Judge Judy [Episode 9973] Best Amazing Cases Season 2O24

y old waitress Emily algy is suing her ex-boyfriend 25-year-old restaurant
manager Ken palazola for the return of her belongings and for emotional distress Ken is countersuing claiming
Emily destroyed his magazine

collection yeah case number 229 on the calendar in the matter of all guia versus palazola I have been sworn in
judge you may be seated folks have seats Miss guy are you and the defendant had a relationship and lived together
according to what I read for a few months yes you became pregnant had a fight and you were escorted Away by the
police it is your claim that the defendant kept some of your property yes
ma'am and you also think that he emotionally disturbed you
yes he suing him for money because you were saddened by the fact that you had
this baby and he's not sure if it's his and hasn't had any contact with the baby so you're sad I don't know if you get
money for that but we'll find out Mr palazola says that sometime prior to
this major fight when you finally were escorted out by the police you had destroyed his favorite magazine
collection by pouring something on it is that right she spray painted them and threw them away and that since he's
remarried you have embarked on a campaign of harassment for which he wants to to be reimbursed his harassment
he only wants $400 for so it couldn't be that terrible okay when did you live together
start and finish he signed the lease on I believe it was May 24th and I moved
out on the 28 of August of 2002 when did you move in with him was that on the
24th of May no I moved in with him about 3 weeks prior to that at his mother's house so the beginning of May August
28th is when the police escorted you out yes okay what items do you claim you
left behind when you were escorted out by the police I have a list do you want a list is it a very long list no it's
not very long and this is August 28th of 2002
yes what took you so long to get to court being a single parent is pretty difficult we're talking a year later
madam what took you so long to get to court well it took me a while to get all of my things in order look just showed
this to defend
please all right now I've seen what kind of items you're talking about I'll take the list backward we're talking about
two oven mitts a calander for spaghetti we're talking about a cutlery tray a
blue green tumbler a toilet bowl brush four ice cube trays two plates two bowls
two washcloths so let's get to what Happ happened on the 28th of August when you
were escorted out I found out I was pregnant and everything just started going downhill after that in the
relationship and he was working major hours at work well working and one night
I asked him if he was cheating on me and he was like you're crazy and that was the night prior to the 28th and we got
in a big fight that night the next day we were fighting fighting fighting all day later that night he was picking me
up to throw me out of our apartment when I was was 2 and a/2 months pregnant and did you did you scratch him first no I
scratched him to put me down when he was Pi literally picking me up to throw me out of our apartment and then I went to
the store with our roommate and he called the police and when we got back the police were there and they arrested me they arrested you because they saw
evidence that you had assaulted him that I scratched him yes but I also had a bruise on my leg but they told me that I
could talk to the judge about that did you plead guilty to assaulting him I PL guilty but then whenever I went for my
actual court date they told me that I would get a lesser sentence if I was to plead guilty so yes I pled guilty in the
end when you were escorted out by the police did you have an opportunity to get your clothes no when did you come
back for your clothes I never did because he had gotten a restraining order so my father and my brother went
over there to get my things and he had already packed them up and I had a list for him and they asked him about the
other things and he said that he got rid of them this is not a lot of stuff Madam this is a lot ofu this this is nonsense
stuff it's ridiculous did he ever sue you for the assault no call it even now
let's get to the counter claim okay uh look at there fast to start your honor
uh we had to move out of my mother's house because she made it so difficult uh she couldn't keep a job uh so
therefore all these items that she's bought pretty much came out of my wallet other there's are already took care of
that I'm talking about your counter claim pay attention we're over that the night before the police came out she
wanted to fight and she wanted to do it in front of my roommate which is out in the living room that is when I picked her up there was no picking up the day
after I picked her up carried her into the room so we could talk because she likes to have a show and she likes to
fight in front of people she can't do it between me and her so the next day me and my roommate we went out came back I
looked out on a window ledge a magazine of mine was spray painted and I asked her you know where is everything thing
and she told me she spray painted them threw them away at this point I was a little upset the police were called out
they were called out three times that day first two times they what day are you talking about the 27th of August of
August so the day before no no I'm sorry it was the 208th what day did you spray paint his
magazines I didn't spray paint his what you do to the magazine I spray painted one magazine and what' you do with it it
was on the window sill when what date on the 28th go ahead so they to come out
three times uh the second time is when she really abused me I had scratches all over my back that turned into a couple
of scars the third time they came out a female officer came she seen the scratches she agreed to arrest her for
domestic violence now at this case all I wanted her to do is just to leave so
that's why I didn't press charges uh the state of Michigan is the one that press charges on her and put the restraining
or I want to know what your counsil claim is about uh the due harassment uh she found out that I had a girlfriend
and and that's when all heck broke loose she wrote a letter to my Corporation did you file did oh to your corporation yes
let me see what she wrote to your corporation this was a couple months after the court case happened I
also you wrote a letter to the defendant's employer he has an employee
living with him an employee that works in the same store and you are sure that that's against company policy you give
the employees name and then you say that he also has a mother and brother working for him and I'm not sure if this is
company policy or not but it seems to me that this is unfair treatment to other employees and more favored towards those
particular family members and then you name them why in the world would you send this kind of I put in there I
didn't say anything why in the world would you send this letter I don't know I guess out of Vengeance I don't know
right there was no reason for you to write this letter except to harass him is that right I wasn't harassing him of
course you were well who are you harassing the corporation Judge Judy continues in a
moment well if it is mine I'm going to fight for custody right now instead of fighting for custody why don't you fight
to find out if this is your child real cases real people Judge Judy Emily algy
says ex-boyfriend Ken palazola owes for the return of her belongings Ken is
countersuing claiming Emily destroyed his magazine collection and slandered him at work what else I also had the
police reports from uh for damaging my property I'm not interested in your magazine sir um she wasn't able to
contact me and she called me many times and uh as soon as she found out that I was married is when all this took place
she ever taken you Court to established paternity of this child no the front of the Court's really slow I just have to
wait to be contacted by them so you did file a yes ma'am I well just for child support yes well paternity because he
says he wants I assume you want a blood test yes maam when did you file that lawsuit um in the beginning of May of
2003 in any event I'm dismissing your claim because you have no case against him for this property I do find however
that this letter was sent maliciously and for no reason you can't do that you can't conduct business that way young
lady I mean the two of you were foolish enough after knowing each other for a few months and having a tumultuous relationship you were foolish enough to
get pregnant and have a child that was pretty stupid right yes now you understand that if this is your child is
there a strong possibility that that's true I honestly since then finally out she slept with two men while we were
together while I was away on business at the time when uh the baby was conceived so you're not sure no not at all okay
that's what he heard from someone else so listen truth of the matter is you don't have to wait for the courts to go
for a blood test I assume that you want to know whether this is your child or not is that right FR of the court I
assume that you want to know whether this is your child or not is that right yes because if this is your child times
are wasted you don't want to not have a relationship with your daughter do you no so then why don't you make arrangements between the two of you to
go and have a blood test um contacted the friend of the court and they said it was cheaper to go through them so
cheaper for who cheaper for your daughter cheaper cheaper for me cheaper for him but all the while he's missing out on his daughter's life if it is not
mine then I do not care but the point is if it is your child you don't want
another year to go by without her knowing you no but she uh also if it is
mine I'm going to fight for custody because she you right now wanted instead of fighting for custody wanted you fight
to find out if this is your child so the difference is $400 yes and
what's the name of the blood service there um they sent it to Washington uh I didn't bring that information with me
well you're going to get the name of the lab because I think that you really want to know don't you this your child or not
yes and that the sooner that happens the better off you are is that right yes so what we're going to do is I'm awarding
you $400 on your counter claim sir because I believe that she did in fact harass you but the check's going to be
made payable to the blood bank so the two of you and this little baby can go and have blood tested and find out
whether or not this is your child does that sound reasonable to you do that way you can find out you got it I don't need
to find out he does no you need to find out when you have a child out of wedlock
stupidly you're living at his mother's house house did you get thrown out of his mother's house no we didn't it was
my choice to move out and what about your house with your parents did you get thrown out of there initially
technically not technically not technically and how old are you I'm 18 and then I when I read your complaint
you said he told you he wanted his life complete with a baby so you got pregnant this was not this was not an accident no
it was not an accident this was not an AC this was an on purpose somebody 17 years old who has no job who has no I
had a job yes I had a job didn't last long because according to what I read your job didn't last long because his
mother said you shouldn't work so hard so you quit your job well that was my second job do you understand yes I I
believe it's more important for you to find out for him to find out whether
this is his child and for you to get any money either of you I don't understand
why you would come in and Sue over two po holders why you would come in and Sue over a spoon a lad a green blue dish and
you sue her over this letter which clearly didn't damage your job right well it did because I had to take a
couple of days off I sympathize with you sir listen to me if in fact this is your child the fact that you have turned away
and said it's not my responsibility is very unkind to both her and this little
girl so it seems to me a standup fellow would say if this is my child I want to
know and I want to know now not 6 months from now not eight months from now and then have the audacity to
say if it's mine I'm going to fight for custody whenever but by that time your daughter's 2 years old she doesn't even
