that time I was working at Target distribution in Woodberry Minnesota you still working there no ma'am who was 

your supervisor my supervisor there was uh I forgot her name because I I'm not 

working there anymore due to all this stuff that's going on now I'll wait you remember who your supervisor was in the 

phone number I don't have that with me right now we wait go get it excuse 

me how old are you 22 and you 17 where do you work um don't work right now what 

do you do I'm looking for employment what were you doing on December 10th 2010 I was at my cousin's house cousin's 

house where in St Paul Minnesota and where is this Walmart parking lot it's 

in bla Minnesota how far is that from St Paul like 50 minutes how did you get to

which was probably about a couple blocks from there and um once I got there I noticed they were still behind me so 

then I hurry up and park over there look at me so I hurry up and parked and once I parked they parked only about I say a 

few cars from me who was in the car it was Yvonne jela and Jalisa go ahead so 

anyhow I parked and they were still behind me and my mom is on the phone so I'm like okay they still here why are 

they here so she said just go into the Walmart and before I get out of my car I can hear them yelling oh I'm gonna f 

this be up if she don't get out the car we'll break the windows and get her out 

and um if she just act funnier say something F we're going to beat her up so miss crumb there is no question in 

your mind that the defendants were at the Walmart parking lot on December 10th 

correct that she was not at work at December 10th at 9:30 in the morning 

correct and these two were not in I don't know visiting a cousin for a 

couple of days they were with mother correct and I don't really have to get into what this family dispute was all 

about I don't want to know suffices to say I assume that at one time you were a 

close family and because of something you're not a close family anymore right and nobody knows how to just not be a 

close family without being destructive exactly or I don't care that's not my 

problem I don't want to put this family back together I don't care if you're not back together all I care about is your 

key car me too exactly did you go into the Walmart I did I actually ran and uh 

afraid of being assaulted by them three so I ran into Walmart and when you came out is when you noticed your car was key 

I noticed the damages on my car and you did not see any of them key your car no but I'm pretty sure they did it because 

they were say it's very easy to determine can I see pictures of your car please 

would you show me where it was keyed are you talking about this these Marks here I don't know it's very hard when you do 

these blowup pictures to see what you're talking

phone rather than blown up so that I can't see a thing

there is no proof other than your statement that they were in fact there you didn't see them do it but certainly 

she said she was at work they were in some other place so if they were lying to me about her being at work on that

the defendant who was then your boyfriend for some some reason which I'm sure you will explain you decided that 

you didn't want to prosecute this case criminally is that right yes when did this incident take place January 27th 

tell me what happened on January 27th defendant Albert Chen he discovered that I was going to display clothes at a 

Borum dance school and he became very jealous and uh he went with you he 

insisted he has to go while we were there he T me into a storage room he was 

screaming at me calling me names he also attempt to burn my clothes and burn my 

face using the lighter in the storage room yes he tried to injure me and burn my face you managed to get free 

according to your complaint from the storage room is that right yes there are people there and uh people knock on the 

door he left and when I tried to leave he was still behind my car and he got 

into the car with you yes so I gave him a ride home while I was driving he became um he blew angry at me he punched 

in the windshield and tried to break the window he also pulled the handbrake 

tried to stop the car and he yelled at me and tried to grab me out the car he said he want to die with me and there a 

policeman behind us and he they took him out of the Court you were actually taken into custody is that right sir uh no the 

police took me out because I have a open can of the beer and then they thought I was drunk but I where did they put you 

Mr Trum on the street they left you you just on the street on the street you left is that right I told the policeman 

I was first gear I do not want the defendant to be in my car again the police officers told me I could fire 

police report and uh did you do that yes I went to a local station fire police report that night that night and an 

emergency ring order was surrended to me that night and what happened when you got home when I stepped into the H my 

house it was close to 2:00 in the morning I heard defending abun leaving message on my recording he sounded 

angrily on the phone he threatened me to pick up the phone I did not pick up the phone 15 minutes later the door Bear 

Went I knew it was him so I did not answer and I tried to call 911 and 

defendant call in my phone at the same time so I could not die out he threatened me to uh give him $35 for the 

test fair for the cat Fair yes I refused but he threatened that he make a scene 

out of it and wake up my neighbors so I uh brought the money out and gave it to him he forced his way in once he's 

inside he grabbed on me and threw me on the ground he got on top of me he twisted my wrist he injured my spine and 

my f my joint and he attempt to rap Me by pulling down and ripping my pants and 

I bought my evidence of the ri and toorn pan I don't have to see them the elate was uh broken go ahead and I started 

screaming and he stopped for the rest of the night he uh abused me uh by threaten 

me to join the toilet cleaner he forced me to smell lighter gas he uh threatened 

me that if I reported the police he would kill me how did it come about that he left your 

apartment my mother call about 9:00 in the morning the first time he did not let me answer the phone I said if I 

don't answer my mother will call the police then he let me answer the phone my mother said she's was coming over so 

then defendant left and I called the police and make the second police report but I told the police officers that I do 

not want him to be arrest because I was too scared that this guy will retaliate let me see the police 

report this is the first police 

report this is the second 

one and in the bottom is St that I asked the officer to not uh arrest the 

defendant why because I was too terrified then why do you come to court 

now miss Fong because uh it's four months after and also putting in in jail 

is very intense that he will become very angry and retaliate I also have the 

photos of the uh policeman talk on me it was uh kicking on my face that was 

injured also on the damaged carpet on the damag uh closet door and the damaged 

portable closet and also the burned uh clothes policeman also took his lighter 

and burner cloth for evidence all right Mr Chong I have a couple of questions for you sir because I've read your 

answer now there is no question that you did in fact pull the emergency break is that right yeah I did pull the emergency 

break the hand breake yes um I want to mention why I need to pull the handbrake because I told her to stop the car 

because I feel we were arguing you her car and she drive pretty dangerous 

that's why I heard I read your story that's not a reason to pull a handbrake she hadn't been drinking that night you 

had you had an open can of beer is that right right okay so the police took you out of the car mhm and how long did you 

stand out on the street waiting for a taxi cab uh around like an hour and a half and you were very angry at that 

time yes I were angry then why did you go to her house that night because because there's no question that you 

went back to her house is that right right now you didn't live with her I did not

tried to get out of the car she wouldn't let you out of the car according to you you were so frightened of the way she

assault manessa says Albert terrorized her over the course of 24 hours how long 

did you stay there that evening on the all night did she ask you to leave oh she never asked me to leave that's a lot 

of balone sir that's baloney you because even if you were only arguing with her verbally she would have asked you to 

leave she didn't ask me to leave she let me sleep in her her living rooms at the 

four she told me because I legally blind I'm visually impair I cannot drive and 

it was laid around like 2:00 and this she let me sleep in her leaving room and 

next morning she woke me up and then she and I left but we were argue for a long 

time right right why do you believe that Miss Fong would have made two police report reports if you had not threatened 

her uh because when when the argument by the time uh my language was very strong 

and insulting her and she was angry and I just want to make sure you understand 

um I didn't do anything physically I don't believe that sir I believe that you did something physically T I believe 

that you did I believe that you went there that night and you were very very angry right and when you are very very 

angry based upon something that you did earlier that evening you for whatever 

reason wanted her to stop the car and you pull the emergency break up you 

could see good enough to pull up the emergency break I don't need to see I can it just like you can feel her face 

you pulled up the emergency break which means Mr Chung that you have a temper and what she did later on that evening 

which was according to you felt sorry for you and let you sleep on the floor 

of her apartment that doesn't sound like the kind of woman who would not let you 

out of a car if you wanted to get out of the car so you got a temper you've got a 

temper and I believe that you punched the windshield on the car didn't break it but I believe that you punched it mhm 

I did sure cuz you have a temper and that was before you were standing outside for an hour and a half in the 

cold at 1:00 in the morning that was before after you were really mad because she 

was ignoring you in the ballroom right mhm good you better stay away from her 

because you see this judge you may get some very nice judge if you go near her 

again you may get somebody who will be very sympathetic with the fact that you tell them that you can't see you're 

legally blind you're a poor soul all right you can't put your hands on 

anybody never in anger and get away with it and I'm just very sorry that she 

didn't follow through but I tell you something else if you ever go near her again ever it is very possible that 

you're going to get unlucky and get somebody just like me do you understand 

and if you get somebody just like me you're going to go to jail and they don't care what your handicaps are do 

you understand yes keep your hands to yourself and stay far away from her

out I tery uh the defendant was threatening me if I uh arrest him and 

put him in jail he would kill me and my family that didn't do it and if I did it 

after the police did the full investigation I already been in the jail and now the next case all parties in the

lawsuit is an attempt to keep her in his life Mr mcco it is your claim in this 

complaint that you were romantically involved with the defendant and made a series of loans to her including a car

and the rest of it why don't we just purchase a vehicle you'll have the first lean on on the vehicle so that I'm 

protected well the truth of the matter is you really are not terribly protected 

all you are if you have title to the cars you're exposed in case she has an accident in case she doesn't get 

insurance well she did that I know but that's a problem Miss Wilhelm first of 

all how old are you 32 how old are you sir 71 okay Miss Wilhelm this whatever 

kind of relationship you had with the plaintiff was of relatively short duration I read your answer very clearly 

and your answer says that he clearly wanted more from the relationship than you were prepared to give him absolutely 

absolutely can I see the title to the car please yes title certificate of title I'd like to see it please the copy 

of the title and I'd like to see the certificate of exhibit B and C showing 

the registration and the application I just want the title to the car he has the title this is a copy who has the 

original I have the original at home I just made a copy of it your honor well that wasn't very smart sir well I that 

wasn't very smart because I read the defendant's answer very clearly she says 

Bin's goal was to control me when I didn't respond to his advances he became increasingly hostile is that true that 

is correct not true event sh eventually I told him that he could have the car back because it's not worth the

part of your lawsuit is you made a series of loans to the defendant when did they start started after we had 

purchased the uh automobile she just needed money time after time and I just I felt like we were committed enough we' 

already committed that we would go to Texas once she got through her ordeal and that she would move with me take the 

kids she wanted out of Indiana so did I she's 40 years your Junior yes I know you're onor very foolish yes you're onor 

very foolish do you have a promisory note sir no you're her you gave her money for a 

lawyer yes how much money did you give her for a lawyer $500 that's not true you gave her money to pay her mortgage 

