mess I want to come back just for a day just clean up the my grandmother made
very C the sheriff the sheriff's escorted her out and when she forgot uh
one or two items inside the place in her you know Hasty exitus from from the the residents they wouldn't even let her
back in to get those items okay and so you know when a sheriff's there and the kids are all on on the porch crying you
know and she's trying to get her stuff and get out I'm not I'm not making her out to be an angel but she's a good person your honor and I love her and you see her sister
over there crying and I'll tell you why she's crying because you're making her out to you're guessing and I respect
your position guessing Mr exactly what you're doing I'm not guessing sir am I guessing at the fact that Miss Omen has
three children am I guessing that part you're not am I guessing at the fact that each of her three children has have
three different fathers not guessing at that I'm not guessing at the fact that she was addicted to drugs and alcohol
I'm not guessing at that no ma'am you're not I'm not guessing at the fact that you've been involved in this family for less than a year I'm not guessing that
no you're not and I'm not guessing at the facts are that you don't know one thing that went on in this family from
your own personal knowledge for the last 10 years you don't know that Judge Judy
is ready to rule Miss Garrett listen to
me don't rent them an apartment anymore I don't know if he's going to be
longterm or shortterm whether he's going to be as longterm as the other three guys that were in your grand granddaughter's life I haven't a clue
you've sued for very little money slightly over $1,100 they owe you at least $800 in
rent that's your lawsuit $1,184 is what your lawsuit was
for there is based upon what I've seen the mess and the mess alone in that
apartment as far as I'm concerned takes at least 300 bucks to clean up that kind of that kind of disaster so so you tell
me that this was painful thing for you to do yes it is I not only think it's painful I'm not so sure that I would
have done it I would have just said from now on I'm not going to bail my granddaughter out and I would have eaten
the $1,100 you chose not to do that and I can't fault you for not saying I'm
going to chalk it up and right from now on they're on their own it's sad that
you brought her to court she owes you the money she owes you the money for rent and she owes you the money for
cleaning up the mess that she and her boyfriend left in your house judgment is for the plti for the amount of $1,100
that's it Miss Garrett that's all thank you as I excuse you may step
out Judge Judy will continue in a moment and Beverly King is suing her stepfather
Alon black because he kept her baby pictures and keeps aches after her mother
died order all rise
this is case number 367 on the calendar in the matter of King versus black parties have been sworn in judge you may
be seated gentlemen Miss King Mr Black was married
to your mother for 28 years that's is that right yes ma'am and she passed away
recently you are suing him because you say he has certain things that should be yours that are Priceless momentos which
you've attached to PR price tag however $5,000 I didn't put a price tag on it cuz I couldn't put a price tag on it so
the price he says he has absolutely no idea what you're talking about except for perhaps a photo or two when you were
a child but he's more than happy to return married your mother
14 and how long did you live in the house married your mother 14 and how long did you live in the
house with your mother and Mr Black about six years
and how many years you out of the house quite a few years how
many 22 about 20 yeah so you're out of the house 20 years mhm did you have a
good relationship with your mother yes what things do you
believe he is withholding from you that you should have things like my baby
pictures confirmation you know when I made my confirmation um the baby picture when I
was a carnation baby um a jewelry box that I have that that was
given it's not like that I have I'm sorry I have like a photo with that in
the back it's not like that I have I'm sorry I have like a photo with that in the background that's name he took that
out the frame it's supposed to be a these are things I had with my mother you know say 42 years the frame fall
apart it Mr Black don't talk to her sir okay put them back in the Box sir
put them back in the bag the photographs and give them to miss King because that's why you brought them I assume yes
ma all right Miss King what are the things you make the transfer you know like I said
um it's not even supposed to be in this condition Miss King listen to me very
carefully Madam you had 20 Mentos out of that house do you have any other baby pictures of her in your house no ma'
there supposed to be other B there are other baby pictures just a second that's all he has what other things those are
the pictures that he says he has my jewelry box like I said when I was my uncle gave me when I was you know about