know who you are well in defense of myself uh the state did have a restraining order so I was not able to contact the mother of the baby well you
don't have to you don't have to contact her go to court and file a lawsuit they'll order a blood test could I
please we did my mother did send him a certified letter letting him know that I did have the baby what difference if he
says he's not sure that the baby is his what difference does it make I don't know but he wants to know instead of
money for your harassment he's going to take a test right yes ma'am perfect goodbye f i
excused you may step out yeah I had a very very good collection his porno magazines I know she's uh so he hasn't
seen his child and she's 5 months old I don't think it's mine and now the next case all parties in the matter of Flor
versus ety step forward please business owner Wanda Flores is suing the father
of her daughter's boyfriend environmental technician Don ety for the value of a car Wanda claims Don traded
in her daughter's vehicle without her permission Miss Flores is this your daughter yes ma'am is that your son yes
it is Miss Flores your daughter and the defendant's son have a child together
yes your daughter is 17 your son is 18 and how old is the child four months so
they were both underage when this child was conceived yes in December of 2002
you claimed that you gave your daughter an old car in January of 2003 Mr Eddie
took your daughter I assume his son down to a car dealership your daughter signed
over the title Mr Eddie purchased a newer car right yes he purchased it in
his name but with the understanding that the kids would be driving it and that your daughter and you would make the
payments on the car yes then something happened and his son went to jail and you claimed that despite the fact that
you and or your daughter were making payments on the car Mr Eddie took the car back cuz it was in his name and he
says it got repossessed by the bank so are you following this you know this Gone With the Wind I got
it so what you want is the value of the car that you gave your daughter in
December of 2002 yes ma'am Mr Eddie tells a whole different story which I'm
going to let him get to when you gave your daughter this car in 2002 in
December what date in December was it um it was like a week before Christmas and
where did you get the car from I've had it for years was it running yes we just
put a new front in on it we really did a lot of work to it did you have a conversation with Mr Eddie about trading
in this car car no I didn't did you give your daughter the title to the car no I went as soon as they got the car they
called me and asked me if I'd come and sign the title over oh I understand so you gave them a gift but there was an
understanding with Mr Eddy that they were going to use that car as a tradein yes okay now what was the agreement as
far as payment they were the car was supposed to be put in their name I know
right now they couldn't put it in their name because teenagers but um William turns 18 in
August the time they couldn't put the car in their name yeah and they probably wouldn't give him a loan anyway exactly
so he put it in his name yes what was the arrangement as far as payment was my question I was going to pay the payments
with Michelle and the car was supposed to be after they got old enough to put it back in her their name January
February when was the car repossessed I don't know what month Mr ready it was last month why because of default on
payment how many payments were missed uh one which payment April's April payment
yes your honor was due on the 8th of every month and there was no payment made in April no and that's why you took
the car back yes ma'am so you would agree that if she can prove to me that she made April's payment you're in
trouble right yes show me I don't have any proof I really don't so what am I
supposed to do I think they deserve a car for their new baby what Miss
Flores that's nice there used to be a program you know called the millionaire you know you wait for John bears for
tipon to come knock at your door and give you a million dollars and then you go and buy whatever you like you had an agreement you had an
agreement with Mr Eddie your agreement was that you would make the payments on this loan every month he says that he
repossessed the car because you did not make April's payment that was due April 8th and he repossessed the car in May
and then he it got repossessed by the bank cuz he couldn't make the payment either my question to you is very simple
show me you made April's payment and then you have a case you tell me I can't and I say so what do you want for me and
you say I think they deserve to have a car so maybe you can convince bird to buy him a car your honor if you breached
your contract with Mr Eddie you're not I didn't have no contract with him yes you did no I didn't you just testified under
oath that you did you don't understand Miss Flores you testified under oath that you had a contract a verbal
contract with him that you would make the payments on this car no I had a verbal contract with my daughter you
can't she's 17 she can't make a contract only he can make a contract and you testified that you had a contract
contract was with him that the payments would be made and April's payment wasn't made he had an absolute right to take
back the car your case is dismissed that's all why do I excuse you may step out heavy equipment operator Larry
Huffine is suing his ex-girlfriend JN Donovan for switching around his prepaid
grave plots Larry claims she forged a document to do it find in the courtroom
please now this this case number 127 on the calendar in the matter of Huffine versus Donovan prob have been sworn in
judge you may be seated ladies have seats Please Mr Huffine was the defendant what I gather is you had one
son yes her daughter was in a relationship with your son yes and he
was tragically killed right at that time you decided to buy some burial plots
five of them so that when your son was buried you would know that you would be buried next to him and where the family
would be she bought plots above you her her daughter did in any event this is
your complaint you found out that a stranger had been buried in one of your plots yes and it is your claim that Miss
Donovan caused that to happen yes and that she forged your signature for the
authorization with the cemetery yes in order to move around the spots you say
you never gave your permission for that that's correct and you want to be compensated yes Miss Donovan says that
you did in fact give your permission and she says that she can prove that you
gave your permission and she is counter claiming because she said she's had to go through all kinds of legal gymnastics
to clear herself of these allegations so first tell me when did your son pass away in 19 1997 December 24th and how
did he die a doctor made a mistake drilled into his brain so it was a surgical error yes how long had you been
living with Miss Donovan at the time less than two years and how long had your son been involved in a relationship
with her daughter probably since oh 13 years old how old was he when he died 18
now can you show me please the burial plot locations I would like to be able
to see that so I could put it in context I have a video right here if you like it I would
can you hold that a second please Mr Huffine can you walk up to the monitor please
yes and I'd like you to sort of point out with me to figer as it's being explain to me all righty okay this one
here is my parents they're located in the upper Cemetery this right here is my son when he passed away I bought this
these five Lots right here this one included I bought the these two for me and whoever I was married to and my
ex-wife and whoever she was married to at the time and the son was in the middle okay thank
you so you bought your sons one for you one for your wife if should you remarry
one for your former wife and her mate yes I so that you would all be together
now where did the defendants Daughter by their plot she bought the one in front of my son excuse me what just a second
one plot or two just one in front of his right okay go ahead and on May 3rd I got
a call from my ex-wife and she said I'm at the cemetery and she said it scared me to death someone was in your plot one
of my plot that I bought and I said no I think you're mistaking and she says no I'm not so I called Jerry and I said you
didn't do anything with these plots did you and she goes no I didn't so I went down the cemetery and I seen that
Anthony David was buried in one of my plots so I went up to the was it the one right next to your son or one it was the
end so I went up to the main office there at the cemetery and they gave me a letter that Jerry had wrote and forged
and switch plots on me can I see a copy of that letter please and here's one from the notary if
you'd like to look at that too saying that he did not do that i' like to see
both continue and at this point I went through different attorneys they
explained to me what she had did and they gave me a copy of that and you said I never signed it no I never signed that
she also called the cemetery and told him she did not remember doing this that's here
say yes I'll hear you I thought it would make it easier I do have copies from the cemetery of the plots that would make it
easier for you I'd like to see them please
okay tell me the circumstances surrounding the plaintiff agreeing to switch cemetery plots so that you and
your daughter would be together side I'd be head-to-head with Larry she would be
head-to-head with Michael Michael's mother and her boyfriend would be on one side of Michael and Anthony Davis is a
stranger to everybody right so I want you to tell me the circumstances surrounding Mr Hine agreeing to make
that change which in effect would say to him if you marry either your wife or
your ex-wife's mate could not be buried in the same line explain that to me when
we bought the plots and we did by the way who bought them I did Larry did they were under his name he paid for them yes
but so he paid for them so they were his plots right but all my monies went into Larry's checking account and I do have
proof of I don't care about that he bought the plots he bought the plots they were in his name at some point I
don't have a date but I believe it was in early 1999 my daughter had said she
wished that I would have bought my plot next to her and she said well I wonder if you can switch it I said I don't know
so I called the cemetery I asked the cemetery can you exchange your plot if you want to they said you can as long as
you do it before the last payment is made and if it has to be a letter from
the owner a request in writing notorized so I didn't do it immediately I thought
about it for a little bit of time and to be honest I don't remember any specific hard long talks between Larry and myself
I just remembered that he did agree to it I did write the letter out myself you wrote the letter out yourself and that
was in 1999 correct will you still together as a couple then yes we were when did you
separate from Mr Hine a the end of August 1999 so not far after this so I
assumed things had not been going well for a while Larry had suffered a lot of
personality changes due I guess to Michael's death so things had not been going well for a while right if you
separated in August and this was done in May it was a brief few months so I
assume that in May things were not going well between the two of you everything
seemed to be going fine except for that Larry was very depressed a lot so things
were not going fine well I don't know exactly what you mean I me we weren't screaming fighting tearing each other's
hair out well then how come you separated a couple of months later because the end of June or July he went to work in Utah and he had an affair yes
and when I found out I moved out Judge Judy continues in a moment that's his handwriting that is inconsistent with
the notary's log book well his log states that just one individual came correct and that's Miss Donovan and she
signed the cemetery affidavit real cases real people Judge
Judy Larry Huffine claims ex-girlfriend jyn Donovan forged documents so she
could switch around his prepaid grave wants so things were going absolutely
fine until that time to me they were and to you no I told her in the beginning of
99 she would be moving to start saving her money up and get her repl when did you tell her that probably February tell