$500 did you ever get a note from her for any of those things no you're honor I I was too involved well you were too 

involved and that's what you get when you're too involved you don't get paid for that that's right that's stupidity 

no I said that myself to myself well if you said it to yourself unfortunately you got to listen to me say it to you 

again that's okay so this was a lesson that cost you 

perhaps a couple of thousand dollar Miss wihelm says that you never gave her any money I assume is that right that's 

correct never gave gave you any money no I don't know whether I believe you that he never gave you any money I sort

plaintiff was out a substantial amount of money I can't get you back all the money that you were out sir because I 

really feel as if you didn't have a contract with her with regard to these cash loans that you made to her cash 

gifts that you made to her but clearly it was your intention to have have a 

hold on the car which was the largest amount of money that you turned over to the plaintiff by having your name placed 

as a lean holder on the car that is some evidence of a debt that is why you got 

your car back do you understand yes ma'am rest of your claim is dismissed that's all parties are excused you may

morning in judge you may be seated Miss Grande you and the defendant uh live together for a period of time MH and you 

have a child together right and is your claim that when you separated Mr Matson 

kept some property that belonged to you and your daughter right when did you 

commence living with Mr Matson we were apart my whole pregnancy 3 days before 

my daughter was born she was born on this the 12th I moved back in with him the 12th of what the 12th of February 

was the day my daughter was born 3 days prior that is when I moved in 12th of February yeah okay so you moved back in 

a week before mhm and how long did that last it lasted 2 months and what 

happened well he was driving me to work I get in the car I noticed on the the 

dashboard of his car my child's sock we us always keep it in there cuz we thought it was cute to just have a 

little you know baby sock on the dashboard this particular day I found marijuana on the sock and I got very 

very angry and I said is this the kind of father you want to be and he had told me over five times since my daughter was 

born that he was no longer going to use drugs but that was not the case Okay so the fight was over that and what 

happened he got all mad at me told me I don't help out around the house I don't do anything he ended up calling the 

police asking them to watch and escort me out of the house I had less than 20 

minutes to pack my things and basically everything I was trying to gather up I 

couldn't even do I was holding my baby crying and begging please don't don't do this I had less than 20 minutes I left 

okay and then what happened I moved to a friend's house and I came back like 

probably two and a half three weeks later to retrieve my belongings and I noticed where was the baby during that 

time and the baby was with me okay and you came back to get your property had you make made an 

arrangement with him to get your property yes he said come and get your things and I came and then I noticed 

everything was gone all of the stuff that I had laid out he didn't pack he 

told me he would pack my property and my daughter's what property um clothes baby 

bottles um whose clothes my clothes and my daughter's clothes all everything all 

my grooming products I had to leave with not even my toothbrush because I had less than 20 I left with the clothes on 

my back I would always take my toothbrush if I had 20 minutes so you must have taken something 

in 20 minutes you no I left with my child's diaper bag and clothed for her 

and a stroller I didn't even have a car so you're talking about personal effects on your daughter's clothes mhm and mine 

well what clothes of yours I mean this is not a very easy thing to do you can't speculate as to what clothes there are 

you say clothes what clothes he stole my sexy clothes probably cuz he doesn't want me to have them I had this gown 

that was the $800 gown I no longer have that he stole CDs of mine and um my 

labor and delivery tape my ultrasound video things to me that are Priceless

the day of this incident who were you working for I worked for this promotional company 

called go ahead Mr Matson well on my first way I'd like to add on my first way out after I dropped her off she'd 

said said I hope you get in the car crash and die um but but was that over the marijuana cigarettes it was no it 

was about another fight okay but did she find the remnants of drugs in the car no 

she did not and I have a clean drug test here to prove everything okay what prompted you to take a drug test because 

she alleged that in our child custody case so the second she did that I went and took a I took a test did you take a 

hair follicle test or a urine test a urine and blood okay the issue over a Clos I'm sorry yeah is I I we we 

together put all of her clothes in this trailer that was on the side of my house and I give her permission to to retrieve 

them out of there um I have pictures of her clothes boxed I have her things 

hanging up in the trailer I have pictures of all of her things in boxes that she helped put in 

there and we and I helped her load them into a minivan when she came over to uh 

retrieve them did you take those things yes I did fine so you took the things that he had put in boxes now things that 

you're talking about here my baby's first Footprints the birth certificate Etc what's the ETC all of her clothes 

okay who purchased the clothes the clothes I was the number one person at who purchased my friends and myself 

where did you purchase the clothes from if you told me you weren't working this is during my pregnancy where were you 

working during your pregnancy I worked at um in Associates it's a promotional 

company your honor um she the day we I loaded her van for her I videotaped that 

and um she didn't inventory any of the boxes and she went directly to the police station from there just claiming 

that I had stolen everything and filed this report from there and also there was a nine dresser drawer that we had 

dedicated just to the baby things from that I kept two drawers worth of clothes 

and I also o have partial custody of the child and I need some clothes for the child absolutely you're absolutely right sir you should absolutely have some of 

the baby's things and to prove her character here's a ransom note for the child proving says number one I want 

$10,000 before we get back together type of person she is I had to file a 

restraining order because I'd given her $1,200 over the weekend to fix her car to get the baby around while we were not 

together and she was living with somebody else let me see Pap on Monday she called me to tell me she was taking 

the baby she' got in a fight with her next guy and she was going to take the baby to Nebraska so I filed the restraining order to keep the baby here 

in the states and I assume that that was granted that she is prohibited from removing the child from the jurisdiction 

without your consent what actually that's not what happened he kidnapped my 

child for me Judge Judy continues in a moment this person lives in a $500,000 

home is that the home you were living in with him mhm was it comfortable not really and later today 

the initial problem was created by you you personally not her real cases real people Judge 

Judy fra Grande claims the father of her child Mark Matson stole her baby's 

belongings and her clothes how can he kidnap his child well what happened was 

I told him if you don't help me find a home after you just left me I have no choice but to move moved to Nebraska 

with my family where they're going to support me he just kicked me out the week before of course I didn't trust him 

I asked him to watch my child for me while I went to a computer class and looked for an apartment when I came to 

pick her up that's when he petitioned for the restraining order and everything he had her for 4 days I have right here 

on his own from a letter from my attorneys stating that he returned my

this case is over the things that she's missing if you wanted to call the next guy who lives at the beach that she ran 

off with he has a garage full of things he's called me he and I have become friends since because she ousted herself 

from his house he and I have become friends since then and I'm supposed from the defendant's house did 

you move into M house yes I stayed one week he's requesting do you have anything at Miss house yeah I have baby 

furniture and I'm moving into my apartment tomorrow where did you get the baby furniture from I got it for $100 at 

a garage sale okay this is a list of receipts that he made a copy of of 

everything he purchased for our daughter mhm and the total money that he has spent on his daughter is 4 $18 when this 

person lives in a $500,000 home has three companies is that the home you were living in with him mhm was it 

comfortable not really he always he's living in a 500 just a second he's living in a $500,000 home Madam it must 

be either a very luxurious two room $500,000 home or else there was room for 

the baby's furniture that you bought that is it Mr house he would he refused to turn the 

office into a Nursery we had no he wouldn't make room for the baby's room

ma'am with the tennis racket but what happened to the dog after he was hit uh 

Jack ran over laid down and whimpered a little bit I ran over to Jack uh saw 

what had happened talked to the gentleman for a minute and what do you mean you talked to him for a minute I 

just I I said that it was unfortunate that it happened and uh asked him his name and that's about it and I left did 

you see the dog's mouth yes ma'am dog was injured yes it was so this lawsuit

right now your vet bills is what $1,921 originally I was asked to pay 900 

well it got worse I assume you have the bills I have all of them yes let me please stay right 

there they're all circled the 

totals now the initial problem was created by you because you without 

anyone asking you to took her dog I'd have to disagree who who asked you to 

take dog initial problems with her leaving the dog at my house no no you had other options if she left the dog at 

your house were you living there with your girlfriend at the time I was living there okay so you were living there with your girlfriend yes okay you weren't 

complaining that the dog was there because then you could have made a phone call and said get your dog out of my house you decided to take her dog out 

along I assum with the other dog that was there yeah so you made that decision unilaterally so between the two of you 

if the dog is injured let's say the dog is injured by you know a flying meteor not by somebody else's 

negligence you would be responsible because you placed the dog in a position of being in that particular place and 

time okay what if I wasn't there when the dog was left there I had no say in it it doesn't make any difference Mr O'Reilly your recourse is not to take 

the dog to the park your recourse is to pick up a phone and call her and say come get your dog I don't want it here

negligent if you're going to use a tennis racket to hit balls to a dog then you have to make sure that the field is 

clear so that you're not going to hit either another person or a dog that's 

your responsibility if you're using a tennis racket so that you cavalierly walk up to him and say yeah you know it 

happens okay apparently you've never been to a dog Park they run no I've been to a dog park sir I have had dogs all my 

life and I know exactly what it's like but if somebody used a tennis racket and 

in using a tennis racket wasn't careful enough so that my dog was injured I would say not only get his name but get 

his address and find out if he had homeowners insurance that may cover the problem if there were vet bills you 

treated this all very cavalierly bottom line somebody is out $1,921 

and if you had the name of the person and the address of the person for her to 

proceed against they already have it where did she get the name and address of the person as far as I know her sister tracked the person down and got 

the name and address and talked to the gentleman why didn't you I didn't simply because if I was in his shoes I wouldn't 

I would feel the same I wouldn't want to be held responsible I suggest that since you didn't bother to track down this 

gentleman initially that you track him down now because you have a lawsuit 

against him for $1,921 you personally not her you go get

payment um I traded in my car that I had they gave me $1,500 for it and then I put $200 cash so far is that correct 

yeah that's pretty much correct and then according to what you've written here your mother took back the car 

correct and you don't have the car anymore more no my sister's driving it you took back the car and gave it to 

your other daughter she thought that she could make the payments on it and you took back the car and gave it to your 

other daughter yes okay when did you do that and why Tasha was late with her 

first payment um she quit her job that she had two about 2 days after she'd got 

the car and she didn't show me that she was going to be able to make the payment 

she got ill she had to go in for emergency surgery and um she left the keys on the counter 

in the kitchen when she went to the hospital I took the keys and had them with me I went to work and I worked 10 

hours I'm gone 10 hours of the day she came when I was at work and took all of 

her belongings she lied to her grandmother cuz she wanted to borrow $25 there was a window broken out of the car 

already when I found this out when I got home and she' moved out I decided to 

hide the car over at my Brothers tyanne then said that she thought that my other daughter she thought that she could make 

the payments and together we made the first one it was about a month overdue before we could make the first payment 

after a month you took the car and you gave it to your other daughter is that right yes do you have the car now yes I 

do are you making the payments on the car I'm behind right now well how much 

behind are you a month and what about the insurance I don't have any 

I asked tyan to at the very least put a four cell sign in the window if she's not going to bring it back to me so that 

we could try to sell it you know because if I you're absolutely right but you can't take her car away without giving 

her her back or down payment do you understand if you took the car after a month she's out her 