seven years old he knows what I'm talking about do you know this jewelry box that she's talking about that box
belongs to my wife because I took it upon myself to call her uncle and ask him I say who this box belong to this
jury box just a second you can't tell me what the uncle said you had a jewelry box there that you said was yours yes
you should have taken it 20 years ago what else Miss King like I said my baby pictures he know I just I resolved the
baby pictures Miss King else it's not solv because that's not one my that's not one my baby pictures listen to me I
am not making a search of his house I am not sending out the militia to make a search of his house do you understand I
understand it those are the baby pictures that he says that he has of yours he says he does not have any more baby pictures of yours does he even told
him he'd rather put him in in the trash before he gave them to me he we went over this he knows what I'm talking about did you ever tell her that no
ma'am he I was speaking to my unle I will take it off the wall because they meant nothing to me I will put them on
the side and she could send her son to pick them up but she's not coming to my house did you have a reasonable
relationship with your stepdaughter while her mother was alive uh halfway
because she leave our house and get her father and come and take her stuff put
them in her father car to go to mon Vernon and she didn't had she didn't has
the decency she was 18 years old to tell her mother that she was leaving and when
her mother asked her Beverly where are you going she says I'm going to M Vernon to better myself that's
that's Miss king that's not true up to now I don't see she better in herself
everything all right that's 20 years ago what I'm asking you after she left when she was 18 uhhuh did she come to your
house to visit with you and your wife yeah once in a while and she spoke to her mother on the phone yes once in a
while and did she speak to you on the phone not very often but she maintained
a good Rel a reasonable relationship with her mother yeah just to just to get money from her good well I could just
you have I'm looking at your complaint Miss King Mr Black lived with your mother for for almost three
decades and they had a good life
together sometimes they had they had a apparently
a good life together they lived together for 30 years yeah no yeah it wasn't they
didn't it was yeah it wasn't that no it wasn't that terrific no my mother had
spoken to me about a lot of things even up until before she died a lot of things they lived together as husband and wife
for 30 years almost almost yeah I have no idea what you're doing here you say
that you want in your complaint which really put me off a little bit you said that you
wanted some things that you had given your mother as gifts okay that that came
with an explanation what happened was I found out that he about a week and a
half when my um before um after we buried my mother he had another female up at the
house Judge Judy continues in a moment he said that it was because because you
know I had found out they slept in the same room with the door closed and everything there's another empty room but he told me they stayed in the same
room because um she was afraid of the dog
whatever real cases real people Judge Judy Beverly King said says her
stepfather Austin black won't give her baby pictures or keepsakes after the death of her mother alustin says Beverly
never visited her mother in the hospital Miss King what you're saying to me that
you were angry because practically immediately after your mother died you
believed that he was seeing somebody else is that what you're saying mhm but
is that what you're saying yeah I had I didn't like it it's not that that you know yeah I didn't like it what was the
cause of your mother's death she had just went in there for hysterctomy you mean she died suddenly
in the hospital yes she hadn't been sick no no how old are you
sir 71 years old Miss King 71 years old isn't old
today but but it's certainly the other side of the mountain
right and your stepfather was someone who probably was accustomed to having
someone take care of him do the things that sometimes men don't know how to do
you know which sometimes is a very long laundry list so the fact that he jumped into a
new relationship may not have sat well with you it was her best
friend somebody clearly that he was comfortable with mhm that knew him
assuming that everything you say is true your mother's best friend happened and she was right there
to jump in and sort of take over right
if your mother really cared about him she would probably say good let somebody else take care of him for the next 20 years I did 30 somebody else can do 20
if your mother was happy with this man reasonably happy in a marriage for almost 30 years you shouldn't be
Dickering over this kind of stuff so the stuff that you say you want which were
gifts that you made to your mother over the last whatever five years 10 years
that you're not entitled to those are gifts that you made to your mother this is her husband your pictures and things he says he's given to you do you have