me about the conversation that you had with her it took place she told me she was going to move her daughter back in and I said no she's not and she says
well she's not moving back in I'm moving out and I says well I have to go to Utah till the end of August when I come back
have your own place why did you not want her to move her daughter back in many different reasons her daughter was very
disrespectful she was 19 years of age she was experience an ecstasy drug and I
didn't want to be around it and I told her no and she could not accept that answer and that was in February that was
in February she knew after February did you continue to live as a family with the defendant yes well then how did she
know you were serious because when I told her she was moving out I was very serious she knew that okay was your
daughter living with you in January of 1999 I don't believe so was there a time
when she was planning on moving back in 1999 I don't remember okay it is your
claim Miss Donovan that the plaintiff agre agreed to switching of these plots
and according to your answer you have an expert witness who is prepared to testify with regard to that I'd like to
hear the witness is that you yes step up
please witness been swenberg witness has been sworn you're
on tell me your name Andrea McNichol Miss McNichol when did you become
familiar with the defendant well I actually just by telephone on uh May 8th
2003 and what did she tell you she asked me to examine a document I guess you're
calling that the cemetery plot document that was notorized M I asked her for the
original it's always best to examine the original she called back later and said she made an attempt to get the original
that they would not make it available I told her that anything that I could find would have to be contingent on that the
the copies that I looked at were true representations of the original in other words sometimes you get the original and
you see that someone had cut and pasted something on there or there are things on that that you cannot see when you see
the copies okay um after that she provided a large sampling of signatures
I told her to get the signatures of Larry hauffen in the notary okay this letter from the
notary did you in fact examine the signature on the notary yes and you
concluded that the signature on the notary was the same yes to my naked eye
the JS are totally different well if you'll notice on the letter he writes his JS four times well he wrote it
because he evidently looked at this you've seen this log book yes it is clear that according to the notary's log
book he did in fact notarize something for Miss Donovan correct but I I would
like to call your attention to the fact I was also provided a large sampling of his signatures not just the one may I
see them please yes actually I I prepared this whole report
this is the copy they made for you now that's what I'm looking
at well clearly his signature on this document
which has nothing to do with this case but I'm just looking at the signature the J is different from the J on this
document let's take a look I don't find it different let's take a look you never sign your name the same way twice let's
take a look no but this J is totally backwards it's my op that's his handwriting I'm
just asking you about the J that's totally different this other document he signs in my opinion with several shapes
to the letter J Judge Judy continues in a moment this doesn't strike you as being
strange yes it does somebody sends a an I love you greeting card and signs it
love Larry Huffine real cases real people judge J
Larry Huffine says ex-girlfriend JN Donovan switched around his prepaid grave plots without his
permission what do you say is his handwriting in just the
notary box in this just in the notary box now unless the whole notary area was
cut and pasted on here this is his handwriting in this lower which is a possibility yes without seeing the
original it is a possibility that is inconsistent however with his log right
but his contention no not his contention but it's inconsistent with his log well
his log states that just one individual came correct just one individual and that's Miss Donovan and she signed a
cemetery affidavit okay and it is your opinion
that the signature on this Cemetery document is his signature yes would you
go over there and bring that board up closer to
me so that I can see it I do have original documents
if you'd like to see them okay okay so the question signature from
this Cemetery document is at the top okay okay now I have not had the opportunity examine the original but if
the copy shows that there was not a cut and paste and that this ink was placed upon the paper then these signatures
match exactly to these other signatures some of these are from checks and some of these are from other things correct
cards greeting cards Etc yes okay put that back please just m I'd like you up here
please are you telling me
that you made your decision based on the documents that the defendant gave you
yes and one of the documents that she gave you was a greeting card I have it here Hallmark greeting card I'd like to
see the original bird would you hand me the original please I think that's all of them
there's several Originals I just want to look at the greeting
card I little strange with a a love and and a full name is it isn't it is
it this is the one miss m this doesn't strike you as being strange yes it does
somebody sends a an I love you greeting card and signs it love Larry Huffine he
signed every card he ever gave me everything she gave was like Larry D Huffine Larry Huffine always
37 love Larry Huffine I can only go on what's presented to me I understand
thank you very much good now I will hear from your daughter
she's been dying to say something I'm going to hear from you your honor you have a letter right in front of you from
the semetery saying that the document is an original document no it's not an original I don't have an original it's a
true it a true I do not have an original the city of Las Vegas will not release
it I do not have an original and neither listen to me and neither did your
forensic expert have an original now your forensic expert could have seen the
original but your forensic expert does not have the original no that's not what I'm referring to ma'am fine I'm
referring to you have a letter before you I understand what you told me that some clerk said that this is a copy of
the original I understand what you're saying to me you're not going to be able to change that that your forensic expert
did not have the original I have to make a judgment and
my judgment is based on several things I Believe Miss McNichol that you are a qualified expert in the field of
forensics I believe that you were quite honest with me when you said that you did not have the original and that
perhaps had you had the original your judgment would have been different without having the original you believe
the copy of the document that I have is uh Larry hin signature I disagree with
you I have to ask myself why someone who had so carefully planned for the death
of his entire family would have permitted a scenario where a stranger
could be buried next to him that's one thing the timing of this letter is also
very important Miss Donovan would have me believe that Mr Huffine would during a time of domestic Strife be so kind as
to do permit the defendant and her daughter to move into a situation where
a stranger is occupying the cemetery plots that he has bought and paid for
that doesn't make sense and if it doesn't make sense it's usually not true so I do not believe that he ever agreed
to this now I also find most bizarre a love card that is signed love Larry
hufflin but some people may be that strange and it is possible if that's strange I have to make a judgment based
upon what has a ring of truth to it what has a ring of truth to it is Miss
Donovan's daughter wanted to be close to her mother and close to the teenage
boyfriend and she persuaded her mother who knew she was on her way out of this relationship to forge this signature I
believe that that's what happened and since I'm the final Orbiter cuz that's where you've put this case your counter
claim Miss donov for damages due to defamation of character and slander are dismissed and
I am awarding Mr Huffine the $5,000 that he has requested which is the maximum possible allowance that this court can
grant him although I don't know how he can ever rectify the situation that has occurred with the cemetery plot I doubt
very much whether he can and for that I am s sincerely sorry that's all this case is over parties are excused you may
step out thank you your honor to be 7year old arborous Tom V is suing Carol zamit and Katherine Smith for the cost
of a Quadrunner Tom claims the defendant 16-year-old Sons stole the
[Music]
vehicle y this is case number 236 on the calendar in the matter of V versus zamit Smith who's bothering you that lady over
there raise your hand if you're bothering bird stop it okay thank you judge why has it been sworn in
your honor you may be seated gentlemen have seat stop it or step out there who's Miss zamit I am your honor and
you're Miss Smith yes which one is your son um Tony's my son this one right here
why don't you two lovely ladies sit down and let these two gentlemen come up here and see what I can do with for and to
them what is your first name Tony how old are you Tony 16
I'm 16 also but you have a name Andy the reason I ask these two young men to come up here is because their parents don't
really know what happened here because they weren't involved they just relay what their children tell them isn't that
right correct okay you purchased an allterrain vehicle yes honor was a used
one yes and you left it in your yard yes you came back after being gone for a
week or so and you found that it was gone correct somehow they came into possession of your ATV that's correct
and according to you they damaged it substantially so that it really can't be used and you want them to pay a
substantial amount of money their parents yes the parents say that the boys really did some creative
decorating of your ATV that's their answer that they painted it and made it nice but then somebody stole it from you
and those people that took it from you must be responsible for the damage is that what what I'm getting yes
you so here we go when did you purchase this ATV on May 16th this year cuz I got
a job in Lake Arrowhead and it calls for an allterrain vehicle and from whom did
you purchase it my father and how much did you pay him for it$ 12250 you don't have a bill of sale do you yes I do I'd
like to see it this is actually um a paper trail from the original owner okay
like to see it good I love when people come
prepared okay do you live in a house sir yes I live with my mom is that where you brought the ATV no I bought it at my
yard where I keep all my equipment at this place right here I am a grounds
Keeper at this uh Buddhist temple in exchange I keep my equipment there let me see it and this is the front entry of where
I drive in and it's posted private property no trespassing these boys are trespassing
okay so you left this ATV on the grounds of a Buddhist temple yes you work as a
grounds keeper I keep the grounds up in exchange I get to keep my equipment there I'm an arist I keep all my
equipment there okay fine good now you got it on the 16th yes and you put it there yes when did you go looking for it
again oh uh that week I got a um I didn't get this newspaper article just
just till recently but this is where I went I talked to the US Forestry Department San Bernardino California and
there's um over a million dead trees and I want to go down there and help them remove the trees this is not show and
tell I'm not saying this show this is why I bought the quad I I I put it down please I asked you a very simple
question Mr vile where did you go and when I went to San Bernardino Lake
Arrowhead and when did you go there um a week after I purchased the quad I parked
it up there with all my other equipment I left and when did you come back uh
another couple weeks later so about three weeks went by not three weeks no I
went for a week to see what's going on in Lake Arrowhead so I can assist him with my services I came back the quad
was gone let me tell you what you wrote sir in your complaint you say you purchased this 1986 Yamaha Quad on May
16th and you parked it on private property on May 18th then I went to Big
Bear to do some work on the 19th and returned home a few weeks later that's