$1,700 it didn't go exactly like that okay um Tasha I tried to communicate 

with her if she was going to be able to make the payment and our she started a new job and then she' gotten sick and I 

didn't know if she'd made any money she was working at the car lot that she actually bought the car from she did not communicate that with me at all that 

weekend she showed up at her work with her paycheck flaunting it she never came 

to me and said mom I've got the money or anything I was just protecting my interests in where is the car now you 

have it she's got are you living with your sister yeah mhm I know just a second oh this is very 

easy you have a job now um not right now no well how could you make the payments if you don't have a job um the reason I 

don't have a job is because I'm takeing there I'm going to Colorado at the end of this month and I'm going to be gone 

for two weeks so I can't really start a new job and then just leave so I was going to get a job once I came back well who's supposed to make the car payments 

my sister she's been making them and um how many car payments did you make all together two of them you made two and 

you've had the car since when the end of February and I made the rest I'm going to resolve this case very 

easily she doesn't have a job so she can't make the car payments right right well I can get the money that's not a 

problem to do it where are you going to get the money from as boyfriend no my 

boyfriend what I I was willing to make the car payment for her as a matter of and she made the car payment on my my 

other car so that I could use I had a car to drive I was making you're the boyfriend yes right you're the boyfriend 

fine so you have good credit um it it got bad in October that's an whole 

another issue okay I'm going to resolve this for your mother because your mother did a very very foolish thing yes 

because she co-signed for you the car is titled in your name the car is titled in her name the loan they would come after 

her clearly in the event that the car right no I I actually talked to them asked them if I could get off the loan 

and everything and I said now as far as coming after the payment they said they're going to come after me first 

yeah but you don't have any money so then they're going to come after your mother everything everything is in my name only I mean she is on it but papers 

that show that I sign doesn't make any difference let's say that you co-signed for the loan so they come after you and

47-year-old contractor Brian Graham is suing his ex-wife 47-year-old registered 

nurse Cheryl Graham for unpaid bills and the deposit on a car Cheryl is countersuing for pain and suffering and 

harassment Mr Graham you and the defendant were married for 12 years according to your complaint are you currently divorced or 

are you still married legally we are divorced okay and what year was your divorce it was Final about two months 

ago when did you separate uh september/october 1999 and you got an order for spousal 

support is that right yes ma'am and you say Mr Graham that you had an arrangement with your now former wife 

that she would be responsible for certain bills and when she did not pay those bills you deducted that because 

you paid the bills from the spousal support that is correct and then you 

went back to court and the judge told you that since it was an order for spousal support you could not deduct the 

amounts that you claimed because judges don't like it when anybody else fools around with their 

orders that would sum it up very well judge right so the judge told you that 

if you felt you had a claim against her you could sue her in civil court that is correct therefore you're here now you 

see what I managed to glean out of these five pages of papers that you wrote you are so good the only thing that was not 

clear to me Mr Graham is what specific items you are claiming you had an 

agreement over with your former wife so first let me ask a couple of basic 

questions what was the order for spousal support the order that I was to pay 

after paying for the car would be a cash payment of um 

$330 20 cents per month plus an amount for uh making up on a cash out for the 

house and that was honor about September of 1999 the order began as of March 1st 

of this year 2000 so there was no order prior to March 1st that is correct is that right according to the settlement 

it was February 12th when I moved out when he was to start paying support can I see that 

please did you both have attorneys yes yes we did don't know the magic words of keeping it simple husband shall pay to 

the wife ask him for spouse will support $625 a month commencing on the day that the wife moves out of the residence 

she's supposed to vacate the residence March 1st 2000 did you move out of the residence on March 1st 2000 I moved out 

on February 12th okay did you make payments of spousal 

support sir no I did not why we had a Dodge that was coming up to the end of 

its lease in December I knew that a car would be needed for transporting the children and and these were your 

children yes correct these were your children that he raised over the 12 years with you yes so I agreed that when 

that lease was up I would purchase the car and I said but I don't have the down 

payment that's when she agreed to pay $800 toward the down payment of that car and the auto insurance those would be 

deducted from the spousal support okay so you made a car payment of $800 and the auto insurance payments of how much 

$227 66 for that period of time your honor this is the written agreement that uh Cheryl gave me prior to that time uh 

saying that she would pay $800 plus the auto insurance out of the spousal support or settlement order we have 

more uh the next item is the utility bills now I moved out of the house in 

October of 1999 leaving Cheryl and the children staying in the house through 

the time we actually signed our final agreement our final settlement agreement uh Cheryl did pay all the bills uh it 

seems though that on the day we signed that agreement all payments of those bills stopped and that was early in 

January and then when she moved out uh I moved back in and I started getting 

bills that had not been paid bills that were delinquent they included the telephone bill the gas and electric 

water and sewer uh the cable bill had not been paid so that's that makes up a 

um total of $778 1226 did you pay those bills no and why 

he did not move out of the house and my daughter and a neighbor know that he was there daily he was there every morning 

to take my son to school he came and worked in the house he works for himself a lot of the tools are in the garage he 

was there daily working on projects for jobs he used the shower he used the 

house all he did was go spend the night with someone else he was sleeping elsewhere right and you did in fact Miss 

Graham pay the bills prior to January yes you paid the bills in November yes 

in October yes in December yes was he showering picking your son up from 

school using his Tools in October yes in November yes in December yes so you 

decided to stick it to him for January Judge Judy continues in a moment 

he was a wonderful father for 12 years someone does not just become an ogre but he has gone from we'll make this a civil 

divorce to I'm out for blood real cases real people Judge Judy 

Brian Graham says his ex-wife Cheryl Graham owes him for unpaid bills and a car deposit okay let's he you before in 

August before he told me that he wanted a divorce we had discussed how we were going to handle bills and saving money 

for future and that type of thing and I had agreed then to pay the bills and I continued paying it until it occurred to 

me that we didn't have a future and my contributing towards his future didn't make any sense no but you and your 

children were living in the house so was he no he wasn't living there he was doing the same thing that he was doing in September October November and 

December the fact that you decided to change the rules cuz that's what you said you had agreed with him that you 

would pay the utility bills while you were there that was before he asked for a divorce you had said to him I'll pay 

the utility bills while I'm here no I don't believe that's what I said but that's what you did can I make a comment 

here sure I got the order for him to pay me all the erres and he was to pay me 

out on May 16th he did not do that 3 days later he went and he filed this suit for just about the same amount 

several days after that he canceled my car insurance and when we did the settlement agreement I didn't go after 

half of the business that I could have because I was trying to keep it as a semi civil thing since there were kids 

involved and we'd known each other for 30 years Miss gr you clearly had an arrangement with him that you were going 

to take over and pay for the utility bills while you were there and you just decided in January because you were 

going be moving out in February the hell with him let him deal with that when he moves back in which is really what you 

said to yourself so you understand now that you cannot resort to self-help in 

modifying a Judicial order I'm sure that the judge made that abundantly clear to you there is no doubt in my mind your 

honor that was in inappropriate behavior okay so you can't do that I gather Mrs Graham that since you said you've known 

each other for 30 years you did have a marriage in between because you have two children it appears to me at least that 

Mr Graham has been been a reasonable and concerned stepparent to your children he was until August yes do your children 

have a relationship with their father he died he died before Brian and I got married so that what the children know 

is this person has their parental figure right and that's not how he is behaving 

well there are always bad feelings when there is a divorce I'm sure that there are hurt feelings on both sides you know 

doesn't sound like a total CAD to me I mean he did in fact say to you you keep the call car because you're going to 

need the car to get the kids you just said to me that he would come back to the house to drive your son to school he was maintaining an illusion that he was 

living at the house he had to come back to get his clothes he had no clothes there that doesn't require him taking your son to school like you said he 

treated him as a son for 12 years well that's a nice thing that's a good thing that says to me that he's not an ogre 

you're her daughter yes it's just very unfortunate that when a marriage breaks up there are such bad feelings you know 

I mean if he was a good person for 12 years he doesn't all all of a sudden become a monster just remember this there are always two sides to a 

story may I say something please sure I have requested from my mother 

that I be shown any documents in the way of letters or uh court papers that she 

has in which he has Brian has sent to her and you said yes he was a wonderful 

father for 12 years someone does not not just become an ogre but it has appeared 

to me that he has gone from we'll make this a civil divorce to I'm out for

the first thing is loving parents do not share with their children the particulars of a settlement agreement 

and I don't care whether you're 14 or 12 or 6 

it's an inappropriate thing to share with a child details of financial arrangements and 

right now you no longer even enjoy the legal relationship of stepf Father step parent with Mr Graham that's unfortunate 

what about your brother my brother at the moment is living with Brian at the 

house so your brother is living with plaintiff right how old is Brian will my brother is William how old is William 18 

what is William doing he's in fact he's graduating high school tomorrow I hope he is okay and you see your son 

regularly yes but you don't visit no I don't visit with Brian by my own choice 

okay well that's your choice that's unfortunate in any event I entering a judgment for $2,171 in favor of the plaintiff can I 

get you to order him to follow the settlement agreement where he was going to be keeping the car on the insurance 

and taking the insurance payments out of the spell support I don't understand Mrs Graham why you wouldn't want to have total control over your own money now if 

what you're saying is that instead of giving you the money he should deduct it and pay it himself that seems to me to 

be fool hearty put a period and end it well that's what I'm trying to do good

needed a credit you have a credit card I didn't want a credit card I didn't need 

one you had hers didn't have hers she had hers did you use hers I didn't use hers 

without her being there she was I didn't mean that you used it without her knowledge and permission did you use her 

credit card we used her credit cards did you ever use her credit card for things that were strictly for you yes like what 

um well we uh some car repairs okay and that was for your car 

right so you did need a credit card for your car repairs uh well at the situation I didn't really need a credit 

card I could have paid for it myself cash but it was offered the use of the credit card to pay for my car in 

Paris so chivalry being dead you accepted well that's a different type of 

I wouldn't say that I'd say that the money was supposed to be used towards a vacation that I was going to be going on 

with the plaintiff how much did you charge on her credit card for your car repair uh about $850 did you pay for 

that would be actually incorrect okay how much did he pay how much did he pay for the car repairs um how much did he 

charge on your credit card for the car repairs for the car repairs is about $1,400 and how much of that did you pay 

I'd say I paid probably all of it show me I can't show you I can show you what I did pay though I can show you what 

I've paid over the years basically the plain of had my checkbook she wrote checks for me um she just said okay well 

this is what we're paying this is what I'm paying um and I just continued to pay let me just see sir your checks for

right here and I have payments I mean he was accredited this is from uh October of '95 until July of 96 and there's in

matter of me charged on her cards like I want this I'm charging on the credit C and you're paying for it okay you ow you

this on the American Express bill that she breaks down for June does she break down what would be my charges and her charges mhm okay why wouldn't she want 

to do that throughout our relationship on the American Express always just a second why she did but maybe she did it 

in this month because you know you don't break up overnight things start going bad in the months before that couple 

years before that right well then you stayed in the relationship longer than you should have you know people have to 

be smart both men and women you don't co-mingle these assets and expect somebody else courts to waste their time 

going through a five-year relationship separating who bought Kleenex and who bought toilet paper and whether it was 

his toilet paper or your Kleenex that's just not going to happen Madam you look like an intelligent young woman you 

don't let somebody else use your credit card his word dating for four and a half years isn't being married I realize that 

why after four and a half years weren't you married huh exactly

1996 correct yes what I would like you to do is assuming that this was valid evidence which it is

that wasn't my $88,000 well but a good por at least a portion of it sir was yours portion of it here has your car 

repairs which were extensive and you were making minimum payments due on the account so then you break up and you 

decide well I don't have to make minimum payments anymore on the account I'm not going to make another payment on the account which is exactly what you did 

because there is nothing in your alleger to suggest that after you kissed each other goodbye you made one additional 

payment which is out really out I never knew how much money I paid all along now well that's your

there are a lot of other charges here that are substantial big ones you know did you go to um TOA Lodge and TOA 