any other pictures of her I'm going to ask you one more time I have I have the list and like I said he knows what I'm talking about because when I had when I
had asked him he told told me that everything in my mother's house belongs to my brother and my yes this is your
brother yes he said everything belongs to my brother step and my sister do you live in the house with him I was the
last one to leave the house yes you are her brother yes I just have a couple of questions for you we let's not get into
the pictures right away okay was he a good stepfather to you he was an excellent stepfather did he have a good life with
your mother he had a wonderful life with my mom do you have any resentment towards him I have absolutely absolutely no resentment towards him whatsoever
does he have a new lady friend um almost not an answer yes yes and you happy for
that yes I'm very happy for that because after my mother's death none of us was
around cuz we all had our own lives so he he needed friends he needed people in his life how old were you when he became
your stepfather seven eight seven he took good care of you very good care of
me your sister says there were a lot of pictures of in the house that are hers you've been back to the house of
course since your mother died yes of course are there any other pictures there that you saw of your father's no no Miss Ken you better get over it you
better get over it get over your anger your brother's hey his reaction is reasonable your
reaction is not reasonable okay can I just say no you can't say any your reaction is not
reasonable your reaction to him because that's what this is all about you resented the fact that within a week or
two after your mother's death he had a new interest in his life is this your mother is this your mother's best friend
yes it was a good friend of my mom I'm saying when when that happened my brother had came up for the funeral okay
my other brother came up for the funeral he was there at the house when I had call I asked him you know well how is
Jordan is he you know is he there this like 10:00 in the morning he told me no he walked Sherry home I was like walk Sherry home 10:00 in the morning it all
then it all came out he told me you know about Sher spent the night and everything think yes it upset me but I
also called him I spoke to him on the phone I had told him what I had heard about Sher be you know they stayed in
the same room he told me that they stayed in the room because you know there's another empty room but he told
me they stayed in the same room because um she was afraid of the dog whatever so I felt maybe you know she called me also
yes right that's when she found out that um Sher had stayed there what did she say and I told her are you going to stay
with her one of the things that she said that I really don't like is she had a good
relationship with my mom before my mom passed away she wasn't even around so I
don't see how she could possibly say she had a good relationship with my mom I like ridiculous don't talk to him
terrible I would like to explain that she says that she think that I'm angry
at her yes I am for the simple reason when her mother got sick
her mother was in the hospital for a month and 7 days she is 42 years old she
didn't even take 2 minutes to go and see her mother now you will know the truth I
spoke to my mother every now you will know the truth Judge Judy continues in a
moment and later today yes sir I wasn't drunk like she's saying uh cuz how could
we go play golf all the time real cases real people Judge
Judy Beverly King is suing her stepfather Austin black because he kept her baby pictures and momentos after her
mother died Mr Black speak to me when I go to see my wife my wife had give her
give up she's stressed out and her exact words to me she said don't call her

you and that was the last thing she never even see her mother when she was in the hosit you go to the hospital just
a second Miss King I just have one question to ask you Mr Black says that your mother was in the hospital for a
month and seven days right how many times did you visit your mother in the hospital SP to I didn't ask you spoke to
her I said how many times did you visit I didn't visit my mother I my it was I had I have asthma I had just came out
the hospital a month before that spoke to my mother every day my mother told how many times did you visit your mother
in the hospital and is the answer none none I spoke to on the phone Cas is dismissed that's all our excuse step out
please okay not the back door to your right not the back door to your right okay see they don't know that my mother
told me a lot of things about them okay he don't know that when I spoke to my mother in the hospital that she told me
about him having that Affair I wish you would tell them what you were in the hospital for me and my wife went to the
doctor my friend and asked what my daughter you know what he tell us we have to give her says when their romance
ended Ruth Davis still owed him money he loaned her for car parties on Moore versus Davis step forward please