what you wrote that's irrelevant this is private property don't tell me what's irrelevant I'll tell you what's relevant
I want you to try to answer my questions as best as you can the questions that I have not the things that are on your
agenda which are not relevant as to why you went to work on trees you purchased it on the 16th I want to know when you
left and when you left it on the grounds of the temple and when you returned I
returned about a week and a half later that's why I didn't have enough time to register when I got back I know you have
your own agenda as far as your testimonies what you're telling me is not relevant what's relevant is when you
left it there and when you came back and saw it missing that's what I wanted to know did you file a police report no I
didn't why not because it's a small community I drove around looked at garages just waiting for someone to
drive it in front of me and I have a lot of eyes around the neighborhood a lot of kids in the neighborhood they know I had
the quad they gave me a note on my truck that they seen these boys driving it and
that's when I responded date did you get the note on your truck I don't have the date well actually I do it's on the
police report cuz that same can I see the police report please I don't have the police report we have we cop police
report
you'll notice that it's a found property not stolen also yes you stole the
property let me explain something to you don't make any excuses to me you stole the property it was a when you take
property that doesn't belong to you that's stealing we didn't think it was uh like there was no chain on it there's
no lock let me explain something let me explain something I'm going to get to you in one second but I want to tell you something if you don't want to make this
a very sad day in your life you're not going to make excuses say you took property that didn't belong to you when
I grew up that was called stealing a car is not chained to its parking space
right and if somebody leaves a car in a parking space and just happens to go into a store and leaves the keys in the
car that doesn't mean it's abandoned that you can take it cuz it's not chained to the meter you understand each
other yeah we have good Judge Judy continues in a moment let us assume that instead of a quad all
of a sudden your boy shows up and in the Drone driveway is an automobile we didn't bring it just a minute this is my
scenario not yours they did not bring it back and put it pay
attention real cases real people Judge Judy Tom V says 16-year-olds Tony zamit
and Andrew Smith stole his Quadrunner the teens say the vehicle was abandoned
at a Buddhist temple okay so you told the police that you found it abandoned in a Hill area
behind the Buddhist Church on approximately May 23rd is that right yes Yan and you wrote it yes it had no
battery or the in the ignition was broken and it was we had to bump start it we had to roll it and then start it
and then we uh parked it about 100 yards away from uh where it was and then we came back the next day cuz the seat was
falling off and the wheel so we Ed the bolts and then we panned the Plastics cuz they were weathered cuz it was
originally red and it faded to pink and white and we went back to the next day and it was it was gone yeah we we like
we're making it kind of like a little project or like fixing it up if anything we made
it better we didn't like break anything on it you want to say something the
pictures that we have your honor show that what what it looks like behind because you could come down out of the hills where the kids ride their bikes
and you're right on to this dirty area so it doesn't look like it's a contained area doesn't have to be a contained area
madam let us assume that instead of a quad this was a
car okay okay and all of a sudden your boy shows up in the driveway is an
automobile and you say to him where'd you get that from he said well I was riding my bike up behind the Buddhist
temple and there was this car sitting there and it wasn't attached
to anything and the starter wasn't working and it was the color was fading
we looked around nobody was there so we jump started it and we brought it home because we want to make a project at of
fixing it up we didn't bring it just a minute this is my scenario not yours you didn't bring it home you hid it you
moved it from one location to another you're following my scenario they brought it back and put it in your driveway right correct no they did not
bring it back and put it in your driveway pay attention I said I am making up a
scenario for Miss zit right that the boys found the car in the same area
right here that the car was faded its seat was
Wiggly you had to use a screwdriver to start it but they brought it home
because the boys wanted to make a project out of fixing up this car are you getting me Miss zamit yes would the
first thing that you do call the police and say I want to know if this car is registered to anybody
yes right yes they didn't do that the boys actually have their own off-road vehicles I don't care what they have
they didn't do it if they had called to find out if this car was titled your
sons would have found out that there was a name attached to this ATV they chose
not to do that they chose to take the ATV and move it from one location to
another that's called Larsen the day you found this vehicle was that the day you told
your mother about it no we told no the answer is no when did you tell your
mother about it after he came to our house right when did you tell your
mother that you took it and moved it when he came to his house we got a phone call same time right where is this ATV
now it's uh in my neighbor's yard just trash it's in your neighbor's yard just
trashed okay I just a second just a second stop getting hysterical it's an ATV don't get hysterical it's not you're
well you know you don't have a life-threatening illness that's why not I'm just just a second put your hand down you have to accept responsibility
for what you do your sons just bought an ATV and they bought it for what he paid
for it which was $1,250 not for what he wants for it which is
$2,650 that's the cost of the repairs your honor listen to me buy another one they just bought this one for $12 $50
and they can fix it up to their heart's content do you understand yes good judgment for the plaintiff in the amount
of $1,250 that's all parties are excused you may step out I'm just aggravated that their
parents didn't take responsibility to correct them I think it was an honest mistake we didn't know that he owned it
they're not remorseful it's sickening I'll just leave other people's properties alone I don't think they got the message loud and clear the boys are
very clear now that if if something's in question don't touch don't touch and now the next case all is in a matter of
Robinson versus Hill step forward please legal secretary Carol Robinson is suing
her son autoshop district manager Joseph Hill for a series of unpaid loans Joseph
says the money was a gift Miss Robinson Mr Hill is your son yes ma'am and it is
your claim that while separated from his wife he accured a series of loans from
you to pay his bills other expenses including child support your son says that there was never an agreement ment
that the money that you did in fact Advance him to pay his bills was a loan that you agreed to help him out and that
you're only angry because he went back to his wife is that what you're saying sir yes ma'am okay how old are you 28
how many years have you been married uh a little over three years you have children yes ma'am one son what kind of
work do you do I'm a district manager for an auto auto mechanic shop and how long have you been doing that uh for
about 3 years now I want you to tell me about what happened after you and your
wife separated well when we separated we were both working we were both working so
there were a little uh more bills than my income could could pay for uh my mother was there to help me out just
second specifically I want you to tell me what you did you separated from your wife where did you go I stayed in the
family home my wife left and when did she leave what month what year may of this year where did she go she went to
her grandparents house with your child yes ma'am leaving you in the house now is this a redle house or is it's a
rental house yes ma'am and what's the rent $850 a month and how much were you earning at the time sir uh I earn about
$1,440 every two weeks is my gross income now tell me about this conversation that you had with your
mother when she started to help you she agreed that she would help me through tell me about the conversation I'll
decide whether she agreed to help you okay tell me about the conversation uh well it come to the point where we were
discussing the finances at my house she had told me that she would help me take care of my bills to bring my bills to
her bring her my paychecks every two weeks and she would pay my bills uh she did make a loan to me at one point in
time for an attorney which has already been settled and taken care of between me and her how much was that $2,500 is
that right that is correct and he paid you back not yet we have a settlement
agreement to pay that back settlement agreement from where uh that she wrote up and I signed that I would pay it back
over the course of the next however many months at $100 a month when did you do that uh roughly about 3 weeks ago do you
have a copy of that yes ma'am I'd like to see it [Applause]
please oh so she had sued you for this yes ma'am but your lawyer was only
$2500 yes ma'am is that right so why did you agree to pay her on $
4,425 there was uh past issues of finances where she had loaned me money to pay off a probation officer that I
also agree that I do owe her how much was the probation officer 1900 okay now
tell me about this other money that she says she laid out for you for other bills and it was it's clear you agree
Miss Robinson am I correct that he was turning over his paycheck to you yes ma'am and you were paying the bills yes
ma'am you were paying his rent yes ma'am you were paying child support yes ma'am how much child support believe there
were three payments that I made in the amount of 280 plus a $5 charge for the cashier's check and there were P you
bills that were his and and his wife's what about the 1440 he gave you bi-weekly what' you do with that it was
not 1440 his net pay is 1,237 every other week is that right
that's roughly okay so that's $2,000 a month that's plenty of money to pay his rent plenty of money to pay less two
payments of Child Support where's that money uh the cell phone bill was quite large every month well tell me what the
cell phone bill was uh there were three months that I paid $ 41915 just a second what was one cell
phone for $400 a month I'm a district manager I have 10 stores that I have to stay in touch with on a on a regular
basis throughout the day well then your company pays for that they reimburse a small portion then you take care of that
then you give that back to your mom we're playing legitimate expenses for which you do not get reimbursed do you
understand yes ma'am okay and when you took his paycheck and you took his paycheck since June yes ma'am is that
right did you tell him each month when he went over what he had given you yes ma'am I showed him the check register
and how low my funds my own personal funds were getting and he says don't worry Mom he says I'll pay it all back
he already owed you $4,400 Miss Robinson some of it he owed you for more than a year how could you legitimately believe
that your son was going to pay you back for all this stuff when he hadn't even paid you back money that he owed you for
a year and a half we how did you legitimately believe I'm asking your legitimate expectation that your son was
going to have more money to pay you back when he hadn't fulfilled what you claim
and in a settlement you say were obligations that existed almost two years come on let's be real when did you
stop giving your mother your salary check beginning to Mid July so that's June and half of July that's a month and
a half and it is your claim Madam I'm just curious It's your claim that in the month and a half you laid out for him
for which you were not reimbursed by his salary check $431
3350 is that right that is correct I don't believe you I don't believe you and I don't believe that you had a
legitimate expectation in that month and a half that he was going to be able to pay you back if in fact you laid that