California together yeah we did you went together and you charged that on the credit card $232 right she charged it I paid it you 

paid okay I would she would charge something I'd bring cash and I i' pay cash how who would you pay cash to I'd 

pay cash for everything else it wasn't matter of okay let's thr everything on the credit card I wasn't walking around Penn oh I just a second I understand you 

went to this Lodge and how long we at the lodge two nights yeah two nights two nights but truth is I see what you mean 

the lodge is paid for on here but you also had to eat you TI people I assume 

you didn't go skiing or what I have my own money I it's not like I went penniless no but if he was with you so I 

assume he paid no not necessarily you know something truth of the matter 

is I don't necessarily believe you either I think that uh you put some 

things on your credit card some things that are clearly his bills but according 

to this you did go on vacation certain things you put on the credit card but there if you look down the same dates 

there are no dates there like for restaurants going out to eat so that he probably paid some of some of the meals 

in cash and you put some of the stuff on your credit card and whether that balanced itself out 50/50 is anybody's 

guess you still had an $8,000 nut nobody is going to figure this out certainly I 

am not going to award you $4,000 because I do believe him when he says that he paid for certain things in cash 

otherwise you would have been a jerk to stay with him since he was earning four times as much as you were right yes good 

so I don't think you look like a jerk so I'm awarding you $2,000 consider yourself lucky that's all bu's I excuse you may step out

I was helping him out he uh he didn't have the money he didn't have the credit to get a credit card so I allowed him to 

use it I was making four times as much so how come I didn't have the money I don't know good question you just don't 

say on good faith that I'm going to pay you back and you don't do it that's just wrong but it's okay to take and take and 

take and then that's all right you have a twisted view of our relationship and now the next case all 

parties on Welton versus lunaria restaurant step forward please harmonica 

virtuoso Danny Welton is suing restaurant owner Bernard jacop for not paying for his performance Bernard 

claims the harmonica player's rude Behavior caused customers to leave Mr Welton yes ma'am you play the 

harmonica yes ma'am I do you do that for a living yes ma'am I do according to your complaint you had a contract with 

the defendant to play at his restaurant you we had verbal agreement because I am I 

speaking you had a contract with the defendant to play at his restaurant yes 

ma'am you played there yes ma'am he didn't pay you that's right that's what this case is about that's right he's got 

a defense and he says you didn't play and you cost the money so your agreement was an oral one how 

much you supposed to be paid initially uh my band was supposed to get $350 for 

the band I was supposed to get 85% of all covers and also I was supposed to be 

reimbursed for an that I took out The Hollywood Reporter mhm um I got n and 

also something very important and very dear to me he was supposed to feed my band and he gave them nothing nothing no 

that's not true even according to you he gave them something according to you he gave them stale Pizza yeah well stale 

Pizza that was nothing they ate it they they spit it

are not going to in this proceeding play with each each other yes ma' this was for a one night performance 

one night uh engagement and how many shows were you supposed to do in that one night uh two and did you do the 

first one yes ma'am and it was packed packed and then there was a problem 

according to you sir with the second performance so why don't you tell me about it there was a drunken lady in the 

audience who started to Heckle me mhm what did she say you know I'll be honest with you judge I do not recall exactly 

if I were to say exactly I would be wrong okay so you started shouting things that's right how long have you 

been a performer sir all my life since years old I assume you've had 

people do this sort of thing yes ma'am okay so what you know how to handle them so what' you do I start uh throwing 

lines back at her to keep her quiet hoping that we 

squelch uh the problem and her boyfriend got mad at me and 

threatened to charge the microphone and I said come on you know he was going to come up 

there I was uh you know I wasn't going to back off I've never taken a half a step 

backwards in my entire life so so what happened Bernard closed the show at that 

point Bernard you closed the show down when that's happening we were forced to 

you closed down the show is that right very smart 

exactly the right thing to do so what happened next well um actually there weren't that 

many people there because it's kind of an early uh type uh uh subber Club you 

get your big crowd the first show and sometimes I noticed that there's never even a second show the first two times I 

played there there wasn't even a second show oh you played there before twice before did he pay you uh yes the first 

time everything went well the second time he broke his a M with me he did not pay me the cover charges but you went 

back for a third time well I gave him another chance you know I'm kind of a sucker that way a sucker who never backs 

down that's right mhm kind of an all day not back down

for the second and third show we had to close the bar we lost bar revenue and we lost um show Revenue you um in addition 

to that his manager that is present had a tab for $80 here it is and he signed 

it saying he was going to pay the following day and never he come and pay it well that's not his problem he is not 

his manager's keeper was representing Mr won and um in leaving the in leaving the property we have witness here he 

assaulted our Metro we have the copy of the security and the police report here 

and it doesn't who the m i step up Sir what is your name Gerard Buck you have a complaint filed against 

this against this gentleman for assault I did file a complaint yes how did he assault you uh on the way out he elbowed 

me very hard and kicked me that is not true I I think we called security made a report and then filed complaint with the 

police made a report with the police department were you escorting him off forcefully no you no you can't go near 

him I mean you know he's out of control if I may your honor you are the manager 

yes I am your honor you drink a lot pardon you drink a lot no that wasn't just for me that was for other people in 

the audience well but you were buying that's correct your honor why didn't you pay the 

bill because he said he's not going to pay us and I said you can deduct it from 

what you owe us oh was that what you said that's exactly what I said to him oh so you told him to deduct the $80 from the amount of money 

from the $300 well we had there were 28 this see your honor if I may explain 

sure it's a small showroom with a large bar off to the right hand side of the 

performers in a large restaurant that opens up during the performances y just

When this incident occurred with this lady Heckler absolutely well didn't you 

tell Mr Welton that he behaved totally inappropriately no I don't believe he did behave inappropriately this man

he's not a comedian yes I am he's a har you are he's also a comedian he's a standup

little common sense if somebody is drunk in the audience then what you do is you 

try not to have that escalate into a dangerous situation dangerous either for 

you for the other patrons for members of the band and if a situation appears to

testosterone that I've heard about so much lately you walk off the stage and you 

approach the owner or the manager and you say there's this lady out there 

heckling me I just taken a quick break see what you can do about this lady because I can't continue to perform you

him no he invited himself up to the mic no you said come on up here well you

youron why don't you tell me why he came to live with you well my son and his wife ex-wife 

called my wife and I and told us that they couldn't control Richard anymore and that he was becoming a 

a street person he was on drugs and did not go into school and they decided to 

get rid of him they were going to throw him into uh Court uh I guess the uh ward 

of California till he was 18 they put him in a mental institution in belflower California and that's where we picked 

him up at and my son and daughter-in-law or ex-daughter-in-law promised us that they 

were going to help us to support Richard and we knew he had a history of drugs and when did did you have this 

conversation about support this was about first of June or so cuz we picked 

up Richard on the 12th of June right well tell me what the conversation was 

about support well that they would both give us $100 a month to help us take 

care of Richard I told my son that I couldn't afford to to solely pay it so 

that's uh that I needed his help to help me with Richard 

and he agreed and so did Brenda or uh Michelle as she's well known now and we 

went before a notary and we signed papers to that effect I cannot find my copies all my files are missing and I 

don't know why you mean copies of papers that say he would pay you $100 a month 

yes and you telling me that that was in writing yes is that true sir no it 

wasn't so what happened with Richard when he came to your home well uh we tried to get him into 

school cuz he'd been out of school for over I guess 6 months or 7 months he was flunk in seventh grade so I called the 

governor of Utah and asked them if they could help me to get Richard into some kind of a tutoring program and I guess 

through the him calling the school in our area and everything I finally got him a tutor to help him through the summer to get ready for the eighth grade 

how long did he live with you all together 11 months he had I had him up 

until December 25th what happened in December yeah we met his father and uh his father's uh new 

wife in uh Caesar's Palace I believe it was and we let Richard reacquaint with 

his father and we talk tried to talk to his father into taking him home with him for a week or two and he did and then 

about a week after he had him or 3 days or four days something like that called me back and said I'm deciding to keep 

Richard and how long did he keep him for uh well he called me back in uh it's 

either January February and told me he couldn't keep Richard in the house he kept running away he was starting to 

Dish school again if he was in school I don't think his father put him in school for at least a month or so and then uh 

uh about a month after that he called me again and said Richard was uh a runaway 

again he took off in his uh underwear or his pajamas I don't know which and his 

father was looking for him but it took him a week to find him and then he came back to live with you you know then he 

went to court and he was being charged for two burglaries and a few other things now my son didn't want him 

anymore so he had petitioned the court to make Richard a ward of the Court 

until he was 18 they called me and asked me if I could take Richard back to Utah to save 

him from being Award of State of California and you did I did and how 

long did you keep him at that point I had him until October I believe my son snuck up and told him and stole him from 

us what do you mean he snuck up and stole him he came up while my wife and I were 

at where she works and uh then I get a call from my daughter saying that Rick 

had just come up there with a sheriff and took Richard with him and then after that happened we 

found a lot of papers missing our files few other things so I don't know if they prepared this prior to him coming up or 

what okay sir um when Richard went to the um hospital his mother put him in 

there because Richard was living with his mother at the time Brenda uh Michelle she came and 

told me that she put him in the hospital and I said well ask Richard he wants to come to live with me he said no so 

Michelle said well how about if he can go with his grandfather well Fred said 

yeah I'll take him so Richard says well I'll go with him so he went with him 

because Brenda Michelle was going to put him into a placement home when did you change your name from Brenda to Michelle 

about four 5 years ago see when I was married to her she was Brenda so I'm 

used to Brenda you know calling her Brenda so my uh Fred took him to Utah 

with him and he asked me well Rick are you going to help me and I says well if I have some money I will send you some 

money he says okay so he went up to Utah and uh I was 

getting calls from Fred that he was in trouble uh sniffing gas and all this 

stuff we met in Las Vegas in December and my fa and Fred said um take Richard 

with you he I want him to get to know you again and all that I said okay so Richard was with me and he was getting 

in some trouble with the law and stuff like that so we went to court and the 

court was going to put him into a placement so Richard says well I'll go back to Grandpa's 

in Utah so I called him up and I asked him I said Fred Richard would like to come back to Utah and he says okay I'll 

take him back he came down and picked him up took him up there and he was having problems with 