60-year-old Howard Moore says when their romance ended Ruth Davis still owed him money he loaned her for car
repairs all right I see I have all kinds of evidence here Mr Moore you and the defendant were living together yes ma'am
and you say that you made a loan to her to fix her car you gave her
$928 right and then the romance lost its Bloom mhm right mhm how long were you
together approximately 2 years and when you separated she didn't pay you the
$928 cck she says among other things that you kept a piece of artwork that
she made and she placed is to value on that of $500 correct yes I did can I see
the
artwork can I see
you how did you make this cross stitch beautiful thank you just
beautiful give it to her you want I don't want it you bought you got it okay you got it
you may not want it but you got it you made it you fixed the value on it and
your answer you now have the picture back and now you owe him
$928 you agreed that you had borrowed this money I agreed but I also have paid
him back I don't know why I'm even here I paid him back the night I got my money
and it was how much August 14th how much did you pay him
$420 $428 I'm sorry and he had the picture already and he wouldn't give it
to me okay could you show me proof that you gave him
$428 no I don't have any proof now you say that there had been other loans that
you made during the course of the record on a pad but he has that may I see it
please she has down here your honor $428 400 money I got was from the bank
in whose writing hand this writing this is your hand that's my record that I kept that I kept track of paying him and
I paid him over the years and never missed the month I just didn't put paid in full because I was throwing it away
cuz he agreed when I gave him the money he agreed he said okay we're paid in full do you know what this is really
over he's upset because I moved out and I didn't want anything more to do with him and he just been calling me and and
harassing me at different times no Madam take a look at all take a look at these pieces of paper you wrote down on that
and it goes back quite some time every single payment that I assume you made to
him yes I did just show me on that piece of paper especially since you were
separating it would have seemed to have be logical that that would be the most important amount that you put down no I
moved out in June here's a June payment and here's a July payment and then in
August is when I took off for the boy cuz I knew that that he uh wasn't going
to give it back but what's the bottom well but that's so let translate that in 428
$428 well but that's so let translate that $422 $428 but you were taken off
the $500 for the boy Judge Judy is ready to rule
you were taken off the $500 for the boy you now have the boy back so I would be
owing him $428 I already paid this man why should I pay him twice Madam but
that's he's only upset because I left him well he may be upset because you left him but in your own handwriting it
says that you owe him $428 and that's giving yourself credit for $500 for this piece of artwork that you made which you
now have back that's in your own hand Miss David come on you owe him
$928 judgment in this case is for the plaintiff in the amount of $928 part are excuse you may step out
thank you Judge Judy continues in a moment and
on the next Judge Judy with I've had it I come home and
he's drunk all the time and and sleeping and with I've had it I come home and he's drunk all the time and and sleeping
and I just said I needed to get out and get a different life I wasn't drunk like she's saying uh cuz
how could we go play golf all the time I'm very upset no I I don't even want to see him
again Judge Judy continues in a moment and step forward please 22-year-old
Gracie Brun is suing her best friend's mother Rita holin for using her Sears credit card and not repaying her Rita is
countersuing for the years that she supported Gracie order all
rise quiet please judges is number 349 on the Cy
the matter of Brun versus H King P have been sworn in judge you may be seated have seats please I read these papers
let me see if I understand this miss brwn you lived with the defendant for many years mhm lived in
her home yes you were friends or friends of one of her children is that right yes how old
were you when you moved into her house 18 and how many years did you live there um until April 21st of
1996 and how old were you I was 20 so you lived there for two years MH and did
you get married is that why you left mhm um according to your papers there was a
time when you allowed the defendant to use your Sears credit card m M I believe
on three occasions and the total bill was about $500 mhm that's what you're suing her for yes she's quite
offended right that's right tell me why well because of the fact that you know I
open my doors for her you know she was a my daughter's best friend and so I just
figured you know um and she was an 18 she was 17 I have proof uh because we
had uh at the time we we decided that she was going to live under a roof going to give her medical and dental insurance