out for him I don't believe that I believe that you said I'll help you out I'll pay your bills give me your salary
I'll try to act as your accountant and make sure that all of these bills are paid and in some organized fashion was
it your wife who was responsible for paying the bills in your house sir yes ma'am so you didn't know how to do that
not very good with money okay so you gave instead of giving your wife the money you gave your mother the money yes
ma'am is that what happened yes ma'am well you shouldn't have done it Miss Robinson he's your son that's what you're supposed to do your case is
dismissed that's all party are excused you may step out he's on Sherman versus
Holland step forward please football mom Beverly Sherman pursuing the director of her son's League Lester Hollands for
emotional damage because he banned her and her two sons from the club
order all rise quiet in the courtroom
please is number 91 on the calendar in the matter of Sherman versus Holland sir P have been swor in judge you may be
seated have a seat please those belong to your boys yes
ma'am Mrs Sherman I've read your complaint you are suing the defendant for
$55,000 for discrimination stress mental anguish
because he won't let your two sons play in his football league right is correct my my two sons and my daughter who's a
cheerleader and my niece well let's not talk about your niece I'm not interested in your niece let's not talk about your
daughter who's a cheerleader that's not part of your lawsuit let's talk about your two sons you believe that it is
actionable which means that you have a cause of action against this man for the things that I've just outlined because
he and I believe you run this Football League that's correct I founded it won't
let your boys play exactly why won't he let your boys play do you know well Mr Holland seemed to have a personal
Vendetta against me for uh uh an incident that happened earlier in before
the season actually uh got started um what was the incident well the incident happened where um I was the uniform
coordinator and uniform coordinator for the team for the organization okay okay
uh I coordinated the the the accessories and uh things for the uh the football players the um team moms
the team managers uh the coordinators and uh everyone involved so you were in
charge of uniform accessories exactly correct yes all right so what happened um the incident happened where uh I
ordered gold socks to accommodate the uh colors or whatever in the uniforms and
Mr Hollands wanted blue socks and uh the incident just got blown out of
proportion he you know just really you know never let me live it down and he's
just been real you order col socks that he didn't just a minute let me understand this you ordered a Col of a color socks that he didn't like he had
an argument about that a big argument and after that what happened after that
he everything I have done for the organization he has just you know looked down upon me he's uh criticized me he's
just nothing I can do for the organization is to his liking you know
everything you know I your boys had played in the league before in his League before this was the start of this
organization he I know but did they play for a season with his group yes this was
their first year and they did play yes so your complaint is that they weren't invited back for year two
exactly you want to say something to me uh yes uh that incident that she
described was only one of many incidents the incident that actually brought the last blow was at a meeting in February
28th of 97 uh we supposed to been just a general business meeting and Mrs Sherman
became unhappy with the agenda and stormed out so uh when the board met and
discussed the year of events from August from the incident with the socks there was an incident uh on uh I believe that
was uh Wednesday September third after a high school game she had verbal
confrontation with our cheer courp coordinator which she was kicking the lady's vehicle slamming her
door and this was done in front of uh several the High School faculty and it
was what was that incident about it was about a list of names that
she was demanding from our cheer coordinator that she did not feel that was produced in a timely manner I I
didn't demand anything and I'm sure if I was kicking and doing this to this lady's car in which it was a brand new
car I'm sure I'd be in court right now with her for so what you're saying is you I did not I did not do that to the
lady you didn't assault her car no I did not we had verbal words beginning to get
the gist of this so your board decided that they didn't want her to be the uniform coordinator anymore well just
not uniform coordinator just through her conduct and her actions throughout the entire course of the year um which uh I
have here um the uh flowchart for the organization uh even with the incident
that involved myself and Mrs Sherman uh over the socks uh yes it was the it was
really an ugly event and there were several other events as her acting as the uh uniform coordinator there were
numerous listen Mr Hollands you have a right to say if you
have a board I don't want this person involved all I asked you was did your
board decide that they didn't want Miss Sherman to be the uniform coordinator anymore and to not invite her back yes
and not invite her back in what capacity uh any involvement and it was basically
uh not wanting her to even return uh to the organization simply because of her
conduct okay now what did that have to do with her
boys well the boys were are are in her family it was wasn't that we were banishing the boys but it was just that
we prefer that she did not return with her family because of her contuct and uh it was brought to our attention
well do you think it's possible that she can come and just participate you know and support her children and we said
well yeah but it's a concern with the other parents other board members that her having nothing to do would just give
her more ample time to just be more of a disturbance well Mrs Sherman your
problem Madam is that you have to have a legally actionable
case Mr Holland is not legally obligated to accept any boy or girl on his
team I'm sure that a lot of people try out for the team that aren't accepted is that right that's
correct exactly but what he is doing is trying to keep my children from participating in his program because he
doesn't personally like me so in which but but but Mr Sherman that may sound unfair to your children but let us
assume the follow period in life it's unfair in life it's discrimination you know if if he auditions what do you do
you audition people for your tryy outs let's say he has tryouts for his football league and 50 kids come in tryy
out and he only accepts it's 33 per team 33 kids exactly you're going to have
17 right that's right 17 17 children who
are going to be disappointed if I permitted your lawsuit
madam that would mean that the families of those 17 kids who were not asked or
invited on to the team could have a cause of action for discrimination
mental stress on themselves mental stress on their children nobody would be involved with
coaching a team anymore nobody would be involved in starting a team this isn't the case this is not the cas of course
it's the case it's not they didn't even get an opportunity listen to me they
don't have to be given an opportunity they do according to the bylaws of King conference yeah this is this he he
doesn't own this organization this is a public organization just a second this isn't a public organization a public
organ just a second that's just like saying a black person couldn't go to a a
white Please Mr chairman don't bring black and white into this that's absolutely ridiculous how many how many
children in this league are black the almost enre so then stop talking discrimination has nothing to do with
discrimination Judge Judy continues in a moment he has a a ego problem a control
problem and he just does not take constructive criticism from a woman
well real cases real people Judge Judy football Junior League director
Lester Holland says he had to ban Beverly Sherman and her sons from the league because she was too much to deal
with it has to do Mr Sherman with the fact that he had an altercation with you
and according to him the board decided that they didn't want you to be involved anymore that's fine that's fine and they
would prefer for the sake of all the other children not to have you involved because according to him and I'll let him go on and tell me what the incidents
were that he says we had one incident where he says that you kicked the car had another incident where you had a
verbal altercation with him I mean I feel sorry for your boys but you have to understand that not every wrong is
legally actionable not every wrong results in
coming to a court sometimes if something like this happens you have to say to your boys
which you did according to your papers listen guys there is another football league and you have to be involved with
that one because I don't get along with Holland I don't get along with this whole organization there is another place for your boys to play football but
why do they need why do they have to be made to go somewhere else when they haven't caused they haven't done
I haven't listen to me sure you're not following me I said it's sad I said it's
unfortunate I said it's probably unfair to the boys that they can't
play all of those things I what I'm saying to you is it is not legally
actionable because if it was legally actionable for you that it would be legally actionable
courts would have to open their doors to the other 17 boys who tried out for that team and who for one reason or another
were rejected and it may have been unfair he may not have liked them because they were too tall Too Short too
fat too thin he needed a tall one this was a short one whatever reason he wanted this cheerleader because she was
prettier than that cheerleader he wanted this cheerleader because she was taller than that cheerleader if I allowed your
kind of lawsuit our courts would be flooded with this kind of case and we can't have that cuz not every wrong is
subject to a legal redress it's as simple as that it's sad
but of boys can play football they weren't discriminated against because of their race because of their ethnicity
because of anything else they were discriminated against if you can use
that term because he didn't want to look at you during the course of the Season
not a problem cuz I don't want to look at him either he didn't want to so that so you're you're saying that he can tell
he can make people come and go in this organization as he chooses that's absolutely right Judge Judy will
continue in a moment and later today tell them about that you was a prostitute and how you was a good
actress because you had to fake for your tricks you had to fake for your uh uh she only kills from rich people and
real cases real people Judge Judy football Junior League director
ctor Lester Holland says he had to ban Beverly Sherman and her sons from the league because she was too much to deal
with you don't seem to understand it's sad but every I'm going to say it one
more time every disappointment does not result in a lawsuit for stress right your boys have the
opportunity to play at another football league where not only they will be welcome but hopefully the two of you will be welcome welcome to participate
welcome to get involved I would suggest that you use your energies toward its more productive things rather than
negative things they are not they are not welcome because you madam are not
welcome and the fact that you are fighting here in court about this instead of moving on and getting your
boys involved in another football league where you your boys and your son will
all be welcome is a big mistake we've already done that good case is dismissed
that's all excuse they step out back the children suffer because of the
parents Behavior he behavior of the parents why you know
we just do not permit the Family itself parties on humph versus Steward step forward please company manager Ernestine
humph claims her niece 33-year-old Yolanda Stewart stole $1,000 of her
company's cash miss humph the defendant is your niece yes
ma'am and according to your complaint you are accusing your niece of stealing
$1,000 of business money yes sh I am well tell me why you think she took this
money and how I uh represent a company in Detroit and I um am responsible for
making the deposits weekly deposits on Tuesday May the 6th I was in my office I