Richard um Richard was sneaking cigarettes and uh he asked for the 

cigarettes back and Richard said no so he punched him out gave him a black eye 

and so I called up there and I asked how's everything with Richard and he says well 

I just punched him out cuz he wouldn't give me the cigarettes then he mouthed off and I hit him again I saids you know 

that's not right why are you doing that well I'm tired of this excuse my French I'm tired of it and I said well try to 

understand you know then I called up again then he's over medicating them 

with zoff 150 milligram a day and I said why 

are you doing that she says well I'm trying to keep him calmed down and I talked to my girlfriend my 

wife and I says well you know what let's go up to Utah and pick him up he's getting abused Judge Judy will continue 

in a moment stupid isn't written you sir they do not send you to NA meetings because you on soloff don't say dumb

California permitted your son instead of going to a juvenile facility to go to 

live with your father is that correct yes he was released to your father's custody not to yours is that right uh 

yes so you had no right to go and pick him up because he was in fact released 

to your father's custody right right see I didn't even read those papers and I know that bird 

knows that too CU we've been around the block SE didn't uh the court said he 

they allowed him to go up there isn't that a different phrase 

allowed let me tell you what they did in the state of California they saved themselves probably 100,000 bucks by not 

putting him in a facility here a taxpayer's expense they said we're going to make it Utah's problem we'll send 

them to Utah to live with his 

grandfather let me first discuss with you sir your counter suit I'd like to get that resolved first which is you're 

suing for mental anguish for your son you want $2,000 you don't get a 

penny nothing okay 

your 15-year-old problem you visited on your father and 

mother they had their own problems I assume you wen't a piece of cake to 

raise you have other children sir yes how many other children we have three others and they raised their 

children you were having a problem with your child so let me tell you what you did you were having a problem you and 

Brenda Michelle Sonia whatever her name is you were having a problem with your 

child you couldn't deal with it so you call your father help me I'll take 

him then you take him back while he's in your care goes out 

and he commits a couple of burglaries now the courts are going to take 

them the courts have evidently decided that you are not fit to take take care of him and your former wife Michelle 

Brenda Sonia is not prepared to take care of him so they call your 

father with your permission and he takes 

them how you can't control him neither could 

you so where you get this counter suit from you've been reading too many 

fiction books but let's get to your 

lawsuit how much money did you send to your father in The

you there comes a time when you have to stop visiting your problems on your parents you got a lot of other problems 

meanwhile the one major problem that you have was a 15-year-old child you asked your parents to take some responsibility 

for him and then you had some financial problems and in a whole year you sent them 100 bucks you know you can't feed a 

goldfish on 100 bucks he said something rather interesting sir 

in his answer which I'm sort of curious about did you apply for welfare for him when he was living with you yes I did 

and how much did you collect for welfare while he was living with you master you remember uh 

two me I think it was two payments of 250 that was towards the end of uh 96 

yeah I only got two up to they helped me out with two months two months and how much did you receed for those two months 

it was a total of 500 cuz it was 240 a month so it was quarter 480 yeah cuz 

Richard had a $1,200 hospital bill when he was sniffing gas okay but they paid that right that's how we had to go for

his report card you're doing better yes and he's going to na to get off 

because when he was with my father he was on that zolof for so long so the 

courts wanted him to go to na to to get off of it you know from the withdrawals 

and stuff off to zoff what stupid isn't written here sir they 

do not send you to NA meetings because you're on Soul off that's what the no no no no no no no no no no they send you to 

NA meeting sir if you're on illegal drugs not if you on drug prescription medication that you're taking they don't 

send you to NA meetings what you what do you I mean I'm not St all that so I'm just saying that when I brought him back 

from Utah we went to court and this is what the judge put him the judge may have put him there but not because he 

was taking Z off maybe because he was taking a little crack maybe because he was taking a little cocaine maybe because he was smoking a little dust for 

all those other things maybe he went to NA meetings does that sound right to you does that sound right to you I don't 

know about I don't know maybe it was with him because I brought him L hey hey hey hey hey when you sent him to your father the 

first time you sent him there because he was doing drugs right right mother and I 

Y mother what kind of drugs was you doing I don't know he was living with his mother well you should know you're 

his father because they went you should know you're his father he lived across the street from his son how can figure 

that sir you should know and they don't send someone to NA 

meetings because they're taking prescription drugs don't say dumb things especially 

to me but I'm pleased to see that you're doing better

rule seems to me that if it was recently that you spent some time with your grandfather and grandmother even though 

you may not think so now it may have been a good break for you because if it wasn't for them you would have been in 

juvenile hall right yes huh yes and that wouldn't have been a very good thing no

going to jail I went what I went you went to jail they saved you from

is located in Rono Beach and I went down there and she she described me her service and how she has years of 

experience psychology and sociology and how she's must have set up you know 

90% anyway wonderful and it wasn't going to cost you anything because the men pay 

well when she told me the service for women was free however you have to pay a fee of only $165 to have your 

photographs taken at her photography studio located in Hollywood and you don't have the option of going to your 

own service you have to go to hers you don't even have the option of bringing in your own photographs did you at any 

time ask then how she made a living I mean how did she make her money what she 

does is that she contacts all these men that she has in her catalog tells them about our profile and background if they 

like what they hear then they go down to her house review our photographs then they instruct her I want to meet this 

woman this woman that woman this woman and then she contacts the women and said this guy wants to meet you this guy 

wants to meet you this guy wants to meet you that sounds all very nice how do you make your living do you 

charge the men yes Shir depending on how long they join your honor they pay 

anywhere between 2,000 and 5,000 depending on how long they join your honor they pay anywhere between $2,000 

and $5,000 depending on the length of the membership depending on the amount of guaranteed introductions they receive 

the women pay absolutely no membership fee whatsoever per so let me figure this out 

so you went down and took your photographs correct and paid $165 

correct and nothing happened correct didn't get a call I got nothing from her 

every single month I called her and I go hey what's up what's going on anything yet and finally after the fourth or 

fifth month I finally got her on the phone because every time I called her I always got her machine and she said you

divorce according to the defendant he says that you were supposed to share the marital debts is that correct yes your

that you were both deficient in paying income tax for a year while you were 

married and they took your whole refund to satisfy that deficiency is that correct yes your 

honor and that was a joint debt yes so you say he should be responsible 

for at least half here onor um a statement came to me from the IRS stating that 11 almost $1,100 went to 

paying his Social Security his social security number not my number the only reason why I was responsible is because 

I was married to him at the time and we had filed jointly for 1994 taxes were you working in 1994 in the year that was 

fed you were not no I was not what kind of work was your husband been doing at that time he is an 

self-employed you have children together yes we do your honor how many children one how old is that child he just turned 

five so you were staying home with him when he was young yes I did so how much did they take all together they took 1, 

18930 can I see please the a judgment of divorce sure here you go 

what kind of business are you in sir uh I do graphic arts and 

printing now miss Bassler this judgment's divorce is clear

we borrowed money on the house and I agreed as long as her father was living there that I would share in the cost 

what do you mean you borrowed money on the house we the the house belonged originally to Michelle and her sister 

her sister basically wanted nothing to do with the loan that we needed when we moved to Las Vegas just a minute I was 

what you telling me you took out a home equity loan on the house uh yes well why don't you just say that that's something I understand very clearly you took out a 

home equity loan on her house on her house on her house on her property what' 

you all do with the money um we moved to Las Vegas together together how much 

money sir would you say you used of the home equity loan between the 

two of us all of it how much your honor I can't give you an exact give me an 

idea okay the the first loan was in the amount of 70 75,000 is correct over 40 

,000 of it went to purchase a home here in Peter's name I was not on that house I given him the money for the down 

payment we lived there and the rest of it was to pay off um Consumer Debt and 

to live because Peter didn't have a job from the time we moved to Las Vegas until shortly after we moved in October 

of 91 it wasn't until the end of January of '92 that he found employment is that right that's correct

child support from what apparently is an educated man like yourself in his own business right who's got money for a

Judy Michelle Bassler wants her ex-husband Peter cor to pay his share of 

their federal income taxes he wants her to stop harassing him the reason I find that interesting 

is because I read your answer sir and in your answer said you said that she didn't work that you supported the whole 

family that you worked and took care of everything she just stayed home for the most part I I I met the 

obligations I was the one earning the money to pay back the loan well how much did you pay back um we were paying 

probably around $1,000 a month but how much did you pay back we paid back at whatever the loan 

payments were until there was a balloon at the end of the loan that's what caused the refund 

how much did you pay on the loan was a 30 do and three at the end of 3 years I had a refinance Peter made one payment 

in before our divorce and the rest of the time my sister and I took care of it okay now what's all this other thousands 

of dollars for harassment Mr cor she has taken me to court for several things she 

has told the district attorney statements that were absolutely false 

and she has dragged me to court she's made me out to be a deadbeat dad I have paid every dime of my child support my 

child is my primary concern um my divorce decree says 18% of my income 

since my income fluctuates my child support payments fluctuated so she who 

did you have lawyers representing you in this divorce proceeding uh yes I did did 

you yes your honor don't you understand Madam that when somebody is self-employed you don't say I'm going to 

accept 18% of his income that brings you back and forth every single time a month 

comes due because you don't have a paycheck to look at and you have 

absolutely no way of checking and the only way she has to check sir is if she takes you to court so this is a very 

foolish thing to have in a support order 18% of your income very stupid your 

honor can I play a tape for you just a it's very critical in the um harassment charges just a second yes tell me what 

the tape is going to is going to say to me uh basically it goes with her Rambling On and On how I'm going to take 

you to District Court I'm going to take you to Family Court I'm going to keep you in court I'm going to make your life miserable so why don't you go into 

courts sir and say I want a fixed amount to pay every week we we already have that the the district attorney ordered 

me to pay 270 per month M period you know that issue is not finished he has 

to prove his income he supplied me with computer generated income taxes in family court and when we went for 

divorce I was not represented Peter went to court by listen to me listen to me I 

think that until you get the issue of support resolved there is going to be 

continued acrimony you cannot have a support order that says 18% of your income especially when you are 

self-employed so I would suggest as fast as you get as you can to get the matter 

of support resolved it has been no not according to her if it district attorney 

directs you to pay a certain amount of money sir that is not a court proceeding 

a district attorney is there as an interim advocate so he has suggested that until 

this matter is ultimately resolved you pay $270 but I'm telling you this sir if the judge after hearing this case 

determines that you in fact earn more than what you told the district attorney 

based upon several factors some of which I don't think I'm 

going to tell you now so that they might come as a surprise to 

you you must be prepared to pay more than 

the $270 a month because that doesn't probably represent 18% of your actual 

income we understand each other yes perfect Judge Judy is ready to rule

in her telling you she's going to take you to every Court in the United States including the Supreme Court of the United States $270 a month is an 

outrageous amount of child support from what apparently is an educated man like yourself in his own business right who's 