to cover for her braces I I have the uh the enrollment forms from my husband's
State insurance so you covered her health insurance I covered her health insurance her medical insurance I paid
for her a homecoming prom dress that I have pictures of you know I didn't ask
for anything in return you know and for her to have the audacity to come back at me for the $530 some dollar I did pay
her back that I did pay her in cash I paid her I I never go without paying a
debt and I never thought that I'd have to have a receipt to um to to carry with
me to prove that I have paid her because you know she would call me mother she would call my husband dad you know we I
I loved her as a daughter and she wasn't really anything to me and the only reason that I feel that she did this is
because of the fact that her mother-in-law uh was upset because I wouldn't come out and give her money for
the wedding in expenses when she got married so this you believe is really over money for her wedding exactly tell
me about that well when uh back at the time that uh she was getting her wedding
uh Arrangements done uh we were going to be getting a settlement my mother was run over and killed back in 95 and I was
waiting for a check to come in and at the time I was also on disability I've had back surgery and I had offered to
help out with the wedding expenses you know half of the wedding expens that was very nice of you yes it was why would
you want to do that because I loved her you have your own family yes I do you have children of your own yes I do I
have two children at home and a grandson and my husband and you volunteered to
face for part of the wedding yes I did and then what happened and then when um the months went and the money wouldn't
be coming in they were getting very stressful what do you mean the money wouldn't be coming the money that the money that was supposed to be coming in
for the settlement and it was getting closer to the wedding and the mother-in-law was getting very stressful
where's the money where's the money and I didn't have the money and what I little that I did have I went ahead and altered her wedding dress and I had paid
for the cleaning I had paid $100 towards the Mariachis just little things like that but nether did I never did I ever
hear that they had you know confronted the mother the biological mother for any money after everything that we've done
for her I just can't understand why she comes around and wants to sue me for 532 and it's over an amount of five over
5,000 that we have here in receipts let me just take a look and see because you have a counter claim which you
understand yes I really can't address and I'm going to tell you why because you never had an agreement with her
exactly that she was going to repay you for your kindnesses yes you gave to her
because she wanted to in order for me to entertain your counter suit I have to find that there was a contract even if
it was a verbal one for you to for her to pay you and there wasn't one exactly
okay so let me let me take a look at some of these things there is the uh orthodontist Bill
way at the back it shows $1,000 paid towards her dental work did she pay $1,000 towards your dental work did she
no she didn't I have cop right here of everything that I paid for the contract is in my name so I don't know what she's
talking about oh did you actually pay for her orthod husband's medical
insurance paid for that yes now when you were there for 2 years mhm to and a half
years mhm uh were you going to school yes I paid rent I paid her $37.50 a week
which added up to $150 a month uh the first and what did that include we I didn't have to pay for uh
groceries or anything the only thing I that we had to pay for was shampoo and detergent stuff that we used so for $150
a month you covered your rent your gas electric M uh your food mhm and whatever
other in dental expenses that they may have paid for they took you out to dinner when family went out to dinner did you go with them yeah and when the
family went out to dinner and you went with them were you ask to pay your share no sometimes she would treat
sometimes we would treat it was never like they paid for everything Judge Judy will continue in a moment if you do
things for people then that's out of the kind of your heart you don't have to keep a log oh I did this I did this I did this I happen to think you're pretty
ungrateful and later today I don't think he thought anything wrong with the three
of you living nicely together you look like three nice people you could live nicely together yeah the Golden Girls do it what the Golden Girls do
it he's cute real cases real people Judge
Judy Gracie Brun says her best friend's mother Rita holen used her credit card
and never paid her back Rita says she not only paid her back but she supported her for over 2 years now tell me about
the Sears credit card why did you why did you need her Sears credit card the
time that I used a charge card it was probably just something that I had to buy and the money hadn't came in yet the