had balanced the manager sheet counted the money and I had $7,200 on my desk my in cash yes in cash
cash already wrapped and counted what kind of business is this Coin Laundry a
coin laundry so they collect all the money and then they you make a deposit of cash exactly from okay so there was a
knock on the door and the employee was in the bathroom so I opened the door it was my niece she works down at the next
light and uh I thought she just saw my car and came by to say hi whatever uh
during the time that she was there I turned and walked away to use the
telephone and when I came back she suddenly was in a hurry to go and a
couple days later the uh corporate headquarters in Toledo informed me that my bag was missing a roll of tens 100
tens which is $1,000 and uh they didn't understand why this happened
they wanted to know if I had someone helping me count the money because all of the years that I worked for this company that has never ever happened
well how many people touch this money after you count it and prepare a deposit
I give it to the owner's son David and he takes it and gives it to his father
the owner of the company and he makes the deposit so at least two other people
touch that bag before it gets to a bank right but the owner has 26 stories he's
a multi-millionaire and his son is very wealthy I don't think they need $1,000
did you take this money no and second of all she did not walk away and use the phone she asked me to walk away and call
my sister to see what time my sister and her daughter were coming to Detroit we both walked to the phone which I did
that and my sister was not there we left a message on her machine and then I said well I have to go I was at work I seen
her car like I always do I stopped in and say hey how you doing we both talked the money was on the table and I talked
to her briefly and then I said said well I got to get back to the store I left nobody in charge I said I'm going down to Highland Park and then I'm going back
to my store she said oh thanks for coming and all that she walked me out to my car I don't know if she she came out
the second door and she watched me as I got in my car and she was talking to me and this right here is what I had on I
had no jacket I had no purse nowhere where I could have stuck $1,000 the day
before that she told me she needed some money I said well I you know I don't have any money she told me that the day
before and also the day before I helped her count this money she paid me $50 out
the money for helping her count it which it wasn't my first time helping her count the money at all and then after
that she said uh she came to me about a few days later she said I went to the meeting in too she was nervous she came
up to my job she said they said I'm missing a bundle or T and she said from the house I said well it couldn't have been missing from your house when I
stopped at your lat I said you were just now writing it on the sheet she said uh oh you right and then after that that's
when I heard it happened at the L which she never left me and which her office has a lock on it so why would she ever
say she could have just asked me to step out and let the door lock Judge Judy continues in a
moment let me tell you this you really do not have any proof
that Miss Stewart took this money no it's just circumstantial and you understand that
it's really unfair for any Court to convict someone and in effect I would be
convicting her of being a thief if I were to Grant you this, judgment that you're after
understand especially since there were other people who had their hands on that
money I just think it's so sad that you would had a lovely relationship according to your papers before this
happened and that you make this accusation without any real proof to
back it up uh that she was the only one in the office that day while the money was on the you need money I and you and
you needed money well I did not no don't I not any money
listen to me listen to me you may have needed money she may have she may have
needed money bottom line is in a court you have to deal with proof and there
were other people who touched that money after you counted it prepared a deposit
and gave it to the owner's son you don't know who the owner's son gave it to he may have let somebody else to his father
well but you don't know that hey I do I look like I need help okay I'll just
help you don't know that it may have gone from his hand to two three other
people before it ended up in the bank so I cannot award you the Judgment that you're requesting I just again find it
very sad that two people who had been very close to each other clearly are now not I think maybe
you should apologize to her for letting this thing go this far anyway this case is dismissed thank
you excuse step out ganian step forward please Tracy Kennedy a 28-year-old
manicurist claims her business neighbor ban gdanian scammed her into moving out of her premises so he could move in she
says she was promised $3,000 but never received it order all rise
[Music] yeah this is case number 107 on the
calendar in the matter of Kennedy versus gdanian parties have been sworn in judge you may be seated have a seat sir all
right well this is an interesting story Miss Kennedy you had a beauty salon that was um there prior to the defendant's
business moving right next door is that right um I was his business was actually
there but he just bought it um there was a the first owner there there when I
moved in but he was not there when you moved in right you have a beauty salon
he has a paging and cellular service business okay and according to your
complaint you were in the cellon for about 6 months when the defendant approached you
and said that he was interested in expanding his space right I was in there for a year and he had been in there
about 6 months when he approached me okay so after a year he approached you and said um he pulled me aside on the front
porch and said can we talk for a few minutes I said sure he said that he was
um wanted to know how long I intended on being in my space and how long was your
lease Miss Kennedy I didn't have a lease I was month to month but I did plan on being there for quite some time how much
was the rent on it $525 a month okay so the defendant approached
you according to your papers and said I'm interested in expanding my business would you like to move right and you
said what I said I had no intentions of leaving then he said I would be willing
to compensate you to leave move your business elsewhere and um I said you
know let me think about it for a little while and I'll get back to you but I really had no intentions at the time of
leaving I had only been there a year so so I said let me think about it
um two days later I came back to him and I said yeah I think I want to take up
your offer I think that in instead of moving someplace else I'm just going to you know go to work for someone else the
Market's really hard to find someone in my business right now and you know I
would love to just work for someone else for a while um and I said you know I need enough money to pay my
bills what bills the loans that I had on the salon um I had one from the bank and
I borrowed um a couple thousand dollars from my husband's um uh parents so how much did you ask him for
$3,000 was he agreed am out and did he agree to giving you $3,000 if you would
move yes so he was really buying you out of your space according to basically right and what happened according to
your papers right which I read very carefully was that eventually you were
told that when he went to negotiate his lease with the landlord he said to him I'll give you half of what she was
paying in rent right the landlord said absolutely not right he then came next
door to me and said the deal is not going to go through but by then I had already given my my girls notice and
found another place how many employees did you have I had two girls at the time
okay ultimately you did move into that space sir is that right that's correct you're on and you didn't give her the
$3,000 there was no agreement about $3,000 your honor well I'd like to hear your version of what happened okay I'll
be happy to uh actually uh she's right we uh I approached her we casually asked her what her plans are and I'm you know
told her about my intentions to move I need a larger place and at that point she says well I've been thinking of
moving my business is not doing well and I'll give you an answer I got to talk it over with my husband I'll give you an
answer and then a couple days later she approached me and said yes indeed I've talked it over and I've decided to move
and she asked me for compensation I said you know Tracy this is not you know the
right time to talk about anything at all I I don't even know just a sh Miss Kennedy I don't even know if I can reach
an agreement with the landlord so please let me talk to the landlord see if I can reach any agreement with him and then if
there is anything to talk about with you we'll talk about it that doesn't sound right to me sir no that's not what
happened there just a second that doesn't sound logical to me
sir so what you're telling me is the amount of
$3,000 that figure never came up in your discussion with her she threw that
number at me I'm not it did so it did come up in your
discussion and you asked her if she would like to relocate because you wanted to expand your business that's
not in the context that came up to your honor well you did in fact expand your business into her space that's correct
yes so this is what we have so far we have your discussion with her about your wanting to expand her throwing out a
figure which you ackn that she threw out a figure of
$3,000 your statement well it's not a good time to talk about it now I have to talk to the landlord
first now did you speak to the landlord yes and what was that conversation with
the landlord sir at that point uh I offered uh a total of close to not a
total I'm not interested in total I'm interested in what you are telling me
under oath that you offered landlord for
her store to rent I did not offer landlord a particular uh price for her space I offer offer for total for total
my we're going to get I understand I'm sorry how much were you paying for your
store alone sir uh $550 $551 for your store alone that's correct
and what did you offer the landlord for both places uh
$900 so in effect you offered the landlord substantially less than what
she was paying that's correct yes after she had given notice that she
was leaving that's correct yes so now you got the landlord by the
throat Judge Judy continues in a moment honestly I had no participation
in her movie oh no I'm going to give give him a copy of my book and later today he advertised our
show as Playboy Girls of Rock you know as Playboy and they going to see a bunch of beautiful women in bras and panties
real cases real people Judge Judy Tracy Kennedy says she moved out of
her manicurist Salon because ban gdanian promised her $3,000 she says he never paid her and
the whole deal was a scam the landlord has a tenant that's giv him
notice he's got somebody else ready to move in right away and you were're going to get a
bargain cuz you were going to get two stores for
900 was your store the same size as his bigger bigger so you were going to get her store
for 400 bucks you were paying 550 for yours so the landlord said to you at
that point forget it right your honor at that just
a second we understand each other this
gentleman someone I'm um we understand each other so don't
we so the landlord said to you forget it
at first then you moved out right you moved
out in June correct yes when did you move in July 1st and
what rent did you pay uh about 950 uh close to $1,000 you're a business man
don't no no not let's say $1,000 sir you're a businessman you know exactly what you pay for rent in this
business so let's not say about the 950 exactly what do you pay in rent I the
honor your honor the only reason I say about because the rent itself is the the
but there are some other triple Nets and what have you that figures in that I'm not quite sure that's what I'm saying about that's why I say about
$1,000 I I'm sorry
rent 9 the rent the to the the base rent is [Music]
$950 I rent $950 your honor so you still got the landlord for
a couple of bucks but he didn't give you the lease right away did you sign a lease with him yes I did you're honest I had a year lease with him and you signed
another lease for the second space that's correct your honor at a monthly rent of