got money for a tape recorder so if she's annoyed that you 

went through clearly with her a lot of her money I could understand that shouldn't have

you may be seated sir have a seat all right the chronological posture of this case is as follows you sir are 

employed in a jail yes as a guard as a deputy yes ma'am and there came a time 

when you miss cameroni were an inmate in that jail having been convicted of some speeding violation is that correct yes 

it's correct you claim that while you were in the jail you was subjected to 

maltreatment by the plaintiff yes that's correct you complained to your husband 

is that you yes who sent faxes to the warden that's correct and as a result of 

those faxes you were further mistreated by the 

plaintiff then you served your time you got out of jail and you started to write on the internet about the plaintiff and 

about the things that you suffered from while you were in jail at his hands is that 

right yes that's correct and you're suing her for slandering you yes 

ma'am did you ever sue him no I did not you chose to take out whatever anger 

that you had by using the computer well I chose to tell my story through a 

website instead of suing civil okay how long have you been employed as 

a deputy in the jail sir um three years ma'am and what were you doing in the jail you were there for the speeding 

ticket for how long were you were you actually incarcerated I was incarcerated for three and a half months why that was 

pretty long time for speeding ticket well back in 1993 I had drove my 

Corvette at 145 mph up their freeway why would you do that 

you know it's I I realized it was wrong and I shouldn't have done it you know 

and it was a long time ago but and I know it was dangerous but the treatment 

that he put me through I'm not getting to the treatment so that's what you were there for yes now tell me about the first time you 

had a contact with him uh that was June 

6th of 1997 he was uh on night duty at the time and 

he was assigned to the tower in the walkthroughs and uh he would open and 

shut the door all night a loud metal door so I could not sleep and then when 

the sergeant came through at 8:00 a.m. and asked me while I was still sleeping I told him I couldn't sleep because of 

the loud door opening and shutting and the sergeant says I'll take care of it it won't happen again and that took care 

of that situation I started having problems again when I uh filed a habius 

with the court which was not welcome with many of the Jael staff what what kind of habius he I was being denied 

medication that my doctor had prescribed what kind of prescriptions were you supposed to be taking don't show me 

letters look at me stop playing with papers okay I was supposed to be taking uh pain 

medication and uh laox and uh what was that for it was for my depression I went 

through a court order psychiatric review and uh so you supposed to be taking 

medicine psychiatric psychiatric problems yes and then for my insomnia I was supposed to take something for that 

so you filed a habus corpus proceeding because you said that they refused to give you that medication right and were 

you ultimately given the medication after the hor habous Corpus proceedings yes what would that have to 

do with him well when I had come back from court to the jail he was the one who removed the handcuffs 

and the shackles and he was very rough and twisting my arms and he was telling me I hope it was worth it when he was 

removing the handcuffs so when was the next time you had a problem with him well after that I had constant problems 

with him tell me about and with another inmate well there was a particular inmate in there who and now are these 

things that you memorialized on your website on the internet I didn't go into detail on my website do you have what 

you complain about Sir in writing that she wrote on the internet yes man I have 

part of it yes can I see it please very the second paragraph on the 

first page is the beginning of 

it this is an accounting of life in jail and the Very unprofessional conduct of 

two deputies in particular another deputy and yourself okay towards her yes ma'am so 

so far this doesn't say anything I want to see particularly what she says about you so I can address each of those 

things would you have him put a star next to the things that he's actually complaining about so that 

I man that's that's that's kind of hard to say no I want to see sir you are 

alleging that she either libeled and or slandered you well that's what I need to 

explain ma ma'am it's it's not just what she said it's the context of my name is 

now associated with this website on the very first page of it and it it contains 

words rape Prejudice show me where that's alleged that you were any part of that sir by read by reading it ma'am the 

the nor a normal person reading that we'll see we'll get my name Conta Twisted into that and see this 

just a second she doesn't allege anywhere in here that you raped her correct no ma'am she doesn't allege 

anywhere in here that you beat her correct no ma'am it says gives her a 

gives a whole Litany of her experiences in the jail which may have included those things but with regard to you all 

it says is the fact is that Deputy Birmingham acted in an unprofessional 

manner on numerous occasions while she was in custody is that what you're saying yes ma'am 

that's what you're complaining about why is my name on the Internet this isn't a this isn't anything to do with free 

speech this isn't anything to do with with her trying to uh raise funds to go to Supreme Court or anything like that 

this is just her ill will to try to get revenge and my name doesn't belong on the first page of her 

website well you were employed at the jail when she was there right yes ma'am 

do you remember her when she was inmate oh yes ma'am tell me what you remember about her I remember um basically she 

she'd complained about everything she accused everybody of doing something wrong um she was just uh not your model 

inmate mhm and how did you and how did you react to that sir I didn't care I 

was just doing my job doing my eight hours and going home Judge Judy continues in a moment they' say things 

to me like I could make it worth for you here she could snap your little ass 

right in half real cases real people Judge 

Judy Sheriff's deputy Eric Birmingham says former inmate Judy ceron slandered 

him Judy says he mistreated her in jail Mr Birmingham you've been employed 

according to you for 3 years yes ma'am how many disciplinary proceedings have ever been filed against 

you none ma'am are you still employed there yes ma'am you want to tell 

me Madam what other the things you are specifically complaining about that he did to you tell me okay there was 

another inmate there who was the she was the lover of the jail Cook's 

daughter and she was in there for no the lover of the inmates the lover of 

the jail Cook's daughter go do this one more time she 

was the lover of the jail Cook's daughter okay okay and she was a very 

tough woman she had been incarcerated for beating up two of their sheriffs so 

she was very tough and very large and she gave me a very difficult time there 

many times she would back me into the wall and threaten to beat me up and guards would come run running to stop 

her every time she would do something bad to me and it came down to discipline 

she was not disciplined and Deputy Birmingham chose not to discipline her and many of the 

times when we had conflicts or she instigated it he would choose not to 

discipline her and it just made matters worse and I felt it was very unprofessional for him to do this what's 

next just caused her to be more bold what's next well my husband sent a fax 

to Sheriff which he had intercepted Mr Birmingham intercepted he came up to my 

cell dumped out my coffee which I had to purchase through commissary and he said he was sick and 

tired of me he had the fact in his hand and he says you better call your husband and tell him not to send any more faxes 

does that sound familiar to you no ma'am that's doesn't sound familiar to 

you no ma'am Mr Birmingham are you trying to tell me 

that a fax of complaint was never received by you indicating that you 

failed to take steps to protect this then inmate no ma'am you never saw that 

no ma'am he came into your cell with the 

facts yes he did and he dumped out my coffee and I felt that his unprofessional conduct was putting my 

safety in Jeopardy you know and he'd say things to me like I could make it worse 

for you here she could snap your little ass right in half and things like this 

when did he say that to you when he had the fax and dumped the coffee out mhm 

okay you still taking medication yes I am still the anti-depressant medication 

yes were you on that medication before you were incarcerated yes I was is this 

the first time you were incarcerated yes it was my first and only offense and I haven't committed crimes since this was 

your first and only arrest yes uhhuh did you know that frankly Ma I didn't care 

sure you did well let me tell you why I have no I have no business let me tell you why officer Birmingham here you 

dealing with a woman married woman have children 

baby and did something really dumb four years before by the time it got through 

the process only arrest he she's given over 3 months to serve in jail 

pretty frightening Prospect wouldn't you say can I add some clarification that sure okay first of all she spent um 

approximately and I'm not sure the number 20 days back in 91 or whenever 

she was first arrested um she was committed after a trial and then got out 

on appeal Bond so she had spent 20 to 30 days there already so you knew a little 

bit about her history of mhm I now I do now I do yes ma'am oh sir are you 

telling me at the time that you that you folks were having according to you lots of difficulty with her with her husband 

faxing and everything else that you didn't open up the file and take a look at it are you try I I knew what she was 

there for yes ma'am here was an inmate who was given lots of problems who was not prepared to accept the regular drill 

of being in jail right yes ma'am right and that presented 

a certain amount of irritation for the for all the people in jail now 

how many guards are there in jail it depends on the shift in the day give me some idea of how many people she would 

have come in contact with between all the shifts um four to five a shift to a small jail four to five a shift and 

three shifts a day yes ma'am so 20 people give her say she doesn't complain about all 

20 right yes ma'am she only complains about really two right 

mhm why do you think that is I don't know ma'am if she had such a problem with me then why didn't she F complain 

with my department you're she did she complained through him she complained sent a facts I believe her when she say 

you w when she says that she walked into her jail cell with the facts irritated as hell I believe her she doesn't accuse 

you of any criminal Behavior she says that you were guilty of unprofessional 

behavior that's a subjective term Judge Judy continues in a 

moment I could pick up the phone it's only 2:00 and save my little baby 600 m round 

trip and that she wouldn't see

former inmate Judy ceron has damaged his reputation on the internet she says he 

mistreated her certainly what she's saying is you failed to protect her from 

another inmate who was dangerous and that what you were really 

telling her was listen babe you better just do your time quietly stop complaining stop making a pest out of 

yourself CU if you do there are things that we could do to make your life unpleasant is that what you're 

complaining about yes and he also what he did was the worst thing that he did was 

he did a walk through and he told me when I was watching the news sitting on a bunk stand up don't sit on the bunk I 

sat on the ground he says don't sit on the ground remain standing so I remain standing and then he continued the walk 

through upstairs and left and I had laughed at a a sexual remark that another inmate had made towards him 

which is not allowed but he did not discipline her for it because he welcomes these kind of remarks and I had 

laughed I've got dizzy I sat down and I got back up and I knew I shouldn't have sat down on the bunk so when he 

came back around the front door I was standing right by the phone and he says I'm putting you in lockdown and tomorrow 

you cannot see your baby so I told him look I'm standing right by the phone I 

could pick up the phone it's only 2:00 and save my little baby the 600m 

round trip and that she wouldn't see me he says I don't care and I says well then 

you can have some someone else call my husband not to make the trip he would not do that but you see here's a 

disciplinary action he wrote up and then he also took away my visiting privileges for two weeks and that's all I had left 

and why did you take away a visiting privileges I did not take the physi in away what did you do it's a dis review 

board what did you write her up for if I remember the incident we had an extra uh 

bunk out in the day room area and the rules they don't use anything that's 

it's not intended for okay and she was sitting on the bunk watching TV and like I told other people or whatever and told 

her to sit down over on the tables but I have no extent I have no say on whether 

she loses visits or not that's dis my question what this incident that you were talking about that you wrote that 

you wrote her up for I believe so yes ma' you wrote her up for was because she was sitting on a spare bunk rather than 

sitting on the table is that right yes ma'am okay is designed to have rules and 

to have structure and that's now did you know offic of Birmingham that she was supposed to have her visiting with her 

baby on the next day no ma' does that sound familiar to you no ma'am don't have the only time they can make the 

only time they can make visits visits appointments for visits is on the day of the visit so I would have no say or no 