settlement and I knew I was going to pay her back and I specifically remember paying her back because I what I do is I
put it in a list of who I have to pay and when I got my settlement my sister here she was there when I showed her
that I was going to pay Gracie I entered my daughter's room and I had the money in my hand I said gra Gracie would you
like for me to go pay the Sears account or would you do it yourself she had stated I'll pay it later mom your honor
I moved out of her house while she was in Hawaii I went back the night before and she helped me get the rest of my
stuff to take me I don't know when she came and gave me this money because I have statements here she signed her own
name on my card and this one she signed my name so I don't know if you want to look at these but she never but miss
braa tell me about this wedding problem because that's probably what precipitated this lawsuit I can't
imagine otherwise why you would after what appears to me to be tremendous
kindness by a total stranger to you you would come into court and sue her for $500 that wasn't even the thing I called
I have talked to her on many occasions about this bill I told her I cannot
afford to pay this anymore because that's not right you know she did do a lot of things for me out of the kindness
of her heart which I don't understand why she wants me or why why she's patting herself on the back if you do things for people then that's out of the
cons of your heart you don't have to keep a log oh I did this I did this I did this we're talking about two and a
half or more years of taking care of really a total stranger and there's something else here I mean maybe it's
about this wedding business did you have a big wedding yes I did did you expect her was there an
arrangement where you expected her to pay for part of the wedding I never asked her she offered offered to pay how
much for half how much was the wedding I don't even know my mother-in-law paid for everything she made arrangements to
pay for the whole thing she offered to pay for half so she started adding in oh let's have miai let's do this let's do
that because she was going to pay for half right well two weeks before the wedding she started saying I can't pay for this I can't pay for that I can't
pay for this I never said anything to her about it it was never that was never
an issue with me were you angry was your mother-in-law angry no then I don't
understand why you suing her because it's money that she charged on my bill I I don't think that I should
have to pay that and you say you paid her when she came back into the house I paid her when I got my settlement as you
can see I have uh papers there where I got our our check in '96 it was in March of 96 we got a check
for1 18,000 how could you pay me in March when you didn't charge till the 2nd of March and the a April 18th and
19th how did you pay me Miss BR anyway why you're so angry because it's
frustrating why is it frustrating she say she paid me for something she hadn't even charged yet no she said she got a
settlement at that time she money she paid me in March she had even charged anything in March until March 2nd and
April 18th and 19th Miss Bron I don't know why you're so angry with this
lady it's not what she see she said she had the money because she got the settlement in March then she should have
paid me the money she would me I'm not satisfied that she didn't pay you the money I happen to think you're pretty
ungrateful yes she is she say she paid you anybody who takes a total stranger
into their house treats her like one of their own for 2 and a half years when their own mother is not taking care of
her takes care of putting her on their insurance so that at least she has the opportunity of having her teeth fixed so
that she does have medical insurance even if it's just another $20 a week that's taken out of this man's paycheck
to ensure that you are covered by Insurance she fed you she provided a roof over your head she treated you like
a member of the family that's right so that means she's a pretty good person and that means this pretty good person
is telling me I paid her I have to believe a nice person like Miss hulin
would not lie to me about paying you back so your lawsuit's dismissed I excuse you may step
out she burned the bridge that she that she walked on you know she doesn't have a family now you know she has nobody I
have a all right right used you that the night Shining Armor came and took
you and now the next case parties on Taylor versus Gom step forward please

not me okay and before I said it something else and she said another
thing if I want to fly I wouldn't wait till you leave out F him while you
here and I said go ahead that's honest go go ahead I mean you know I don't I
care less okay and then she walked over to me and she rushed up in my face I
mean she was so close I I could I felt the breath her warmth breath from her
mouth say and her left breath touching my left shoulder and then Lee Lee saw that the
conversation was going anywhere so he stepped in between us so those are the two incidents that you're complaining