$950 that's correct your honor so the landlord lost
that so where's her money there was no money agreed upon
your honor to begin with she did not have to move honestly I had no
participation in her moving out all I had with her was just a casual
conversation for her what are your plans and and she acted upon
that I going to give him a copy of my
book sir yes ma'am yes I come from an old business
family my grandfather was in the appliance business years and years ago and he's been long that I adored my
grandfather he liked to call himself a shrewd businessman some of the people that he
dealt with sort of dubbed him with another name so I'm aware of what you did this
has story has a common sense approach to it you wanted to expand this lady was under the
impression you were going to take over the same rent that she took over nobody would be HT she had evidently had enough
of being an entrepreneur rur enough of being in business by your she said if I can just get out with these loans I'll
go and work for somebody else and here comes the perfect opportunity for her to do that and it's a perfect opportunity
for you to double your more than double your space at a lot less
rent because once she gives notice the landlord is up a tree so the only one
that comes out ahead in this business is
that's smart but not fair to Miss Kennedy all right not difficult judgment in list
cases for the plaintive who I believe in the amount of $3,000 that's all than your honor AR I excuse you may step
out go to your right I'm sorry that the judge did not
see the a con artist in Disguise did she saw you exactly she she could have stayed there she could have absolutely
stayed there and forgotten about leaving she had no reason you're right she saw the con artist judge duty is the
greatest and now the next case parties on Russell versus heinold step forward
please 32-year-old Entertainer Karen Russell is suing booking agent Chuck
heinold for non-payment of a performance fee heinold says the ACT wasn't what was
promised M Russell according to your complaint you are an Entertainer and have a group of
entertainers uh that you work with you dance and sing you have a review kind of act right right according to your
complaint you performed uh in Bakersfield and you weren't paid that's
cor that right M the defendant is not the person who didn't pay you the
club according to these papers stop payment on the check this is true so why
are you suing him who is he and why are you suing him this is the booking agent Chuck hinel in my contract my contract
with the casino is with him representing me with who representing you Chuck heinold representing me let me see
contract go ahead and um when we were doing business
with Chuck he knew at that time the type of show that we were producing and my biggest complaint is
that if we were represented properly we probably wouldn't be in this situation just a second Miss Russell one of the
things I didn't understand understand from your complaint is he is your agent booking agent he is
your agent that's correct he didn't get paid know he didn't get the check from the club to
give to you so how could he give it because to you because it was stopped because he
was because he misrepresented us the casino was not happy with the show and
basically when I spoke to him the Friday evening we had technical problems due to the casino's um staging and Equipment he
told me don't worry no matter what you will be paid if it has to come out of my pocket you will be paid Judge Judy will
continue in a moment I'm telling you it's true you say no I say yes I win I'm
the judge cases real people Judge Judy 32-year-old Entertainer Karen
Russell is suing booking agent Chuck heinold for non-payment of a performance fee Hol says the ACT wasn't what was
promised I'm reading your complaint and I don't see anywhere in your complaint
that he said don't worry I'll pay you even if it has to come out of my pocket
wait he said don't worry I have the balance owed to you and I will come back on April 5th to pay you well of course I
understand what I understand that he said he had the balance he did in fact have a check correct he had a check from
the owner of the club the owner of the club subsequently stop payment on the check is that correct Mr heinold that's
right your honor I have the check right here I have a I'll take a look at the check that's not what you said Miss Russell what you said to me was he told
you that he would pay even if it has to come out of his pocket that's not true
well that's he never said that to us over the phone just a second he never said that cuz that's a very important
thing and if it was true that he said it it would have been in your complaint I have a witness that he did say it he
said it to myself and the partner on the phone conversation Friday night when I also found out that we were being
represented as former Playboy Playmates just a second I'll hear this witness if
somebody wants to testify under oath that this man said don't worry I'll pay you even if it has to come out of my
pocket who wants to testify to that are you let me ask you this question are you
sure you want to testify to that sir are you positive stand up here first tell me
your name my name is Juan Yano Mr Yano I want you to think very carefully
sir are you sure that you want to testify that you heard this man say the
following words I will pay you even if it has to come out of my pocket did you hear that
yes ma'am when when I talked to him directly the night before our last two
performances and you a member of this group yes this is my company did you ever say that to them no why would he
say that to you you're so full of baloney you people why in the world would your agent tell that to you when
he had a check in his hand from the people who you were working for because I confronted him confronted with what I
confronted him because I've been in this business for about 15 years and I know that people write bad checks I
understand that but you're suing the wrong person we're suing him misrepresentation what kind of
misrepresent present how former Playboy Playmates when we're not who did that flyer he just a minute just a second who
print did you print that flyer Mr h no ma'am I did not but the casino when I called the casino I said where did you
get this information don't tell me what the casino said to you that's your say okay when I was trying to find out where
this came from yeah the source went back to Chuck hinel they got that's mad
that's that's heay that's heay now you may have been a upset with that but that's not
misrepresentation youon by him he did not unless you can establish to me that
he actually printed those flyers and sent them out that's not misrepresentation your honor what he
advertised our show as Playboy Girls of Rock you know as Playboy as you're going to see a bunch of beautiful women in
bras and panties that's not our show at all we have a very classy show for us to come into the casino and see the um the
the out the no outside the casino is a huge sign in neon saying Playmates you
know let me ask you this question sir why didn't you leave if you were unhappy with the promotion you got we didn't
know about the promotion until after the second show the problem was nipping it in the bud is they were unhappy because
they wanted to see the bras and the the the women and we don't have a show like
that wasting my time Judge Judy is ready to rule step forward please makeup
artist CAD is heartbroken over the killing of her beloved cat and wants her nextdoor neighbors Toby and Mark Kaplan
to pay the veterinary bills she blames their German Shepherd for her cat's
death order all rise quiet in the court please all
rise judges number 21 on the calendar in the matter of gerain versus Kaplan pis been sworn and judge you may
be seated how long have you folks been neighbors um almost a year according to
your complaint Mr Man you were the owner of a cat the defendants own a dog what kind of dog do you have German
Shepherd and uh unfortunately you allege that uh their
dog injured and your cat subsequently died as a result of those injuries yes
and you are seeking the vet bills that you incurred now I why don't you tell me how that
happened um I was in my backyard watering and
um Toby came to my gate and called out my name and said Candace and I said yes
and she was very calm about it so I said go to the front door cuz my gate was locked so on my way to the front door I
stopped I got a glass of water I took my time because it didn't sound urgent I got to my front door I saw she was
holding my cat and I said I said I go my cat looks dead I go but sometimes they look that way then I noticed her tongue
was hanging out of her mouth and I said oh my God what happened and she said well we had just gotten home with our
family and I let my dog in your yard as I usually do to go to the bathroom true that is exactly what was
said and uh she said it took me no more than a few minutes to bring my baby
carrier in the house and then she said the dog came back with my cat in his in
his her mouth where where had your cat been the cat was um at the in my yard at
the very top of the back of the gate which is like behind my house but in your yard yeah in my
driveway so you took your cat and what did you do with the cat well she I took
the cat and I couldn't find my key so I insisted that she take me to a vet cuz I didn't even know where a vet was and how
long did you had the cat 10 years what kind of cat was it a himalay what color Blue Point your point
I know a little bit about C I'm blue
point I love their faces don't you I know they're a totally different kind of cat if you know like reg
cats um my son had seen the cat up in the driveway 5 minutes prior to her
coming to my fence with the cat okay so you took the cat to the vet and what happened when you took the cat
to the vet they such a severe trauma and that she would they did x-rays on her
and they said that they would just she needed to stay overnight for care that she wasn't well enough for me to take
her home but they didn't provide care there so I had to take her to um Studio City for overnight
care and they told me just go ahead pick up your cat at 8:00 a.m. she'll be you know ready to go back to the vet I
called them I called him right before I left my house and it seemed everything was okay when I got there they said that she's gone the other Direction um she'd
never make it back
so they let me bring her next door for surgy you want to take a minute want a
minute so I took her um or they transported her next door to the Studio City Animal
Hospital when they spoke with me and they did not say that you know she's not going to make it or anything they just
said that we can't you know say either way and I said to go ahead and what did
they want to do they said she needed to do surgery because she was her lungs she had um a leak in her lungs or air in her
lungs from the punctures so they did the surgery yeah then they send her back
over to the overnight and uh I kept checking on her one time I
check on her and they said she was stabilized and then I check on her again they said she wasn't doing well
and then at midnight they called me and they said you know she's now probably has like a 5% chance of living and she'd
already been through a lot so I just told let her
go and what were the veterinary bills that you incurred I have them on
here uh 1434 and that's not that's just from
Studio City annual Hospital the overnight care I paid cash that was a couple hundred
and then Sherman Oaks Veterinary the first place I took her to was a little over 300 you have those bills those are
all the bills that's the overnight all right here's this actually this is the total total gr and then
here's Sherman Oaks Veterinary Group thank
you I have 178 $6 does that sound right
um I don't know I didn't ask between these two bills yeah okay there's who's going to speak Mr Mrs Ka I am tell me
what happened on that day we were at home we had finished our dinner and then
we went out to get my daughter's booster seat out of my husband's car and we brought the dog out with us she comes
out with us often times and stays right near us or she'll go p and come back but she was not on a leash she was not on on
a leash so so she walked out with us we walked to the car which was about 10
steps from our front door open the door pulled out the booster Mark went around to the trunk of his car to open up the
trunk and looked on the sidewalk and our dog had her cat by the Scruff of the