uh knowledge of are you telling me sir that she did not say to you if you if 

you're going to take away my visits let me call my husband tell him not to make this 600 mile trip she that doesn't 

sound familiar to you no ma'am I don't know you don't know you don't know if it sounds familiar is that what you're saying I I don't remember hearing that 

no Judge Judy continues in a 

moment look I'm going to resolve this matter very quickly officer Birmingham you are in 

fact suing her you are suing her for slander for saying terrible things about you on the internet on the website I 

don't find that she said anything that was terrible about you she said that you engaged in unprofessional conduct 

towards her while she was an inmate in the jail if I have to make a determination today whether or not any 

of that is true I would have to say yes I believe that you behaved in an unprofessional manner towards the 

defendant who was an inmate in your jail and therefore your lawsuit would be dismissed because truth is an absolute 

defense I believe her sir when she says that 

you took her handcuffs off in a rough fashion that you came into her room with a fax in your hand spilled her coffee 

and said listen don't do this again cuz I can make in effect can make your life 

unpleasant here and I do believe that you wrote her up for sitting on a bed rather than sitting on a table which 

caused her to lose her visitation privileges with her child and when asked whether you would please just call her 

husband not to make the trip because the trip would be for not she was blown off that to me sir is unprofessional 

behavior so your lawsuit's dismissed that's all thank I excuse you may step 

out thanks man Judge Judy continues in a moment right and on the next Judge Judy 

so first would you mind telling me why you gave him $3,000 I gave him the 

$3,000 to um go it wasn't $3,000 it want 

to get to you that's correct actually I loaned the defendant 

$2,500 um for him to purchase a 1995 Honda Civic um Upon returning it to me 

he agreed to pay an additional $500 um so in a sense it would be $3,000 

that he returned to me what was the $500 for um it would have been to apply 

toward um was into your owner yes that's correct it was interest 

that's a lot of interest over how long a period was he supposed to pay you back it was going to be over a 3- week period 

$500 interest for 3 week are you a lone shark no no ma'am um he was planning to 

fix the car and then sell it and um just a second would you do me a favor 

you're irritating me it's not a good idea to start off by irritating the person who's supposed to decide your case mhm 

all right let me cut to the Chase from what I gather from what you started to tell me before you were rudely interrupted the $500 is because he was 

going to buy this truck fix it up sell it for a profit you wanted a piece of the profit that's a part of it um he 

actually had a truck before that he was um going to sell and he was going to 

give me the the proceeds from the the truck that he was selling well it's all getting very complicated all I all I 

want to know is as follows okay did you in fact take take out 

$2500 and give it to him yes I did why because he was having some financial 

difficulties and was he a friend of yours yes was he a boyfriend of 

yours yes was he your only boyfriend yes now you did in fact sir 

borrow this money from her yes I did your honor why did you borrow money from the lady she sort of offered to sort of 

make uh alleviate my problems by having to go to a bank and uh you know pull out 

the money and from a savings account to a checkin account and what I done was like uh I just she said that you can 

just borrow the money because we banked at the same bank and she could I could pay her in due time cuz I need to buy 

some parts so what you're telling me is it was too much trouble for you to take the money out of your savings account 

right and put it in your checking account I had to take a day off from work that's why I was your 

honor getting better all the time all right so you borrowed money from your girlfriend she she actually I you just 

say yes or no so you borrowed money from your girlfriend yes I did all right now she says you didn't pay her 

back right yes did you ask him for the money back 

many times ma'am after what period of time did you two break up it was about 

the time that I started asking for the money back how long after the Lo 

um about 2 months after you were supposed to pay her the money back in 3 

weeks right right but you didn't pay back in 3 weeks I have what 

you call record showing that uh on the day that I sold my truck she got her money well show me that I'm really 

interested in that and this case can be over very quickly 

this doesn't say she got her money she had a pigstick collateral your honor for what do you call it for the money that I 

borrowed okay what collateral are you talking about just one second this is for a 1990 Nissan right and this is the 

truck that you're talking about so what you're saying to me is as collateral for the loan that she made to you $2500 loan 

right you gave her the pink slip for this truck right ma'am and what you're saying to me is you sold this truck to 

this man right and you couldn't have sold it without the pink slip right so she had to give you the pink slip back 

right they all all just a second all the parties were there that Sunday when the guy came to 

pick up the truck were you ever there on a Sunday no I was not there on Sunday I don't know what man he is Mr Sagan is 

referring to she didn't get a chance to meet him he was outside and what happened was like she was inside the 

house I had to get the what do you call the paperwork in order for me to what you call do the transaction so I can get 

the money so that's when you know he wanted to get a his pink slip so he can render the money to me so I I I took the 

pink slip outside and I just came right back inside the house gave her the money that was did you have the pink slip for his truck I never received any pink slip 

nope oh my God okay did this man ever see the 

plaintiff were they ever in the same place at the same time they only the only thing was there was just between 

here and there she was in my room and the gentleman was outside he wasn't like Superman he couldn't see through the

came to look at this room that you didn't rent well no I never got the opportunity to rent it I was living with 

a boyfriend then I came back to Mr saa's residence and he as as a friend he 

allowed me to stay there in the living room until the apartment in the back became available and then I moved in the 

in the back apartment now what's all this about people coming in and out of your apartment I was in a 7-month 

relationship it wasn't different men nothing of that sort but it was a problem relationship it was and police 

came to your house yes because he was at my window and he also attacked me in the front yard they were at on Mr saa's 

Residence at his property twice so he got nervous about that how old are you sir I'm 77 I lived there 42 years I 

didn't call the cops but what one time she had the cops over there three times 

yeah she said she did she didn't have a nice boyfriend he he got in jail he's out you know what he's talking about the 

point is you know what that's a self-contained apartment in the back and he locked both doors so that I no longer 

had my private entry around the side of the house the previous tenant did have a 

private entry now he decides that he's going to lock those two because I can't 

can't have my boyfriend over or my friends Miss Garland he's making me he's making me walk through the main house 

and put trespassing signs Miss Carlin listen to me I'm not excusing and I know 

that he's excitable I'm not excusing his bugging your apartment but you have to 

admit that based upon what you told me he was very nice to you he let you come stay in his house listen he was very let 

you come stay in his house wait until the apartment became available right 

right and you don't think that you would have had any problem with him if you didn't have all this problem with your boyfriend um I disagree I I think he's a 

very perverted individual what makes you think he's perverted I know his um 

ladies that come over on a regular basis um he has a library video of 

adult um in his room he's got makeshift toys that I've never seen before um I 

can't tell you what I found when I went into that room I originally on the 

receiver unit I cut the black wire so that I didn't know there was an off and on switch on the monitor but only was 

not only a an audio unit but a video unit here he repaired the black wire and 

then I went in the next morning cut the red wire it's not until he repaired the unit to listen that I confiscated it and 

when he found when I gave him pictures that I took he clipped the wire from the garage coming through my bedroom wall so 

I was able to pull out the this big 

monitor it was very devastating to hear what going on and everything in my 

place what I'm asking you is is this was this a video unit as well 

as an audio unit an audio unit just audio sir did you tell her that you were bugging her unit what did you tell her 

no that you were bugging her unit no well you can't do this sir I know that 

well you can't do it that's an invasion of her privacy he took the time to drill a hole through a garage wall to meet up 

into my bedroom wall above my here just a second did you drill a hole to get 

into her so that you could monitor what was going on in hered no that was in there before she even moved in there I 

agree with that did you monitor her bedroom activities yes oh and everybody 

else that's rented prior to him I believe that oh sir I don't think you ought to rent 

apartments anymore sir you can't do that it's against the law

his room it's very disgusting I mean if you'd seen what I'd seen and later today that the dogs seem to like each

says she had too many gentlemen callers sir listen to me are you on Social

even with your Social Security yeah I think sir your age if you can avoid

have a renters permit I called housing authority and when they let me know he had assured me when I moved in there after the Last Tenant problem that he 

had with also that he had gotten whatever obtained a rent's permit from building and safety to rent the 

apartment and come to find out he has not miss Garland you didn't pay him rent since 

November right is that correct right how much was the rent it's 65 a week do the 

65 * 4.3 will you please burd may I add also he's been going through my trash I 

found this in his room move Madam you don't stay there and complain it always irritated me when people stood up there 

and said I can't stand my landlord he does this he does that he does and he stays there so I'm going to do I'm going to live there right and I'm not going to 

pay right that's outrageous right 

3,967 now sir she's suing you $5,000 for an invasion of her privacy right and 

she's entitled to that money because what you did was outrageous however hug conduct to me is also not with clean 

hands because she comes to court having not paid you rent what live there without the 

listening devices since November and you haven't seen any money from your property so I am deducting the rent that

fee well it's interesting why why doesn't your dog have papers because I got it from a person who uh wasn't 

taking care of the dog and I told the people that I take it off their hands and give it a proper home and really take care of it but why didn't they give 

you the papers they didn't have papers to begin with he owned um some kind of uh wild animal just a minute you just 

told me that your dog's brother gets $1,000 for stud so if your dog's brother gets $1,000 for stud they the litter 

must have been a registered litter you see I know a little bit about that so if you have a registered litter that means all the puppies in the litter are 

registered which means they can all get papers unless you have taken a puppy with the promise that the puppy would 

not be used for stud come again no okay uh anyhow did

moment did you just tell me that your dog has a brother has a brother yes a 

sister and a mother but the brother is a proven stud and the brother gets $1,000 

for stud service didn't you just tell me that correct so I'm telling you that if the brother uhuh has papers yeah one dog 

in a litter doesn't get papers sir an entire litter is registered with the American kennall Club which means all 

the dogs in that litter get paid papers okay right do you understand that so 

where understand that I didn't get papers though oh yes you just told me that I told you that I didn't get it and 

I just took the dog off their hands this wasn't a puppy when I got it okay now I got the dog and I told him i' give him a 

proper home for it I didn't ask for papers CU I didn't even know if I'd do this I didn't care whether the dog had 

or not to to make another dog so I took the dog you know just trying to give it a proper home cuz I have a good heart 

for you know good so your good heart you're going to give her back her $200 judgments is for the planted for $200

suing Regina for $5,000 order all

yeah this is case number 455 on the calendar in the matter of armis versus kamacho parti warning judge you may be 

seated ladies have seats this suit has to do with an assault that's correct and damages that 

you are asking for yes for an assault that occurred about two years ago yes 

that's correct you were both in high school at the time is that right yes did 

you know each other in high school uh yes we did so there was a of 

gossiping that's what this all started about yes ma'am and you went to her house yes Ma'am why don't you tell me 

why there's just been a lot of a lot of hatred between me and Amanda 

and it just got to the point where it needed to be stopped whether I mean not stopped like what it happened but we 

needed to talk about it and what came out of it was a 

fight that's all very soft why was there a lot of 

hatred just gossip just talking trash about each other like 

what just basically she she would tell someone that she didn't like me or that you on I never told 

any you mean she told people she didn't like you and vice versa I mean I did the same about her we just didn't we didn't 

like each other since like the eighth grade good so you didn't like each other what caused you 

to get in a car and go to her house on Halloween we were out trick-or-treating 

and it was a bunch of us and we started like joking about it like joking about what going to Amanda's house and 

confronting her and we ended up doing that we ended up going to her house she came outside and that we started talking 

about we started arguing back and forth well just a minute did you knock at the door did how did she come outside um two 

of my friends called her outside she came outside mhm she by herself no 

she was with a friend she was with one friend yes and how many friends were you with um quite a few I couldn't tell you 

exactly and how did you get close enough to her to get physical well my witness 

um confronted her first and just said that we needed to talk about a couple things we needed to talk that me and her 

me and Amanda needed to talk about a couple things because of all the problems that we had between each other and then what happened and then I 