neck walking gingerly towards us as if she had found something injured and brought it to us and I even reached out
and I pet the cat cat felt dry bone dry fine didn't even have any indication
then anything was wrong looked up at me and I thought well I don't know why she even brought it over she's never done
that and we we started to walk away the cat got up and started to walk towards the house and when she was walking I
thought she looked a little funny so I thought well let me check and see maybe this is the way the cat is or maybe
there's a problem so I picked up the cat and she still hadn't said anything we hadn't heard anything seen anything I
picked her up and I went to Candace's front door I knocked there was no answer I heard watering in the backyard so went
to the gate I yelled out about four times to Candice before she answered and I said I think there's something wrong
with your C but I'm not sure can you come to the front you know come let me in and she said the gates locked I'll go
in the front door I'll come out she came to the door uh after just a couple of
minutes and she looked at the cat she said oh my God what's wrong with the cat is the cat dead and I said I don't know
what's wrong with the cat Gabby brought her to us and and and I don't know what's wrong and and I tend to be a calm
person by nature so I wasn't melodramatic about it and and all of a sudden she said oh my God the her
tongue's out and then she cand started oh my God is she dead is she going and she just with the tears and screaming
and carrying on and she was very upset which I could understand being a pet owner you get upset if there's something
wrong with it so I took Candice to the vets with her cat and at that time the
the vet had said it could be it it appears to be a puncture she could have been hurt it could have been from an
animal you know bite whatever but but they didn't know so they took her back
to stabilize her and it wasn't until the next day or the day after she came over
with bills and handed them to Mark and Mark said you know what is this Judge Judy continues in a moment you know how
long it takes to hang somebody well it takes a while less than 2
minutes real cases real people Judge Judy CST your M play names her
neighbor's dog killed her cat and wants topi and Mark Kaplan to pay all the vet bills M Germain I have a few questions
for you I have to get the logistics was your cat within a confined area she was
just on the um no she wasn't she was just on the other side of the fence and
you do your two properties AB but each other yes our driveways between the two yards so that your cat was outside of an
enclosed area and your dog was yard outside of an enclosed area outside of
out of an enclosed area and when we saw her she was on the sidewalk in the front her dog went into my yard but you didn't
see that there are many dogs in our front yard all the time I say that my cat cuz she's an indoor cat and she had
accidentally G out never leaves that top of that driveway she does not walk around the front of the
yard cuz she's usually in the backyard you know we're talking about mrm we're really talk what we're really talking
about is there is a certain responsibility that you have when you let a pet whatever that pet is outside
without a leash or a cat outside without being confined to an area what I was
trying to ascertain was whether there was any proof that their
dog somehow got into your fenced property where this cat was no and there
is none so the next question is is did the dog actually do the damage to
this cat now I want you to describe to me how this German Shepherd came to you with this cat in his mouth well she was
she I'm sorry she was carrying the cat by the Scruff of the neck like a female dog would carry its pups and the cat was
just sitting there she wasn't trying to get away she wasn't doing anything she was just carrying she doesn't know there
was no sound there was no Skirmish there was no anything going on and the dog walked right up to Mark right up to him
like you know there there's something wrong here well you know sometimes I have seen dogs I don't know whether you
have come in with squirrels come in with all kinds of little creatures outside to sort of bring home a gift that's right
home to their owner look what I have for you and they use they're not bringing
that home to say listen this is an injured pet and I'm coming to you because I want you to fix it they're
coming to you and saying I have a trophy right to give you because I love you w
that's what they're saying I this would have been the first time she brought this trophy she's never she's never this
would be the first trophy that she'd ever brought home in the two years that we've had her she ever brought home just
hey no has she ever brought home a sick pet for you to help nothing so she has
never brought home a sick pet for you to help which is really what you want Su she never carries anything ever in her
mouth she won't even fetch a ball she won't do anything she did this time she did she did this time right and so
you your supposition that she was bringing you home a sick pet to show you
that she had brought home an injured animal is merely supposition I want to tell you right now that it strikes me
more likely that for whatever reason she was bringing home a trophy to her owners
and unfortunately the trophy well was period of time that it was there and and
the you know how long it takes to hang somebody well it takes a while less than 2 minutes Judge Judy is ready to rule
and later today I actually I feel sorry for her new boyfriend cuz she's probably going to ruin him like she has me
so real cases real people Judge Judy Toby and Mark Kaplan say they shouldn't
be held responsible for the death of Candace Germaine's cat that any dog in the neighborhood could have been respons
responsible not just their German Shepherd I'm not a German Shepherd
psychiatrist and I'm not a behavioral scientist so I can't tell you what German Shepherds usually
do all I can tell you is you have a dog that you've just told me never did anything like this before
right but did it now it carried a cat to me yes and so based upon the proof that I
have which is she had a live cat with no
problem and your dog brought her cat your big German Shepherd brought her
little Himalayan cat in the mouth the cat suffered trauma cat didn't
survive it appears to me that I am satisfied by the required Quantum of
proof in these proceedings which doesn't have to be proofed Beyond a reasonable doubt it has to be proofed by a what we
call a preponderance of the evidence you know more evidence than not your dog
caused these injuries so you're responsible for these bills I would also suggest to you that when you have a big dog and now you have a big dog that for
one reason or another brought you prey once that you see to it that that dog is
not with let out without a leash even for a minute unless it's in your enclosed property because you never can
tell a dog that is perfectly fine for years and years all of a sudden goes off like that so I am satisfied that the
injuries that are C were caused to her cat which resulted in the cat's death and the subsequent medical bills that
she is responsible for were a result of what your dog did and I'm awarding the
plaint of $1,786 thank you that's all I excuse you may step out I'm than to your right sure
thank you we wanted to keep peace in the neighborhood and not have problems and
it hasn't been since this incident in the the the rudess towards us from them
the cold shoulders that which is understandable though and then uh sprinklers shooting up over our cars
that are on our yard that AR haven't been fixed in loud music that vibrates our house and everything and so you know
they're they're just rude to Us's on Bonnet versus Roberts step forward
35-year-old engineer Ronald benett is suing his ex-wife sandre Roberts over a
check that bounced Mr Bonnet the defendant has been served in this action
and has not appeared so I'm prepared to enter a default judgment in your favor sir but before I do there are several
questions that I have yes ma'am according to your complaint the defendant who is your
ex-wife uh borrowed money from you well actually wasn't borrowed she asked for
the checks or she gave me checks because she needed the cash immediately and her why would first of all why would you
lend your ex-wife money in the first place well she was living with me after uh why
well she has a 2-year-old son who well actually 5 years old now he's two years old and I first met him he doesn't have
a biological father of record so I become he called me his father and I'm very attached to the little boy so I
went and um allowed her to come back and live with me for you little boy's sake because she come back from wherever
Missori I believe it was and uh until she found a place of her own a stay with
me how long did she stay with you oh it was uh about 3 months till about January
and then an incident occurred where she started having a lot of her male friends calling in the middle of the night and
she'd talk to them for hours uh she wasn't providing anything around the house she was like basically living with
as if I was you know a parent or something taking care of her and so I asked her to leave and then uh she got
violent one day on the car is picking her up from work she didn't have a vehicle at the time she took the mirror
off and started hitting me with it so I said you have to leave you have to go and it's not good for environment of
your son so she got an apartment and all well she started getting behind in her bills because she for whatever reason
and she basically wanted either come back to live with me or you know she needed help with her bills so for the
little boy's sake and I still have feelings for her I mean I know in my head that um you know it never work out between us I still care for her and I
adore the the child so do you visit with the child I was up until recently until
all this mess with the checks go and so I haven't seen them quite a while that's
too bad yes it is little boy and then I feel sorry for myself of course Judge
Judy continues in a moment how much did you give her that
she failed to okay what it was was uh at the time I didn't even have M but she needed $250 immediately for her rent in
cash so she wrote me a check out but I didn't have the cash in my account at the time and she needed that
that I finally agreed to give it to her so I went to National Check Cashers and they have a $37.50 charge so she wrote
me a check for the $ 250 plus the additional 3750 and then she told me about her car being in the shop and she
couldn't get her car out unless she had the money for it and it was additional 250 so we went to her car shop and I
wred 250 and she told me at that time she says well I get paid Saturday this like on Thursday she said the money will
be good by Monday so she wrote me in a second check for 250 which is what I wrote out to the C dealership and I have
all all this information here so so far I'm up to 537 50 right and so it comes the Monday
so I held up I didn't really need the money at that time so I held up to the MonDay go to the her bank and I ask him
I said you have the money in the account no we don't so then I try getting a hold of her she's avoids my calls and uh but
she still owes you the money she stopped pay according to your paper she stopped payment on these checks well why eventually then I deposited check I was
trying to do is prevent her from getting her uh bounce check charges and from me getting them so all told including sir
the fees for these checks being stopped came to
$62 right well that could included the mirror because one of the things I was asking for was that she reimbursed because then when I got upset with this
and she promised she would never hit me with the mirror and stuff again then she turned around and uh then she did this
with the check so I said well I'm going to go for a reimbursement of where you broke the mirror that doesn't count the medical payments of where she injured me
with the mirror how did she injure you with the mirror oh she when she broke it off it she started beating me with it
where oh about my well I put my hands up so I have about my wrist and uh and arms and stuff Mr Barnette you better put a
period to the end of this relationship oh it's already happened okay judgment in this case is for the plaintiff in the
amount of $62 the amount of his request thank you sir excuse step out and
on