I went out there and I started we started arguing back and forth what do you mean you started arguing let's hear 

about I start I I asked her about the things that she was telling people that she didn't like you 

right and what did she say to you she just she denied everything so what was 

next and we just continue to argue back and forth and then someone pushed her into me and that's when we began to

don't justify that but I mean there's there's only so much you can take from 

anybody so far I didn't hear anything terrible I didn't hear anything terrible 

when when people are talking about you it it tends to get on your nerves and get used to it people aren't always 

going to say oh she's lovely Miss kamacho she's lovely she's sweet I like her she's the best thing in the world 

since you know apple pie they're not going to say that all the time there's people there's people that are going to talk about yes but when they constantly 

do it it's yeah it's going to bother you so it bothers you it bothers 

you there were lots of things that bother 

bird how are you injured um I was um diagnosed with the 

Mal alignment in my back and and um I had a black eye MH excuse me the black 

eyy yeah I can I can take that but I'm not the one that kicked you in the back I'm not the one that sent you to the 

chiropractor who did um someone that was with me which and later on became her 

friend but somebody that you brought there kicked her in the back mhm right 

yes ma'am how many times were you either kicked or punched um I don't remember everything 

went so fast your honor but I remember it was repeatedly if you'd like I I have x-rays 

here and also x-rays if I could read X-rays I wouldn't be here I also have um pictures pictures I

suing another student Regina kamacho for assault is this your daughter 

could you step up here please what did you do to her after she 

did this when she came home to tell me that she had done this I I I restricted 

her I recommended her I I what did you mean you restricted her I restricted her for a month from going out having any 

social activities and I told her it was wrong for her to have gone to this girl's house to do what she did at the 

time that she did what she did it was at the spur the moment she was wasn't thinking when she came home she 

understood it was wrong and she came home and told you about it yes she told me right away soon as she got home that night did her mother call you her mother 

did not call me I I had no contact from them until later when the police tried to contact us they never did call us 

again but I was more than willing to settle anything that they wanted that's not true because I never heard from you 

just I would I'm curious to find out what happened with the police could you step up here you're her mom yes did you 

report this matter to the police yes ma'am right away what happened to with the police cuz this was very fuz in the complaint okay uh when the police came 

the police had stopped them already once but they didn't know what had happened yet so when they came to my house they 

told us and we uh described them to the police and they said oh well we just stopped them they were running we 

stopped them and asked them why they were running they oh somebody scared us right well why wasn't this complaint 

ever followed up it was by the police it it there is a police report but she was 

never arrested no said that they contacted um her father and her father said that she had left Las Vegas and got 

married that is not true I mean that was very strange to me why the police never followed up on this assault they 

certainly should have that doesn't necessarily mean she's got to go to jail for 7 and a half to 15 but exactly it 

certainly means that there should be some indication that this is the kind of activity she's involved with because I'm looking at the smirk on her face right 

and it's irritating so Mrs kamacho they're suing for damages 

now your daughter looks like perfectly healthy young woman which means that she goes to school that she should get a part-time job in the afternoon in order 

to pay these damages she is working your own good then she's going to pay for damages because she's responsible for 

the injuries to this young lady but she is going yes you want to say something but her depression and her withdrawal 

from school being afraid to go to school because she was constantly harassed to 

where she up to this day doesn't go to miss armas your mom says that you withdrew from school school yes is that 

after this attack yes it was why did you withdraw from school because everywhere I walked down the hallways they were 

always teasing me always telling me things or harassing her harassing me who 

was her friends and her oh EXC me just a second like what um asking me what I'm 

doing next Halloween asking me how my eye was asking me if my back was okay very but in a smky yeah sarcastic 

way so you dropped out of school yes you you didn't drop out you changed schools went independent 

study how had your grades been before I was an honoral student I have been my 

whole life what your honor I don't I I don't believe that my daughter still continue to harass her because the 

harass she harassed W I know I wasn't there but I know my daughter she doesn't lie to me she is very honest with me 

I've taught her that your daughter came home and told you exactly what happened that night Miss kamacho because the 

police were involved if the police had not been involved your daughter would have told you 

nothing and there isn't a question in my mind that after this incident was over they continued to make her life 

miserable when she was in school she and her friends but she started it which means 

they destroyed what sounds to me is was very successful career in high school because 

socially if you're taunted when you're in high school and if it's uncomfortable you just don't want to go back so your daughter's going to pay for that 

and you're going to pay for it if you're smart you'll make your daughter make up the money but they're suing for $5,000 

and I'm giving it to them judgment is for the plaintiff in the amount of $5,000 thank you your honor parties are excused you may step 

out back up to your right please and now the next case part's on Eastwood versus 

Orosco step forward please 18-year-old Maria Eastwood is suing her friend 

20-year-old Sylvia Orosco for Wrecking her car after a night of 

drinking Miss Eastwood you and the defendant according to your complaint were out for an 

evening doing a little drinking partying bar hopping is that right correct she 

was the designated driver yes and she wrecked your car 

yes you want her to pay for the damage yes I do MH she say she gave you some 

money did you give her some money yes I have receipts right here how much did she give you 600 actually 

it's 750 because um Carissa my witness right here she's she was there that night and um we um she paid for the 

impound because the car got impounded and it was 175 or something like that and I gave Carissa 150 so that went

correct plus the I don't want to bring Chris up here you look as if you're freezing Miss Chris 

huh did you know you were coming to court today chissa hey you think that 

that's an appropriate outfit to wear to court um yes did your dress split or is that the way you put it on this morning

Sylvia arasco to pay damages for her crashed car after a night of drinking 

now how much was the car to be fixed the total damage ronner was 

$257 I have every estimate everything that's been paid towards the car I have 

pictures um my statement the police report the impound everything that you can need is all there now you want to 

explain to me why you think you're not responsible for all the damage to this car because I was doing a favor as to 

her because she got drunk and then when they told me to go get the car I went to go get the car they left they took a 

taxi cab somewhere else I waited for half an hour in the area thinking that they would call me they never did so I 

drove her car all the way back to Carissa's house and then from there finally that got a page and that's when 

I drove to get her cuz she ended up going home with some guy so I I went to go pick her up and that's when I got in 

the accident I was trying to get her because she was drunk she was throwing up on tell me about the accident the 

accident was um I was driving on 880 the freeway and I was turning on to 101 and 

there was a car in front of me and she ran out of gas and it was raining really hard so when I pressed on the banks it 

kept I just kept going so you were going too fast to stop I actually the I was only going 15 

you hit the other car in the rear yeah so it was your fault excuse me so yeah it was F I believe that um Sylvia did 

tell me the next day that she was driving a little um too fast but I have no proof to that documentation doesn't 

make any difference she damaged your car now you what kind of car was this a 91 GE storm 91 Geo mm correct did you buy 

it new no it's secondhand but and how much did you pay for it 

5500 how many estimates did you get um I only have one estimate listed 

in there which is the body work is your car currently being fixed body work no I don't have the money to pay for the body 

work I what did you do with the $600 she gave you oh she paid me four installments of 

$150 and that went towards the amount paid to fix the engine she when she 

wrecked the car she wreck the front end clearly there's a lot of damage to this car yeah the estimate that she got for 

$2,500 is not outrageous considering the kind of damage that there that you did to this 

yeah but I mean she only she gave me the one um estimate from the body work which was was $630 and she never gave me anything else 

after that so I mean how do I how I know yeah she told me but how do I know things happened gradually I thought when 

the car first broke down it was towed to a shop all I don't want to go into it listen yeah it's a long story but if she 

was g money she was going to pay meone she should have asked your honor she should have asked for proof she should 

have went I offered I asked you proof you said you were going to bring it to be quiet please I'm really tired 

$2,500 based upon what I see you you when you come to court you should have three estimates not just one I'm sorry 

do you understand this is my first time in court how long ago did this happen the no November 22 23rd were you 

pretty drunk that night um right here I drunk too much past my limit how old are 

you liit 19 how old were you then 18 

you didn't drink at all I had some during when we first left on the way up 

there she stopped at a liquor store and all three of us were drinking up there but you're supposed to be the designated driver not the designated drunk driver I 

wasn't drunk how old are you I'm 20 and how old were you then 

20 let me tell you something there is nothing less feminine less attractive 

active than a young woman drunk 

nothing nothing that I could think of right away anyway sure there are things that less attractive of course it slits 

up until your Naval is pretty unattractive in court in any event you were supposed to 

be the designated driver MH you didn't do the right thing you were certainly older than she was by a couple I was 

doing the right thing no you weren't if you're the designated driver you're not supposed to have any alcohol designated 

driver is the person who's not supposed to drink any alcohol I wasn't going to be the ne driver because I don't I have a restricted license I knew I couldn't 

drive I never said to her yes I'll be your designated driver she just kept saying she wanted me to drive J $2,500 

she gave you $600 that leaves $1900 now I want to tell you something I 

think that because you own a car at age 18 you have a certain responsibility and 

one of the responsible things that you have to do as a car owner is to make 

sure that the car is not used in an irresponsible way and the only way you can do that Madam is if you're not drunk 

if you want to drink take a taxi cab you used your car what I took the responsible action 

and I decid if I'm going to drink I'm not going to drive I think that's a responsible decision in my age there are 

55 year-old olds that go out and drink and still attempt to drive I I knew if I'm going to drink tonight I'm not going 

she knew I had a restricted license why she put it up me excuse me I did not know if I did I wouldn't have Judge Judy 

is ready to 

rule you also gave her $150 is that right to get the car out of impound M no 

I'm going to give you credit for that your honor me that's included in the 600 no it's 750 you gave me four payments I 

gave gave you four payments I paid Karissa 150 for the inpound cuz Carissa paid for the inpound so that's a total 

of 750 just a second but you had to get your car out of the pound didn't you that's fine you had to get your car out 

of the pound in total if I were to find that she was responsible for the entire 

amount she would have to give you $1,750 but I find that you were at least 

partially responsible for going out getting drunk as a skunk so that you couldn't drive your own car so I'm going to give you $1,500 judg is for the plane 

in the amount of $1,500 that's all parties I excuse
